BURNS, JR. and ELIZABETH H. BURNS, His wife, both residing at 275 Town Harbor Lane, Southold, New York 11971 party of the second part, WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the Hamlet of Southold, Town of Southold, County of Suffolk and State of New York, bounded and described as follows: D ST- BEGINNING at a point on the Easterly side of Town Harbor Lane distant 229.28 feet Southerly /000 from Main Road and from said point of beginning, running along the Southerly side of land now or formerly of Norkelum and land now or formerly of Cox, C,- 1. North 65 degrees 12 minutes 30 seconds East a distance of 129.35 feet to a point; THENCE along land now or formerly of Overton Estate, South 34 degrees 53 minutes 00 seconds i� East a distance of 209.05 feet; THENCE along land now or formerly of Brester, South 54 degrees 21 minutes 00 seconds West a U distance of 125.12 feet; THENCE along the Easterly and Northerly sides of land now or formerly of Telles; 1. South 58 degrees 02 minutes 00 seconds West a distance of 133.83 feet to the Easterly side of Town Harbor Lane; THENCE along the Easterly side of Town Harbor Lane, North 31 degrees 31 minutes 10 seconds West a distance of 161.14 feet to the point or place of BEGINNING. SUBJECT to a Purchase Money Mortgage in the sum of $250,000.00 executed and intended to be recorded simultaneously herewith. The Grantors herein being the same persons as the named Grantees in a certain deed dated January 23, 1970 and recorded in Liber 66% page 0037. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for " any other purpose. AND the party of the first part covenants as follows: that said party of the first part is seized of the said premises in fee simple, and has good right to convey the same; that the party of the second part shall quietly enjoy the said premises; that the said premises are free from incumbrances, except as aforesaid; that the party of the first part will execute or procure any further necessary assurance of the tide to said premises; and that said party of the first part will forever warrant the title to said premises. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
