Our application for the location of the proposed park shelter building seems to have turned into a debate not only over the location of the shelter but whether the shelter should be constructed at all. The present feed back that we are receiving is against constructing the shelter and we have determined that in order to pacify everyone we will not be going ahead with the project at this time. In the future we will notify all of our residents of any major changes to or projects in any of our parks. This will give them the opportunity to come to our regularly scheduled meetings and voice their concerns to us. For this reason we have decided to withdraw our application for a variance at this time with thanks to your board and staff for the work put into this application to date. Thank you. A number of neighbors have become concerned with the change of use that will he introduced by reason of any grant of the requested variance. The neighbors are • particularly concerned that the front yard setback request has not addressed what the neighbors perceive as a likely eventual undesirable change in the neighborhood. Many of us ere weekend residents only and it is difficult for us to deal with a matter such as this on the limited time afforded. They are also aware that the requested side yard variance will place the building at probably the most advantageous,position as it-relates to my client's property and those of adjacent property owners in terms of their open view'of the beach and bay. However, despite the applicant's attempts to place the building in an unobtrusive position, my clients•still have concerns. - First, there appears to have been no submission by the applicant of any evidence that some type of temporary structure, erected only during•the months of the parks operation.May,3.1st through-October 15th could.not accomplish the same end as the . proposed structure.,,Since:the proposed-structure•is an "open air'-•type pavilionthere may ' be alternative temporary structures that could suffice to achieve the applicant's goal, which.by;the,way does not appear to have been articulated. In this regard, the applicant has not submitted any evidence to,support the need for a-structure of-this type since Southold Town residents have been using the park for picnics without such a structure for a lengthy period of time. Has the public made its voice known to the applicant? Has demand for such a structure been requested by a large number of park users? Has the applicant conducted a study indicating the need for a covered pavilion? We believe that the applicant while entitled to build should at the very least support their request with some evidence of need. Second, if the application for a permanent structure is approved this Board certainly has the power to impose conditions on the structure limiting the materials and colors used to insure that the final product at least somewhat comports to the surrounding area. Third, if the need for a structure can be established by the applicant there appears to be no need for one of this size, that is 30' x 44'. If the variance is to be granted my clients' request that the Board require that the building be smaller, again so as not to destroy the ambiance of the park and beach. Additionally the building as proposed stands 13' high. We see no reason why the height of the building cannot be reduced. A combination of smaller size with a lower roof will reduce the visual impact of the structure if it is found that the applicant is entitled to this permanent type structure. Fourth, there appeared to be many discrepancies in the testimony regarding the number of trees that would be destroyed by the erection of this building. We ask that the Board to take a"hard look" at the site and limit by a condition of approval, if approval is to be granted, the number of trees that can be destroyed so as to limit the impact on the surrounding area. The applicant's letter to my clients and others dated 4/10/01 states that a maximum of five trees will be removed and those trees will be replaced by new plantings in different locations. Town Hall , i1,---- U ____________L-2 i" � 53095 Main Road __ __f Southold, N.Y. 11971 Gentlemen: Just today I learned from neighbors on South Harbor Road that a gazebo is planned for South Harbor Park, which will necessitate cutting down a number of well-established trees . Since the park has been a pleasant, shady retreat for many peopleoverthe years, a gazebo seems unnecessary, and may turn out to be an "attractive nuisance" . The traffic down this street on weekend nights and during the summer is very noisy and unpleasant. It seems too bad to ruin a rural oasis. My family summered out here since the 1930 ' s, and the atmosphere was uncrowded and peaceful . In the 1970 ' s on retirement my husband and I bought a home on South Harbor Road, which was pleasant and quiet. However, in the past twenty years the traffic has increased tremendously. I respectfully request that the Board consider the necessity of a gazebo in this small park, with resultant loss of trees . The Commissioners have reviewed all the comments made by the members of the appeals board, by owners of neighboring properties and nearby park neighbors at the hearing April 5, 2001 and have determined that,as they stated in their application,the location chosen is the best place-for this pavilion for all concerned and would like to go ahead with the project. The Commissioners estimate at this time that there are over seventy trees in the park itself and that the maximum number of trees to be removed to accommodate this pavilion will be five. These trees are estimated to be less than one hundred years old. They would like to assure you that they will replace these five trees with new plantings in different locations in the park. South Harbor Road off the bay. This will affect those living closest to the ,park, as those trees will no longer be a natural barrier to the weather.
