HomeMy WebLinkAboutL 11662 P 430 L DISTRICT SECTION DEED BOCK LOT 7 = ® MTHIS INDEbUURE madHgthe 5th day lq January,2pine een dyed and ninety-four BETWEEN ROBERT OBERLIN and JACQUELYN OBERLIN, husband and wife, presently residing at 2309 Overlook Drive, Mount Dora, Florida 32757, hereinafter referred to as Party of the first part, and PETER GRABOW and ROCHELLE KRUEGER, husband and wife, presently residing at 333 East 34th Street, New York, New York 10016, hereinafter referred to as Party of the second part, t WITNESSETH, that the Party of the first part, in consideration of ONE ($1. 00) dollar lawful money of the United States, and other good and valuable consideration, to them in hand paid by the Party of the second part, does hereby grant and release unto the Party of the second part, the heirs or successors and assigns of the Party of the second part, forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the Town of Southold, County of Suffolk and State of New York, known and designated on a certain map entitled "Map of Goose Bay Estates" in the Town of Southold, made by Lewis M. Winters of Oyster Bay, Long Island, New York, dated September 12, 1934, as Map No. 1176; as lots 225,226, 227, 248, 249, 250 and part of lots 224, 228, 247, and 251, which said lots and parts of lots when taken together are bounded and described as follows: BEGINNING at an iron pipe on the northwesterly side of Birch Avenue (a 20 foot private road) distant 145. 06 feet southwesterly as measured along the northwesterly side of Birch Avenue; from the corner formed by the intersection of the southwesterly side of Cedar Avenue and the northwesterly side of Birch Avenue; which said point is also the northeasterly corner of the premises herein described; RUNNING THENCE along the northwesterly side of Birch Avenue South 49 degrees, 56 minutes, 40 seconds West 80. 00 feet to a monument in the said northwesterly side of Birch Avenue; RUNNING THENCE through lots 228 and 251 as shown on said map North 40 degrees, 03 minutes, 20 seconds West 240. 00 feet to a monument in the southeasterly side of Oak Avenue (a 20 foot private road) ; RUNNING THENCE along the said southeasterly side of Oak Avenue North 49 degrees, 56 minutes, 40 seconds East 80 . 00 feet; RUNNING THENCE through lots 247 and 224 as shown on said map South 40 degrees, 03 minutes, 20 seconds, East 240 . 00 feet to an iron pipe in the northwesterly side of Birch Avenue, the point or place of BEGINNING. BEING and intended to be the same premises previously conveyed to Robert Oberlin and Jacquelyn Oberlin from Thomas F. Lloyd and Marie C. Lloyd by Deed dated October 4 , 1983 and recorded in the Suffolk County Clerk' s Office on November 1, 1983 in Liber 9451 of Deeds at page 539 . TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances, and also all the estate which the party of the first part has in and to said premises, and also the estate therein which the party of the first part has or has power to convey and dispose of; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever; AND the party of the first part, covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid; AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose; The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires . IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above written.
