Southold Town Board of Appeal~
August 29, 1957
A regul~ meeting of the Southold Town Board of Appe&ls was held at 7:30 P.M.
on Thursday, August 29, 1957, at the Town Clerkls office in Southold, N. Y.
There were present:

306 of the Zoning 0rdinat~ce. Lot No. 78, East Side Bay Shore Road, Peconic Bay
Estates, Greenport, N. Y., 75! x 1801.
Letter to Mr. Hendry advising date of ou%lic hearing, application for the
special exce'otion and legal notices with affidavits from two official town news-
papers were read by the Chairman.
Chairnm. n: "Is there az~yone present who wishes to spesk "for" this appeal?"
5~. Hendry: "I thizdc I ~have stated in the application why I would like this
special exception. I bought the property some years ago with the idea of putting
up a house looking on the water. It will not destroy but improve the neighbor-
hood and will not be a hazard. It is in keeping with everything else on the
street. The l~zil¢!ing lines, setbacks, etc. will be in keeping with everything
in the locality."
Mr. Rosenberg: "Is that a wooded area ~r. Hendry?"
Mr. Hendry: "AYm, jority of it will be t~dcen down with the exception of a few
choice trees."
Chair~: "Is that everything ~'
,~r. Hendry?"
~r. Hendzy: "Yes. I would Also like to say that we are going to put in a
bulkhead and jetty."
Ohairm~an: "Is there anyone who would like to speak "against" this ~ppeal?

There being no one oresent wishing to speak "against" this ~peal I believe the
Board can reach an immediate decision. Board unanimuusly agrees to grant this
appeal for special exception."

Mabel G. Connery (Mrs. Francis R. Conne~y), Luther Ros~d, ~ttltuck, N. Y.
Mrs. Connery questioned the board regarding ProPerty 1801 x 2421 on Luther Road,
M~ttituck, formerly owned by John R. Connery, which is now an estate s~d which they
would now like to sell. There are'll bungalows on the property at present ~nd these
have been rented for over 15 years, for approximately l0 weeks during the summner
months. The property is now zoned "A" Residentie,1 snd Agricultural snd as prospec-
tive buyers are questioning the rights they would have under the "A" zone Mrs.
Connery would like to have it zoned "B" Business District. Cotts~es about 18~ x 20~.
Mr. Frank Hussk, Luther Road, Mattituck, N. Y. Mr. Huzak owns 2 acres of
land, 200~ x ~37~ adjoining Mrs. Connery~s land, on which he has two housekeeping
cottages; one 20~ x 22~ ~ith an 8~ porch s.nd the other 18~ x 20~ with s~ 8~ porch
and. he intends to erect several more. Mr. Husak Questioned first, why this was not
zoned for Business ~nd secondly, will it be zoned for Business. Mr. Huzsk said
another neighbor, ~. Ernst Yoh also rents ~d he did not think that any of the
neighbors would object to h~ing these properties zoned "B" Business.
Board advised both Mrs. Connery and ~J~. Huzak to obtain the necessary forms
from the Building Inspector in order to file a petition for a change of zone which
would have to be filed with the Town Board. Board advised that perhaps it would
be best that Mr. Yoh file at the sa~e time.

by F. F. Overton in 1908, 2~nd additions from surveys and_ air map by Otto W.
Van Tuyl & Son. Mr. Tyte explained t~hat he represented a non-profit christian
group, tentatively known as the Soufud View Bible Fellowship and was here to ask
the Board's suggestions on the proposed layout of the property if they purctm~sed
it for the Fellowship. He explained that it was their intent to put in a 50~ road
from the Middle Road to the Sound. Part of the land would be sub-divided into
100~ x 125~ lots to be sold as home sites and the remainder of the land at the
Sound would be used for a Meeting House, School, playgrounds, etc. It is their
intent to always keep the Beach private. It was the Board's suggestion that they
~ve a plan drawn, showing in detail layout of road, etc., which they could present
to the Southold Town Planning Board for their recommendations.
Discussion was held by the board on the subject of trailers snd it was decided
to recommend to the Planning Board, in the form of a letter, that the use of land
in the "A" District be prohibited for trailer residences. It was further suggested
theft some thought be given to the To~ of Southold establishing a trailer camp_
site.
Meeting adjourned at 11:55 P. ~4.
