SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated September 21, 2015 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The applicants' properties consist of two parcels. Tax lot 9.6 currently contains a 36,364 sq. ft. area located within the HB zone. Tax lot 9.6 is improved with a 1 story commercial structure. Tax lot 22.2 contains a 48,247 sq. ft. area located within both the HB and R-40 zones. This parcel, straddling the HB and R-40 zones, is improved with a single-family dwelling, a swimming pool, and two accessory garages. The portion of this parcel located within the HB zone also has a code permitted use of sand and gravel storage. The property is shown with all buildings and setbacks, and also the proposed lot line change, on the survey drawn by John C. Ehlers Land Surveyor, dated October 1,2014. BASIS OF APPLICATION: Request for Variance from Sections 280-18 Request for Variance under Article IV Section 280-18 and the Building Inspector's July 27, 2015 Notice of Disapproval based on an application for building permit for a lot line change, at: Proposed SCTM#1000-114-11-22.2 - 1) less than the code required minimum lot size of 40,000 sq. ft. RELIEF REQUESTED: The applicants request a variance to create a lot line change. The applicants propose to detach a 9,258 sq. ft. portion of lot 22.2 that is located within the HB zone, and attach the land to lot 9.6. This will reduce lot 22.2, from an existing code conforming size lot containing of 48,247 sq. ft. to a non-conforming size of 38,989 sq. ft., and increase lot 9.6 from an existing size of 36,364 sq.ft. to a new proposed size of 45,622 sq.ft. ADDITIONAL INFORMATION: This application requires Town Planning Board site plan approval. The Planning Board submitted a memorandum dated Sept. 15, 2015, that states in part that they "conditionally support Page 2 of 3—October 15,2015 ZBA#6888—13400 Main Road Corp. SCTM#1000-114-11-9 6&22 2 the Area Variance creating a non-conforming lot in the R-40 zone" because it is consistent with the Town's Comprehensive Plan in that it will enhance an existing business use in the hamlet center by providing additional parking for their existing parking lot. In their memorandum, the Planning Board questioned if the reduction in lot area would require an area variance for the continuation of the existing sand and gravel business use. The applicant's attorney submitted credible evidence in a detailed letter dated September 30, 2015 and in testimony at the public hearing that a variance would not be required. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 1, 2015, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. There will no increase in traffic, or in overall use of the tax lot 1000-114-11-22.2 as a result of the grant of the variance for a new non-conforming lot size. This split zoned HB and R-40 property is improved with a legally existing sand and gravel storage business and a single family dwelling. The sand and gravel business will be contained within the smaller remaining portion of land in the FIB area of the parcel after the lot line change, and will likely operate on a smaller scale than it does right now. 2. Town Law $267-b(3)(b)(2). The benefit sought by the applicants could be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicants could have created a conforming size R-40 lot by moving the proposed new lot line and reducing the sq. ft. conveyed to lot 9.6. However,this would result in a less desirable plot in relation to other existing adjacent lot lines, and be of less benefit to all of the property owners. 3. Town Law $267-b(3)(b)(3). The variance granted herein is not mathematically substantial, representing 1,011 sq. ft. and 2.5% relief from the code required 40,000 sq. ft. for the proposed non-conforming 38,989 sq. ft. parcel. 4. Town Law 0,67-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicants to enjoy the benefit of a lot line change, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Horning, seconded by Member Weisman (Chairperson), and duly carried,to GRANT, the variance as applied for and shown on the survey drawn by John C. Ehlers Land Surveyor, dated Oct. 1, 2014; SUBJECT TO THE FOLLOWING CONDITION 1. The applicant must obtain site plan approval from the Planning Board. The applicant is proposing a Lot Line Modification that will transfer 9,258 sq. ft. of land zoned Hamlet Business (HB) from SCTM#1000-114-11-22.2 to SCTM#1000-114-11-9.6 (also zoned entirely Hamlet Business). Parcel 22.2 is split-zoned, -and this proposed transfer of land will result in this parcel becoming non-conforming to the R- 40 Zoning District (from 48,247 sq. ft. to 38,989 sq. ft.). The Planning Board, at this time, conditionally supports the Area Variance creating a non- conforming lot in the R-40 Zone for the following reasons: 1. This transfer of land is consistent with the Comprehensive Plan in that it will enhance an existing business use in the hamlet center by providing additional parking. The area being transferred is zoned HB, and is being added to an adjacent HB-zoned parcel which requires additional parking. Please note that this parking area is subject to the Site Plan process. 2. No new residential building lots will be created by this Variance. 3. SCTM#1000-114-11-9.6 is improved with a single-family residence which is consistent with the allowed uses of the R-40 Zone (after the lot line change, 70% of this parcel would be zoned R-40). *L2P13400 Main head LLC - Page 1 2 — September '�u, 2015 (1%S'' One concern of the Planning Board is that Parcel 22.2 appears to have an existing commercial use (gravel yard) located in the rear of the property in the HB-zoned area (please see Figure A). As proposed, the transfer of land (9,258 sq. ft.) from Parcel 22.2 to Parcel 9.6 will reduce this HB area from approximately 20,642 sq. ft. to approximately 11 ,384 sq. ft., creating what seems to be a non-conformity with the Bulk Schedule given that there is also a single-family home on the property, and the total parcel area will be less than 40,000 sq. ft. We are seeking the area variance as the lot will be 1,011 sq.ft. under the required minimum 40,000 sq.ft. Lot 9.6 will be increased to 45,622 sq.ft. RECEIVE*) STATEMENT OF FACTS SEP 01 2015 BOARD OF APPEALS The applicants are the Raymond F.Nine Trust*,the owner of 855 New Suffolk Avenue, Mattituck,New York(SCTM# 1000-114-11-22.2) and 13400 Main Road Corp., the owner of 13400 Main Road, Mattituck,New York(SCTM# 1000-114-11-9.6). The parties have entered into a Contract of Sale dated April 17, 2015 wherein the Raymond F. Nine Trust agreed to sell 9,258 sq. ft. of vacant land, a portion of Lot 22.2,to 13400 Main Road Corp. The Contract of Sale is contingent upon Purchaser obtaining a lot line change from the Southold Planning Board in which the area being transferred (9,258 sq. ft.)will thereafter be merged with Purchaser's adjoining party on Lot 9.6. The Contract is also contingent upon the Purchaser obtaining Site Plan approval allowing the purchased premises to be used as a parking lot for the existing building on Lot 9.6. Mr. Nine will continue to operate his sand and gravel business on Lot 22.2. Town documents allowing the use are attached hereto and made a part hereof. As a result of the proposed lot line modification, Lot 22.2 will be decreased from 48,247 sq. ft. to 38,989 sq. ft. Lot 22.2 is in a split zone and the area to be transferred is in the HB zone. Lot 9.6 is in the HB zone and the lot size will increase from 36,364 sq. ft. to 45,622 sq. ft. As previously stated the 9,258 sq. ft. being transferred is to be used as an additional parking area for Lot 9.6 in the rear of its existing building. *Dorothy J. RECEIVED SEP 1 2015 RELIEF REQUESTED OARD OF APPEALS As a result of the proposed lot line change and the reason the area variance is needed is Lot 22.2, a conforming 48,247 sq. ft. lot,will become non-conforming at 38,989 sq. ft. The area variance relief sought under Article VI, Section 280-18 is 1,011 sq. ft. In addition,the proposed lot line change will not conform to the parking schedule set forth in Section 280-78A. AREA IN WHICH THE SUBJECT PROPERTY IS LOCATED Lot 9.6 is located in the HB zone and is surrounded by commercial businesses on Main Road. Lot 22.2 is located in a R-40/HB zone. A portion of the property consists of a residential house, swimming pool, and detached garage. On the HB portion of the property that is in the rear of the adjoining lot to the west,there is a garage. AREA VARIANCE Pursuant to Town Law Section 267-b, the Zoning Board of Appeals is required to consider the following factors when deciding whether the standards for a variance have been met: (a) whether the grant of the variance will cause an undesirable change in the character of the neighborhood or will create a detriment to nearby properties; (b) whether the benefits sought by the applicant can be achieved by some method feasible for the applicant to pursue other than an area variance; (c) whether the requested area variance is substantial; RECEIVED (d) whether the grant of the variance will have an adverse SEP 01 2015 effect or impact upon the physical or environmental conditions in the neighborhood or in the affected area of the Town; BOARD OF APPEALS (e) whether the difficulty causing the applicant to request an area variance was self-created which consideration shall be relevant to the determination of the Board but shall not necessarily preclude the grant of the variance. It is clear that the benefit to the applicant from granting the variances outweighs any detriment to the general health, safety and welfare of the neighborhood and the Town as a whole. The proposed lot line and reduction in square footage of Lot 22.2 will not adversely impact any of the neighbors. The variance of 1,011 sq. ft. is necessary for expansion of the current parking behind the existing building on 13400 Main Road. 1. There Will Be No Undesirable Change In The Character Of The Neighborhood Or Detriment to Nearby Properties The grant of the requested variance will not cause any desirable change in the character of the neighborhood or detriment to nearby properties. There will be no change in the volume of traffic or noise granted if the variance is granted. The additional area will provide needed parking for building occupants, staff and their customers. 2. The Benefit Sought By The Applicant Cannot Be Achieved By Some Method Feasible For The Applicant To Pursue Other Than An Area Variance Due to the configuration of Lot 22.2 and Lot 9.6 there is no other feasible alternative than to seek an area variance as the lot size of Lot 22.2 will be reduced under the minimum lot size required in a R-40 zone. 3. The Variances Requested Are Not Substantial The variance when viewed in relation to the existing structures and neigbhooring lots is minimal in nature. Lot 22.2 and Lot 9.6 will continue to remain in conformity with surrounding properties and uses. Community and neighboring properties would not be impacted. 4. The Application Will Not Have An Adverse Effect Or Impact On The Physical Or Environmental Conditions In The Neighborhood Or District The variance will not have an adverse impact on the physical or environmental conditions in the neighborhood. The use of the properties will remain the same. 5. The Situation Which Lead The Applicant To Seek A Variance Is Not Self-Created The difficulty is self created to the extent that the parties are in Contract and due to the current configuration of the lots and their current uses,the area vari ce is needed RECEIVED to reconfigure the lot lines to meet the needs of the applicants. Mr.Nine was surprised this week to find a ZBA member on the property, and was not prepared to answer questions. Thus, this business use is well established and permitted by Southold Town. The remaining HB area will contain sufficient area for the materials and equipment, as well as the garage, which contains room for storage and service. This use will now function with a reduced area,but one that is adequate for business purposes.
