Southold Town Board of Appeals
August 8, 1957
A regular meeting of the Southold To~m Board of Appeals was held at ?:30
P.M. on Thursday, August 8, 1957, at the Town Clerk's Oi~fice in Southold, N. Y.
There were present: Mr. Gillispie; Chairman, NLr. Bergen, Mr. Rosenberg and
Mr. Gregonis.
Also: }~. H. M. Terry, Building Inspector.
Absent: Mr. Serge Doyen, Jr.

and seconded by Mr. Gregonis, and carried, minutes were ~oproved.
On motion made by ~,~r. Rosenberg
Letter to Mr. Eyser advising of date of public hearing and legal notices
with affidavits from two official town newspapers were read by the Chairman.
Chairman: "Is there anyone present who wishes to speak "for" this appeal?"
Mr. Eyser: "Yes. I hs~e here buiilding plans and plot plans and would like
to show them to you. I have with me ~. Warner of the Tex~s Company. Also
Mr. DeCamp and Mr. DePiazzy."
Mr. Warner: 'ti would like to say that the buildir~ is set up pretty well in
the center of the plot. The plans show two pump isla.nds, one of two pumps and
the other of three pumps, which is subject to change when we get a final survey.
T~nks are 30~ back from the property line."
C_h~irman:"~Wna~ is going to be along the side of the building and tanks?"
Mr. Warner: "It is going to be asphalt all around."
Ch~irn%gn: "What about entrances and egress from the station to the street."
Mr. Warner: "We have to have curb cuts at various points. There will be
tD~ee entrances, each of 25~. A curbing of 17~ will be at the corner of Locust
Lane with two curbings of 25~ each between the three cuts, leaving 8~ on other
cor~er.II

Mr. Warner: "~e intend to place a Tex~s Comp~uy sign on curbing at the
corner ofthe property."
Chs,irman: "I s~nwondering if it would be favorable to have a grass plot on
the corner."
Mr. Warner: "We prefer a blackout instead of grass as it would be easier to
keep neat and cles~." ~We intend a solid block of concrete which will be nearly
4! back from the line."
Ct~irman: "Just where would the sign be placed?"
Mr. Warner: "It would be placed in the concrete, which goes up about 18
inches. ~f this map is approved a final layout will be prepared and it is possible
that we m~y end with a little different setup as to gas tanks, etc."
The board then discussed in detail the matter of the curbing on Locust Lane
and all ~greed that a 257 should be placed at that corner in the interest of
safety.
Chairman: "Is there anyone here who wishes to speak "against" this exception?"
~'Are there any other questions?" "I think we can make our decision right away."
Mr. E~vser: "We will present final map to the Building Inspector at the time
the permit is applied for and sh~ll ad_here to the recommendations of the board."
Boa~rd unanimously agreed to grant this appeal withthe understanding that
applicant agreed to the stipulation of the board that a 25~ curb be placed on
Locust Lane in the interest of safety.

P~BLIC HEARING: Appeal 1~o. 11 -Application of Mrs. Grace R. Eickles,
Southold, N. Y., for a variance of the Building Zone 0rdins~ce, Article III,
Section 303, on Lot. No. 12, Block 2, ~L~p of Beixedon Estates, 757 x 290~.
Letter advising date of public hearing and legal notices with affidavits from
two official town newsp~oers were read by the Chairman.
Chairman: "Is there anyone present who wishes to speak "for" thi~ appeal?
Anyone "against"? There being no response the board I believe is agreed that
this appeal should be granted."
~ Since this lot is on filed map No. 1472, which we understand is going to
be ~pproved, and dwelling was erected on lot in ~t~ust of 1955, board feels that
strict application of the Ordinance would produce unique ~nd undue hardship.
Since variance does observe the spirit of the Ordinance the bo~rdunanimously
agrees to grs~t this appeal.

Mr. Ernst G. Pm,dford of East Marion, N. Y., presented ur~filed map, dated
September 15, 1950, plan of lots of James Douglass at Orient, N. Y. There are
two lots in question, 68~ on the road and 80~ on the water, with a depth of
200~. Board advised that a variance would have to be applied for in order to
build on either lot. Mr. Radford then mentioned a lot in East Marion, 60~ x
85~ and was wondering whether the buffer or the present owu~er should apply for
the variance. It was the opinion of the board that the variance be applied for
by the buyer when he is ready to build.
PUBLIC HEARING: ~ppeal No. 13 -Application of James DIAgusta, Kenney~s
Road, Southold, N. Y. Application for variance to Zoning Ordinance, Article III,
Section 303, on lot 7o. 8, 75~ x 153~, Kenney's Road, Southold.
Letter to Mr. Dsniel Smith, Main Road, Southold, N. Y., advising of date
of public he~ring, legal notices and affidavits from two official town news-
papers were read by the Chairman.
Chairman: "Ts there anyone present who wishes to speak "for" this appeal?
Anyone wishing to speak "against" appeal? There being no response I believe
the board can make an in~ediate decision."
Since lot was sold under contract previous to adoption of Zoning, this bein~
a time payment deal which was paid up and deed given about june 15, 1957, board
unanimously agreed to grant this ~ppeal for variance.
Hearing Ended.
The Chairman advised that all members of the board were invited to attend
the Town Board meeting at Fishers Island on August 20th.
Next meeting to be held on Thursday, August 15, at the usual time and place.
