SEQRA for Change of Zone for Certain Parcels in

WHEREAS, the Town Board is considering an amendment to Chapter 330 (Zoning) of the
Code of the Town of Southampton to re-classify the zoning district of six (6) parcels from
Office District (OD) to Hamlet Office/Residential (HO), four (4) parcels from Office District
(OD) to Hamlet Commercial/Residential (HC), and one Split zoned parcel from Office District
(OD) and Residential (R-20) to Hamlet Commercial/Residential (HC) in WESTHAMPTON; and
WHEREAS, the Town Board has reviewed the provisions of the New York State
Environmental Quality Review Act (SEQRA) and Chapter 157 (Environmental Quality
Review) of the Town Code; and
WHEREAS, the proposed action meets the criteria of a Type I action; and
WHEREAS, the Town Board of the Town of Southampton proposes to undertake the action
itself and is, therefore, assuming lead agency status; and
WHEREAS, the Town Board has conducted a review of the information contained in the
Environmental Assessment Forms prepared by the Department of Land Management; and
WHEREAS, the potential impacts and the magnitude and importance of potential impacts
have been considered by the Town Board; now, therefore, be it
RESOLVED, that the amendment to Chapter 330 (Zoning) of the Code of the Town of
Southampton in order to re-classify the zoning district of six (6) parcels from Office District
(OD) TO Hamlet Office/Residential (HO), four (4) parcels from Office District (OD) TO
Hamlet Commercial/Residential (HC), and one Split zoned parcel from Office District (OD)
and Residential (R-20) to Hamlet Commercial/Residential (HC) in Westhampton, will not
result in any large and important impacts, and therefore will not have a significant impact
on the environment; and be it further
RESOLVED, that the Town Board hereby adopts a NEGATIVE DECLARATION pursuant to the
State Environmental Quality Review Act and Chapter 157 of the Town Code.

Notice of Adoption: Rezoning of Certain Parcels from Office
District (OD) to Hamlet Office/Residential (HO) and Hamlet
Commercial/Residential (HC), Westhampton
WHEREAS, the Town Board of the Town of Southampton has been implementing the
recommendations of the 1999 Comprehensive Plan Update and individual Hamlet plans that
call for zoning changes from Office District (OD) to Hamlet Office/Residential (HO) and
Hamlet Commercial/Residential (HC); and
WHEREAS, eleven (11) parcels have been identified in Westhampton for reclassification
where the existing uses will be supported by the new zoning and allow for greater flexibility
in the future; and
WHEREAS, on August 11, 2015 the Town Board of the Town of Southampton held a public
hearing to hear any and all persons for or against the proposed zoning changes, with no
public comment given at the hearing or during the written comment period; and
WHEREAS, upon review and discussion related to the proposed change to HO and HC zoning
districts in Westhampton, the Town Planning Board forwarded a resolution that indicates
they have no planning issues and supports the Town Board's motion to change the zoning in
accordance with the adopted 2004 Eastport/Speonk/Remsenburg/Westhampton Area Study;
and
WHEREAS, the Suffolk County Planning Commission considered the action for Local
Determination; and
WHEREAS, the Town Board has reviewed the SEQRA information and has adopted a
Negative Declaration by separate resolution; now therefore be it
RESOLVED, that Local Law No. 26 of 2015 is hereby adopted as follows:

Southampton and the corresponding zoning map in order to re-classify the zoning district of
six (6) parcels from Office District (OD) TO Hamlet Office/Residential (HO), four (4) parcels
from Office District (OD) TO Hamlet Commercial/Residential (HC), and one Split zoned
parcel from Office District (OD) and Residential (R-20) to Hamlet Commercial/Residential
(HC) in WESTHAMPTON
BE IT ENACTED by the Town Board of the Town of Southampton as follows:
SECTION 1. Legislative Intent.

since the demand for conventional offices is limited, the Update recommends that the OD
district be generally replaced with the Hamlet Office/Residential District (HO) This district

permits offices and selected retail/service establishments as well as residential uses
.
In the subject zoning change that is being contemplated, the adopted Eastport/
Speonk/Remsenburg/Westhampton Area Study recognizes the small farms, historic
residential neighborhoods, scenic corridor along Old Country Road, and Cooks Pond in
Westhampton as well as the way that the terminus of Mill Road at Montauk Highway serves
as a transition into the Village of Westhampton Beach. Currently this area has a mix of uses
and is primarily zoned Office District (OD).
To accomplish the objectives of maintaining West
strip development and providing an orderly transition in uses, density and bulk between the
existing residential, retail and office development, Hamlet Office/Residential (HO) would
replace the current Office District (OD) zoning along Mill Road and Montauk Highway in
Westhampton as recommended in the Area Study as the permitted uses, scale of
development and design restrictions would render development that is more compatible
with the surrounding community character.
These areas should maintain their current residential scale as a transition to adjacent
commercial (retail/office), open space or residential development. HO would generally allow
offices, housing, and low-traffic generating retail and service uses such as those now
allowed in office districts, i.e. antique stores, galleries, restaurants but without liquor
licenses). High traffic/impact uses would not be allowed, i.e. video stores, liquor stores,
fast food establishments, Laundromats, dry cleaners, and gas stations. In addition, HO
zoning would entail performance standards, requiring that buildings appear to be residential
(no front parking, ear or side parking), use residential style setbacks, reduced lot coverage,
i.e. 20% - 25%, small building footprints, i.e. up - to 3,000 square feet, residential style
windows and entries, pitched roofs, and discrete signage.
The proposed Hamlet Commercial/Residential (HC) zoning would replace properties to the
east of John Way along Mill Road in the transition areas that leads to the Village of
Westhampton Beach Business District. The HC zone would involve much the same design
and performance standards as HO zoning, but would allow by special exception some of the
commercial and retail uses allowed in the Village Business districts, in addition to housing,
offices and other HO uses.
SECTION 2. Amendment.
The rezoning contemplated is identified specifically by parcel and district change in the
following chart:

The Town Board may adopt local laws providing for zoning map amendments pursuant to
Town Law §265 and Municipal Home Rule.
SECTION 4. Severability.
If any section or subsection, paragraph, clause, phrase or provision of this law shall be
adjudged invalid or held unconstitutional by any court of competent jurisdiction, any
judgment made thereby shall not affect the validity of this law as a whole or any part
thereof other than the part or provisions so adjudged to be invalid or unconstitutional
.
SECTION 5. Effective Date.
This local law shall take effect upon filing with the Secretary of State pursuant to Municipal
Home Rule Law.

Notice of Public Hearing on the Draft "Southampton Water
Protection Plan" Proposed to be Adopted as a
Comprehensive Plan Element
WHEREAS, the waters and waterfront area of the Town of Southampton have defined the
character of the Town since its founding - the shoreline areas; the barrier islands; and the
waters of the Atlantic Ocean, Peconic Bay, and the south shore bays; as well as the streams
and fresh water ponds, have provided the Town with extensive and diverse resources and
throughout its history; and
WHEREAS, these precious resources are increasingly subject to the pressures of population
growth and economic development, which include requirements for industry, commerce,
residential development, recreation and preservation so that the Town is often faced with
competing demands; and
WHEREAS, the Town of Southampton has strived to protect itself from the loss of marine
resources, diminution of open space areas, shoreline erosion and permanent adverse
changes to ecological systems and loss of economic opportunities by enacting a number of
effective regulatory tools to protect, preserve, and promote sustainability throughout the
coastline; and
WHEREAS, the Water Protection Plan as a Town comprehensive plan integrates the existing
ƚƷŷĻƩ ƩĻƌĻǝğƓƷ ƌƚĭğƌ ƌĻŭźƭƌğƷźƚƓ
recommendations of the 1999 Comprehensive Plan Update and
to provide a logical framework for long-term guidance related to preservation, use, and
fisheries and traditional maritime industries, increasing recreational opportunities,
promotion of environmentally sensitive development and eco-tourism, preservation and
enhancement of boating and maritime activities, continued support of aquaculture and clean
water initiatives, and fostering the viability of water dependent and water-enhanced
businesses, all of which will increase economic prosperity and improve the quality of life for
