(1) a mortgage dated July 21, 1986 made by The Cove Properties, as
mortgagor, in favor of Bayview Development Corp. ('Bayview") which
mortgage was recorded in the office of the Suffolk County Clerk on
August 8, 1986 in Liber 11857, page 518, and
(2) a mortgage dated August 31, 1987 made by The Cove at Southold, Inc.
("Cove") in favor of European American Bank ("EAB"), as mortgagee,
which mortgage was recorded in the office of the Suffolk County Clerk on
September 16, 1987 in Liber 13339, page 125 (the above mortgages and
indebtedness secured thereby having been consolidated, modified, and
spread, pursuant to a Consolidation, Modification and Spreader Agree-
ment between Cove and EAB dated August 31, 1987, recorded in the office
of the Suffolk County Clerk on September 16, 1987 in Liber 13339, page

The condominium Unit(s ) (hereinafter referred to as the
"Unit" ) known as Unit No. * in the building (hereinafter referred
to as the "Building" ) known as THE COVE AT SOUTHOLD CONDOMINIUM
and by the address of Main Bayview Road, Southold, New York,
County of Suffolk, Town of Southold and State of New York, said
Unit being designated and described as Unit No. * in a certain
declaration made by Declarant pursuant to Article 9-B of the Real
Property Law of the State of New York (hereinafter referred to as
the "Condominium Act" ) , establishing a plan for condominium
ownership of the Building and the land (hereinafter referred to as

particularly described in Schedule A) which declaration was
