TOGETHER with all right,title and interest,if any,of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to
said premises,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part,covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever,except as aforesaid.
AND the party of the first part,in compliance with Section 13 of the Lien Law,covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will
apply the same first to the payment of the cost of the improvement before using any part of the total of the same

ALL that certain plot piece or parcel of land, with the buildings and improvements
thereon erected, situate, lying and being at Fleets Neck, Cutchogue, Town of
Southold, County of Suffolk and State of New York, more particularity known and
designated as and by the Lot No. 45 and the immediately adjoining one-half of
Lot No. 44 on a certain map entitled, "Map of Property of Ravatone Realty
Corporation", Cutchogue, Suffolk County, Long Island, New York Section # 1,
Daniel R. Young, P.E. and L.S., Riverhead, New York, dated November 12,
1930, filed in the Office of the Clerk of the County of Suffolk on December 2,
1930, as and by Map No. 539, bounded and described as follows:
BEGINNING at the corner formed by the intersection of the Southerly side of
Fleetwood Road and the Easterly side of Pequash Avenue;
THENCE North 86 degrees 40 minutes East along the Southerly side of
Fleetwood Road, 199.90 feet to the division line between Lots 24 and 45;
THENCE South 32 degrees 15 minutes East along the division line between Lots
44 and 45 and Lot 24, 59.20 feet to a point;
THENCE South 57 degrees 45 minutes West through Lot 44, 175.0 feet to the
Easterly side of Pequash Avenue;
THENCE North 32 degrees 15 minutes West along the Easterly side of Pequash
Avenue, 156.30 feet to the Southerly side of Fleetwood Road, to the point or
place of BEGINNING.
TOGETHER with a free and unobstructed right of way over and upon Fleetwood
Road and East Road to pass and repass on foot, with animals or vehicles to the
beach at East Creek, together with the privilege of using for bathing purposes
that part of the beach at East Creek which lies Easterly of a point marked by
cedar bush growing on said beach. Said rights of way and the right to the use of
the beach to be the parties of the second part, their heirs, legal representatives
and assigns in common with the owners of other lots on said map.
TOGETHER with a Right of Way recorded in Liber 1940 page 395.
Being and intended to be the same premise described in deed to the Grantors
herein from Anthony G. Nowachek and Helen M. Nowachek in Liber 11896 page
290.
