SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated September 21, 2015 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated September 17, 2015. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: Parcel is a non-conforming 29,485 square foot lot, with 16,985 sq. ft. of buildable area, located in an R-40 Zone District. Parcel is improved with a one story frame house with attached decks. It has 77.34 feet of frontage on Broadwaters Road, 301.60 feet along the eastern property line, 371.44 feet along the western property line and 119.74 Feet on Broadwaters Cove. All shown on a survey prepared by Peconic Surveyors dated March 2, 2011, last revised August 26, 2015. BASIS OF APPLICATION: Request for Variances from Article XXIII Section 280-124 and the Building Inspector's July 30, 2015 Notice of Disapproval based on an application for building permit to construct additions/alterations to existing single family dwelling, at; 1) less than the code required minimum side yard setback of 15 feet,2) less than the code required total combined side yard of 35 feet. RELIEF REQUESTED: The applicant proposes to construct an addition to enlarge the master bedroom in-the rear of the home facing the water. The construction will maintain the 5.5 foot side yard setback where the code requires 15 feet and the combined side yards shall remain at 32.5 feet where the code requires 35 feet total combined side yards. Page 2 of 3—October 15,2015 ZBA#6887—MacGregor SCTM#1000-104-9-2 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 1, 2015 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law§267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The majority of the improved lots on the east side of Broadwaters Road are larger parcels than the subject property. The subject dwelling has been in existence for many years in its present location. The proposed addition is an infill between the existing home and the attached rear deck. The addition will not be visible from the road or to the adjoining neighbor. 2. Town Law &267-b(3)(b)(2) The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The dwelling has existed in its present non-conforming location since prior to zoning. The addition is approximately 108 sq. ft. and is a small bump out on the rear of the dwelling. 3. Town Law §267-b(3)(b)(3). The variance granted herein for the single side yard setback is mathematically substantial, representing 63% relief from the code. However, the single side yard exists at 5.5 feet, the home has been in existence since prior to zoning and the proposed construction will not compromise this single side yard. The variance granted herein for the combined side yard setbacks is not mathematically substantial representing 7% relief from the code. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has not been self-created. The applicant is creating additional bedroom space within the existing footprint of the dwelling which has a Pre-CO dated prior to zoning. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new addition to their home while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman (Chairperson), seconded by Member Dantes, and duly carried,to GRANT, the variances as applied for, and shown on the architectural drawings prepared by studio a/b architects dated 8/13/15 pages T.O1, A.03 —A.05 and the survey prepared by Peconic Surveyors dated March 2, 2011, last revised August 26, 2015. Subject to the following condition; CONDITION: 1. Applicant shall continuously maintain the existing natural buffer landward of the surface water and seaward of the lawn area, as per recommendation of the LWRP Coordinator. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the LWRP. This recommendation was based on the following assessment: 1. The action is not discordant with the build out of the adjacent lots in the community (Figure 1). 2. Further encroachment into the side yard will not occur as a result of this proposal. The existing structure has an existing side yard of 5.5'. 3. The width, composition and maintenance activities could be memorialized within a covenant and restriction. A sample definition of a natural vegetated buffer is included for your use. NATURAL VEGETATED BUFFER -- a land area of a certain length and width where existing vegetation occurs prior to the commencement of any grading or clearing activity. Vegetation shall be maintained to achieve a minimum percent ground cover of ninety-five (95) percent. To achieve the percent ground cover indigenous, drought tolerant vegetation shall be planted. Survival of planted vegetation shall be (ninety) 90 percent for a period of three (3) years.
