WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in the

feet; Thence North 15 degrees 02 minutes 30 seconds west 200.00 feet to the
1000 southerly side of Main Road; Running Thence easterly along the southerly

BEING AND INTENDED TO BE the same premises conveyed to the party of the
Block first part by deed dated 11/23/88 and recorded 11/29/88 in liber 10745 page

04.00 That this conveyance is made in the usual, ordinary course of business of
the party of the first part.
Lot The conveyance of title hereunder shall not effect a merger of the following
022.000 mortgagee into the fee title of the above-described premises,
(a) Mortgage dated 04/29/83, in the amount of $ 185,000.00, made
by Theresa Frohnhoeffer to Southold Savings Bank, which mortgage was
recorded in the State of New York, Suffolk County Clerk's Office on
05/19/83, in Liber 9565 mp 495, and extended by Extension Agreement
dated 07/25/91, made between Fudge Corp. and Southold Savings Bank,
which agreement was recorded in the Suffolk County Clerk's Office on -
• 08/09/91 in Liber 16934 page 395, extending mortgage in Liber 9565
mp 495;

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenpnts.1hal the party of
the first part will receive the consideration for this conveyance and will hold the righj to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indentpre so requires.
