That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will,at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months,which is considered to be the estimated time required to complete the work involved,but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required,upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. Box 1179 Southold, New York 11971 Re: Fishers Island Development Dear Board Members: As you know, I represent Mark Andrews who owns a parcel of approximately 10 acres located on Castle Road and abutting and/or surrounded by the Fisher's Island Club. (Property known as "Sea Wynde") Following my appearance at the Trustees meeting on July 22'd and at the Board's request,my client hired an Engineer to provide the Board with his professional opinion of the current application, and the impact of future water usage at the golf course. Enclosed please find a letter from John F. Sima III at Hydro Dynamic Engineering,LLC. Mr.Sima's resume' is also attached. (Seven(7)sets are enclosed for circulation to all Trustees and Town Counsel.) Kindly make this information a part of the file for this application and consider my client's continuing request that a condition be imposed that: There will be no significant increase in the amount of water used for irrigation and that if, in the future, there is a plan for significantly increased use of water, such increase will not occur until Mr. Andrews and/or all surrounding residents receive confirmation from a hydrologist that it will have no negative impact on their water supply. My qualifications for this include more than 40 years' experience in the ground water industry, having drilled several wells on Fishers Island, and having conducted many ground water impact studies for golf courses in Connecticut. A copy of my resume is attached. This investigation addressed whether this storage pond enlargement will adversely affect the water supply well(s) serving Mr. Andrews' property. To prepare this letter, I have reviewed a letter addressed to your Board and prepared by Mr. Wayne Bugden, dated June 16, 2015, and one prepared by Barbara Rasmussen, dated July 17, 2015. I have also reviewed a plan for the pond enlargement, prepared by CME Associates Engineering, dated 09/16/2014. In my professional opinion,the simple enlargement of the pond will not adversely affect the water supply well at the Andrews' property, but some assurance should be provided that the average volume of water used for irrigation does not increase. The assurance language proposed by Ms. Rasmussen in her letter to you of July 17 would address this point. Since the neighboring wells have not been adversely affected to date, it is reasonable to assume that if the golf course does not significantly increase the volume of water withdrawn from its wells and the irrigation ponds,there will be no adverse impact. I recommend that the golf course submit its water use records to-date, and in the future,to Mr. Andrews to demonstrate that-the withdrawals for irrigation do not significantly increase. If no records have been kept yet,then begin to keep them now as follows: -Install totalizing flow meter(s) on the irrigation pump(s) immediately; - Read and record the meter(s)weekly during the irrigation season; - Provide copies of these weekly readings to Mr. Andrews, on an annual basis or upon 547 Shuttle Meadow Road,Southington,Connecticut 06489• (860)628-4622 1 Hydro Dynamic Engineering,LLC Southold Town Trustees August 10, 2015 Page 2 • Mr. Andrews' request; and - Ensure that each month's total use does not exceed the average use for that respective month by more than 5%. _ . Making Ms. Rasmussen's proposed stipulation a condition to any approval and/or resolution that the Town Trustees grant on this application would address this point. Based on my assessment,it is my professional opinion Ihat the proposed project will have little effect on the water table in the area of the pond,and will cause no significant impact to othor users of water in the area I base this conclusion on lite following factors: • Pumping,wdler from a pond can have an effect on the water idble in the surrounding shallow aquifer. Tile degree of such effect is primarily a function of the amount of water removed and the permeability of the surrc>unciing aquifer materials. • The plan involves removal of invasive Phroyrnites and approximately 6,670 cubic yards of silt,muck and peat accumulated in the pond to create a pond with a maximum depth of El feat and surface area approximately 30,770 square feet;the purpose of the project is to increase the available water storage capacity of the pond for continued irrigation use. • The existing water storage poi Id receives water pumped from two irrigation wells located several hundred feet to the northeast;this pumping is expected to continue with little change in the pumping rate,and the new storage pond will be connected to the existing storage pond with a buried pipe. When water is pumped from the pond,the lowering water elevation will induce water to flow into the pond from the adjacent saturated soils,and a slight lowering of the water table Conversely, water pumped into the pond from the irrigation wells will leak out into the aquifer unlit equilibrium is reached The net effet I of alternately pumping water into the pond, and withdrawing water from the pond,would be minor fluctuations in the water table—an effect that occurs already with the operdlion of the existing irrigation pond. Any work, disturbance, and or storage of construction materials shall be confined to within the limit of clearing and ground disturbance shown on the approved plan. 5. Materials Disposed at Upland Site Any demolition debris, excess construction materials, and/or excess excavated materials shall be immediately and completely disposed of on an approved upland site more than 100 feet from any regulated freshwater wetland. These materials shall be suitably stabilized so as not to re-enter any water body, wetland, or wetland adjacent area. 6. Sediment Use/Disposal Requirement The permittee must inform the Department and the Town Clerk, in writing, where the sediment dredged or excavated from this project will be used/disposed of. In any case, the location must be greater than 100 feet from any regulated freshwater wetland and 300 feet from any regulated tidal wetland. Equipment Storage 100' from Wetland, Water Body All equipment and machinery shall be stored and safely contained greater than 100 feet landward of the regulated wetland or water body at the end of each work day. This will serve to avoid the inadvertent leakage of deleterious substances into the regulated area. 8. Vegetation Disposal Requirement Any cut or removed Phragmites australis must be disposed of in a landfill. 9. Grading Restriction Within those areas shown to be replanted, the permit holder must achieve the proposed contours shown on the approved plan. 10. Planting Required All areas must be planted as shown and noted on the approved plan. 11. Seed,Mulch Disturbed Areas All areas of soil disturbance resulting from this project shall be seeded with an appropriate perennial grass, and mulched with straw immediately upon completion of the project,within two days of final grading, or by the expiration of the permit, whichever is first. 12. Temporary Mulch,Final Seeding If seeding is impracticable due to the time of year, a temporary mulch shall be applied and final seeding shall be performed at the earliest opportunity when weather conditions favor germination and growth but not more than six months after project completion. 13. Minimum % Vegetative Cover Suitable vegetative cover is defined as a minimum of 85 % area vegetative cover with contiguous unvegetated areas no larger than 1 square foot in size. 14. State May Order Removal or Alteration of Work If future operations by the State of New York require an alteration in the position of the structure or work herein authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable obstruction to the free navigation of said waters or flood flows or endanger the health, safety or welfare of the people of the State, or cause loss or destruction of the natural resources of the State, the owner may be ordered by the Department to remove or alter the structural work, obstructions, or hazards caused thereby without expense to the State, and if, upon the expiration or revocation of this permit,the structure, fill, excavation, or other modification of the watercourse hereby authorized shall not be completed, the owners, shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood capacity of the watercourse. No claim shall be made against the State of New York on account of any such removal or alteration. 15. State May Require Site Restoration If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the applicant shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may lawfully require,remove all or any portion of the uncompleted structure or fill and restore the site to its former condition. Precautions Against Contamination of Waters All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the project. 17. State Not Liable for Damage The State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized which may be caused by or result from future operations undertaken by the State for the conservation or improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any such damage. GENERAL CONDITIONS - Apply to ALL Authorized Permits: 1. Facility Inspection by The Department The permitted site or facility, including relevant records, is subject to inspection at reasonable hours and intervals by an authorized representative of the Department of Environmental Conservation (the Department)to determine whether the permittee is complying with this permit and the ECL. Such representative may order the work suspended pursuant to ECL 71- 0301 and SAPA 401(3). The permittee shall provide a person to accompany the Department's representative during an inspection to the permit area when requested by the Department. A copy of this permit, including all referenced maps, drawings and special conditions, must be available for inspection by the Depatinient at all times at the project site or facility. Failure to produce a copy of the permit upon request by a Department representative is a violation of this permit. 2. Relationship of this Permit to Other Department Orders and Determinations Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind any order or determination previously issued by the Department or any of the terms, conditions or requirements contained in such order or determination. 3. Applications For Permit Renewals, Modifications or Transfers The permittee must submit a separate written application to the Department for permit renewal,modification or transfer of this permit. Such application must include any forms or supplemental information the Department requires. Any renewal, modification or transfer granted by the Department must be in writing. Permit Modifications, Suspensions and Revocations by the Department The Department reserves the right to exercise all available authority to modify, suspend or revoke this permit. The grounds for modification, suspension or revocation include: a. materially false or inaccurate statements in the permit application or supporting papers; b. failure by the permittee to comply with any terms or conditions of the permit; c. exceeding the scope of the project as described in the permit application; d. newly discovered material information or a material change in environmental conditions, relevant technology or applicable law or regulations since the issuance of the existing permit; e. noncompliance with previously issued permit conditions, orders of the commissioner, any provisions of the Environmental Conservation Law or regulations of the Department related to the permitted activity. 6. Permit Transfer Permits are transferrable unless specifically prohibited by statute,regulation or another permit condition. Applications for permit transfer should be submitted prior to actual transfer of ownership. NOTIFICATION OF OTHER PERMITTEE OBLIGATIONS Item A: Permittee Accepts Legal Responsibility and Agrees to Indemnification The permittee, excepting state or federal agencies, expressly agrees to indemnify and hold harmless the Department of Environmental Conservation of the State of New York, its representatives, employees, and agents ("DEC") for all claims, suits, actions, and damages,to the extent attributable to the permittee's acts or omissions in connection with the permittee's undertaking of activities in connection with, or operation and maintenance of,the facility or facilities authorized by the permit whether in compliance or not in compliance with the terms and conditions of the permit. This indemnification does not extend to any claims, suits, actions, or damages to the extent attributable to DEC's own negligent or intentional acts or omissions, or to any claims, suits, or actions naming the DEC and arising under Article 78 of the New York Civil Practice Laws and Rules or any citizen suit or civil rights provision under federal or state laws. Based on my assessment,it is my professional opinion that the proposed project will have little effect on the water table in the area of the pond,and w II cause no significant impact to other users of water in the area_ I base this conclusion on the fo lowing factors: • Pumping water from a pond can have an effect o-i the water table in the surrounding shallow aquifer The degree of such effect is primarily a function of the amount of water removed and the permeability of the surrounding aquifer mater ais. • The plan involves removal 'f invasive Phragmites and approximately 6,670 cubic yards of silt,muck and peat accumulated in the pond to create a pond with a maximum depth of 8 feet and surface area approximately 30,770-square feet;the purpose of the project•s to increase the available water storage capacity of the pond for continued irrigation use. • The existing water storage pond receives water pumped from two irrigation wells located several hundred feet to the northeast; this pumping is expected to continue with little change in the pumping rate,and the new storage pond w ll be connected to the existing storage pond with a buried pipe. The net effect of alternately pumping water nto the pond,and withdrawing water from the pond,would be minor fluctuations in the water table-an effect that occurs already with the operation of the exist'ng irr gation pond. The water elevation in the proposed pond wit be maintained similar to the water level in the existing pond; thus, I would expect any change in the water table elevat'on near the pond to be temporary and minor,and this effect would be dampened with increas'ng distance from the pond. The site was inspected by representatives of the Board of Town Trustees and Mr. Robert Marsh of the N.Y.S.D.E.C. on Tuesday, October 28, 2014. Upon Mr. Marsh's inspection of the site and the preliminary plans for the project he contacted our office and asked that the plans be modified to add a shallow shelf along the perimeter of the pond to allow for additional plantings. The enclosed plans have been modified to depict a 6 ft. (horiz.),to 1 ft. (vert) shelf extending 12 ft. into the pond with plantings.
