COUNCILMAN GHOSIO: NOTICE IS HEREBY GIVEN that the Town Board of the Town
of Southold is considering the change of zone of the property identified as SCTM#1000-12-1-
1.2 from R-120 to AHD on its own motion; and
NOTICE IS FURTHER GIVEN that pursuant to the requirements of Section 265 of the New
York State Town Law and the Code of the Town of Southold, Suffolk County,New York, the
Town Board of the Town of Southold will hold a public hearing on a proposed Local Law
entitled"A Local Law to amend the Zoning Map of the Town of Southold by Changing the
Zoning Designation of property identified on the Suffolk County Tax Map as Lot#1000-012-1-
1.2 from R-120 to AHD" at the Fishers Island School Fishers Island,New York, on the 5th day
of August, 2015 at 1:02PM
This was dated June 30, 2015 by order of the Town Board of the Town of Southold. I do have in
front of me a signed affidavit that this hearing was published in the New London Day. I also
have a signed affidavit that this public hearing has been noticed in the Suffolk Times, also that it
was noticed on the Town Clerks bulletin board. I do have a here a State Environmental Quality
Review negative declaration notice of determination non-significance. I also have from the
Suffolk County Depaitinent of Economic Development and Planning, a decision of local
determination as there is no apparent significant county-wide or inter-community impacts. A
decision of local determination should not be construed as either an approval or disapproval.
And that is from Andrew Freleng, Chief Planner. And I have here a memorandum from the
LWRP coordinator, Mark Terry, that finds that according to the Local Waterfront Revitalization
coastal consistency review of the change of zone that this is consistent with the LWRP
consistency standards and therefore is consistent with the LWRP. I have a memorandum from
the chairman of the Planning Board, Donald Wilcenski, basically that the Planning Board does

recommend and support the change of zone based on a variety of issues that they have listed
here.
SUPERVISOR RUSSELL: Okay. Would anyone like to comment on this particular local law?

KAREN GOODWIN: Hello, I am Karen Goodwin, I am Superintendent Principal of the school
here and I am a resident of Fishers Island. I want to make sure you know of my strong support
for this proposal. I commend Katherine Sanger for her persistence in working through this
process so that we would have affordable housing here on the Island. I know through first- hand
experience that all of our school housing is full, Walsh Park affordable housing is full, the ferry
district housing is now full and we have Connecticut families whose students attend here that
want to move here and have been looking for housing, year round affordable housing, and are
not successful in seeking what they need. We also have the same situation with some of our staff
members. On Fishers Island there are some nine month rentals available but many people need
a place to live year round. And so I am very much in support of this program. Thank you.

RONA SMITH: On behalf of the Housing Advisory Commission of Southold Town, I would
like to say that we strongly recommend this project because it is so apt, so appropriate for where
it is going and is should be enacted and it should be built.

KEN EDWARDS: Ken Edwards, lifelong Fishers Island resident and former member of
Southold Town Planning Board and I strongly, strongly support this much needed project.

BRUCE KINLIN: Hi, my name is Bruce Kinlin. I am a summer resident and homeowner on
Fishers Island and an architect. I have been working with Katharine Sanger for the last two
years, I think as you all know, the plan started with a piece of property that she wanted to create
affordable housing on. And kind of through her efforts and our work with the town, Phillip and
Heather and others, we created a new zoning type through legislation that could be applied to
different properties and this is the first I believe, circumstance that it is being applied to a piece
of property. I strongly support it and want you to know that we appreciate that it is being
considered here. Thank you.
SUPERVISOR RUSSELL: Thank you. Would anybody else like to address the Town Board on
this particular local law?
GAIL HORTON: Hello, I am Gail Horton from Greenport and I remember coming here several
years ago, I think it was about 10 years ago, to talk to the residents about affordable housing here
and it is still needed. Affordable housing is always needed in a community to keep the
community vital, to keep people working here and participating in the local affairs, to grow

wonderful children to go on taking care of the Island afterwards, so I strongly support this.

Section 1. Purpose.
The purpose of this Local Law is to amend the Zoning Map to change the zoning on the
parcel known as SCTM#1000-12-1-1.2 from R-120 to AHD, to allow for the
construction of three (3) single-family homes that will remain affordable in perpetuity.
Section 2. Code Amendment.
Based on the goals and identified housing needs of the Town, and upon our consideration
of the recommendations of the Town Planning Board, the Suffolk County Planning
Commission, and the public comments taken at the public hearing and otherwise, we
hereby amend the official
Zoning Map of the Town of Southold as adopted by Section 100-21 of the Town Code to
change parcel SCTM#1000-12-1-1.2 from R-120 to AHD. The property is
approximately .75 acres and is located off of Fox Lane on Fishers Island in the Town of
Southold.
Section 3. Severability.
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by
any court of competent jurisdiction to be invalid,the judgment shall not affect the
validity of this law as a whole or any part thereof other than the part so decided to be
unconstitutional or invalid.
Section 4. Effective Date
This Local Law shall take effect immediately upon filing with the Secretary of State as
provided by law.

The Planning Board has reviewed requested change of zone of SCTM#1000-12-1-1.2 on the Town Board's
own motion. The request involves the changing of zone on a .75 acre parcel from Residential (R-120)to
Affordable Housing District(AHD). _
The subject parcel is currently zoned R-120. Parcels to the west, north and south are also zoned R-120. To
the east, across Fox Lane the parcels are zoned General Business (B). Land use,that surrounds the parcel is
a mix of vacant municipally owned land, commercial, recreational and community facilities (Fishers Island
- School).
The Planning Board supports the change of zone based on the following:
The purpose of the Affordable Housing Zoning District"is to provide the opportunity within certain areas of
the Town for the development of high-density housing for families of moderate income;and further, to do
so with sensitivity to the historic and aesthetic character of the Town's existing neighborhoods."
1. The action supports the purpose of the AHD zoning district and the comprehensive plan. The
parcel is currently improved with three buildings and a change of zone will not degrade the
historic or aesthetic character of the area,conversely,the new construction will expand on
the intent of the community effort to revitalize the area with the development of the iconic
Fishers Island Community Center.
2. The parcel is across the street from the Fishers Island School property and Fishers Island
Community Center,in close proximity to the Fishers Island Community Theatre and the Ferry
transportation hub.
3. The infrastructure is in place to support the AHD zone. The parcel is proposed to be served
by a public road, public water and sewer.

4. The action is fully supported by the Fishers Island Strategic Plan (2007)
5. The action will further and/or meet the following Economic Chapter goals and objectives:
Objective 1-9. Seek to reverse the "brain drain"through the attraction and retention of recent
college graduates and young professionals to the Town's diverse workforce.
Maintaining a sustainable Fishers Island year round population is at risk and the challenge is to
retain residents on the island past the seasonal fluctuation. The creation of the opportunity for
new affordable housing units would provide new housing opportunities for residents in different
economic situations.
1-9b. Ensure an array of housing alternatives—including both affordable and workforce
options—that meet the needs of recent college graduates, young professionals and other
members of the Town's diverse workforce.
A diverse housing stock—both affordable and workforce, rental and owner-occupied—is
demanded within all parts of Town. Recent college graduates,young professionals and
young families have difficulty affording housing in Southold,which in part has resulted in
an invaluable loss of talent, diversity and resources. This action would provide the
opportunity to construct perpetually rent-controlled moderate income dwelling units
The 2005 Hamlet Study and the 2007-08 Hamlet Stakeholder and Fishers Island Strategic
Plan (2009) identifies providing affordable, diverse housing as a priority of the Town. In
order to become more of a live-work community, the Town must allow for housing that
accommodates those who wish to live and work in the community especially recent college
graduates, young professionals and seniors.
Objective 1-10.Ensure the provision of various housing options for the Town's ever-growing senior
population.
Southold has an unusually large number of senior citizens. Claritas Market Place Demographic
Snapshot reported that seniors (65 years or older) make up 24%of the Town's total population. In
addition, another 15%of the population is classified as "empty nesters," ages 55 to 64,who will
reach retirement age in the coming decade. The 2009 American Community Survey also found
that 40%of year-round residents were age 55 or older.This sizable segment of the population will
require special forms of housing and assistance to make it possible for them to age in place and
continue living in the Town (Housing Chapter).
The zone change will allow the landowner to create a diversity of housing types that could
accommodate seniors on Fishers Island.
Goal 2. Promote economic development to occur in an efficient manner that ensures an adequate
tax base, without compromising the unique character of the Town.
Objective: 2-1. Promote public-private partnerships and ways to improve the quality of life for
Town residents through all future development initiatives that is most applicable to the proposed
action.

Public-private partnerships can vastly revitalize a given community and the quality of life for its
residents. Oftentimes, such partnerships can provide an improved level of service and quality of
life with reduced governmental costs. Land costs in the town have made the development of
affordable housing a challenge. In the past five years one unit located in the hamlet of Orient has
been generated in the Town.
Consequently,the need to implement the recently amended Affordable Housing legislation and
create new opportunities where landowners could achieve public-private relationships is
imperative. A change of zone on the parcel implements the legislation.
The Board is also aware that the change of zone is not fully supported by adopted plans that
predate the Draft Comprehensive Plan, including the Hamlet Studies (2005-2009). As stated it the
Draft Economic Chapter of the Comprehensive Plan "The 2005 Hamlet Study and the 2007-08
Hamlet Stakeholder Initiatives identified providing affordable and diverse housing as a priority of
the Town. In addition, stakeholder interviews and public participation efforts suggested the need
for additional affordable and workforce housing in all parts of Town. To accomplish this, it is
recommended that the Town encourage the conversion of apartments above Hamlet Center
storefronts, as well as the preservation, renovation, reuse and adaptive reuse of historic and
vacant structures."
The development of Fishers Island is defined by separate, small commercial areas and a very small
hamlet center. Traditional planning principles of locating housing in developed areas near
commercial areas, although supported to avoid character conflicts and adverse impacts; is less
achievable on Fishers Island.
As indicated above,the parcel being reviewed for a zone change is across the street from the
Fishers Island School property and Fishers Island Community Center. Both properties are zoned
General Business and contribute to the waterfront commercial area. Future plans for the area
include a revitalization project that would inject new economic opportunities for residents. The
plans will generate new job opportunities for the area. The parcel is also located in in close
proximity to the Fishers Island Community Theatre,the Ferry transportation hub and is not far
from the other commercial areas.
6. The action will further and/or meet the following Housing Chapter goals and objectives:
Goal 1.2: Encourage the development of new diversified housing to help meet the needs of current
year-round residents, including senior citizens, emergency services volunteers and other local
workers.
The Town is comprised of a much larger share of older residents than other parts of Suffolk
County, as evidenced by a Town wide median age that is ten years older than the County. As the
population in the Town continues to age, lower cost senior housing alternatives will be in demand.
Despite the increased need for affordable housing for seniors, housing options are becoming less
and less. Small housing units and apartments have been identified as a partial solution to rectify
the growing need. The Town has adopted the following rental rates for affordable units to develop
a leasing structure that would make units more affordable.

A diversity of housing types on Fishers Island is more achievable on smaller parcels due to the
capacity of the Fishers Island Sewer District. The existing system serves a mixture of both seasonal
and year-round residences, a community center, and several offices.The sewage collection system
discharges to a pump station located on Fox Lane near an abandoned outfall in the northwest
section of the service area.The existing disposal system was designed for a summer average flow
of 20,000 gpd and a winter average flow of 7,500 gpd with a peak hour estimated flow of 80,000
gpd. (Peconic Green Growth). New development on the parcel will be required to be connected to
the sewer system.
Objective: 1. Develop units of moderate-income home ownership through the Town's inclusionary
zoning policies, Suffolk County 72 H transfers(tax default properties), change of zoning to
Affordable Housing District,partnerships with non-profit housing developers utilizing New York
State HOME funding. This could include consideration of changing code to allow smaller size homes
than had been previously envisioned(less than 850 square feet.)
The change of zone on the Town Boards on its motion for the parcel implements this objective.
1-11. Continue to support the arts industry through the provision of live/work space in
appropriate areas of the Town.
This objective states that The Town should ensure the provision of studio space and/or
affordable live/work spaces in appropriate areas of the Town. Such space could take the
form of studios located above other uses, or designated vacant buildings could be
converted to studio space and/or a business incubator for young artists in the community.
This type of development should be targeted to the Town's hamlet centers to increase
vitality and the overall strength of the industry in Town.
Goal 1.1:Provide additional diversified housing from existing stock to help meet the needs of
current year-round residents, including senior citizens, emergency services volunteers, and other
local workers.
The loss of professionals and service personal to the high cost of living in the Town is a problem.
Fishers Island small population creates shortfalls in people to serve on fire departments and
provide other services. Maintaining a viable student population in the Fishers Island School District
is also a problem; students are ferried from Connecticut to attend the district. Providing additional
housing opportunities could attract new residents(families)to the island that could place students
in the schools.
Objective: 6. Encourage the development of diversified housing for artists and crafters in hamlet
centers in combination with galleries, etc., drawing on Suffolk County Workforce Housing funding

The change of zone supports the above goal and objective. In 2012 the Lighthouse Works, a
nonprofit arts organization, was created on Fishers Island. The organization provides fellowships
to artists to contribute to the revitalization of cultural arts and economy. Studio spaces are located
close to the parcel in the Ferry Annex Building.The initiative is identified in the Town of Southold
Comprehensive Plan. Future housing on-site could accommodate artists participating in the
program.
The studio type housing option discussed above is currently achievable in the Hamlet Business (HB)
zoned parcels in the Hamlet Center, therefore,the proposed zone change would not conflict with
the objective.
Goal 4:1:Address the problems that result from blighted properties.
Objectives:1. Develop pilot program to rehabilitate units of blighted housing with loans and grants
through the Town's CDBG funding.
This action would create the opportunity of the landowner to participate in Suffolk County
Community Block Grant Funding opportunities.
The Fishers Island Strategic Plan (2007) supports the action through the following implementation
strategies:
1. Create housing,social, cultural and economic opportunities to attract and keep this
target population.
2. Renovate existing buildings for affordable housing.
3. Create incentives for new affordable housing to be built by the private market.
For the reasons stated above,this opportunity to create affordable units on Fishers Island is unique and
the Planning Board supports the change of zone of the parcel to AHD.

This request involves the changing of zone on a .75 acre parcel from Residential (R-120) to
Affordable Housing District (AHD) on Fishers Island, New York on the Town Board's own
motion.
The proposed local law has been reviewed to Chapter 268, Waterfront Consistency Review of
the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP)
• Policy Standards. Based upon the information provided to this department as well as the
records available to me, it is my recommendation that the proposed action is CONSISTENT with
the LWRP Policy Standards and therefore is CONSISTENT with the LWRP. This determination
is based on the following:
The action furthers Policy 1. Foster a pattern of development in the Town of Southold that
enhances community character, preserves open space, makes efficient use of infrastructure,
makes beneficial use of a coastal location, and minimizes adverse effects of development.
The purpose of the Affordable Housing Zoning District "is to provide the opportunity within

income; and further, to do so with sensitivity to the historic and aesthetic character of the Town's

Impact On Land
The parcel is located in the historic Fort Wright area of Fishers Island.
The purpose of the Affordable Housing (AHD) District is to provide the opportunity within certain
areas of the Town for the development of high-density housing for families of moderate income; and
further, to do so with sensitivity to the historic and aesthetic character of the Town's existing
neighborhoods. Towards that end, the Planning Board shall have the authority to amend certain
setback and other specifications in order to ensure cost efficiencies and design that furthers the
Town's goals of providing quality workforce housing. Homes located within the Affordable Housing
District are intended to be affordable in perpetuity.
Under the AHD district, density is permitted at 10,000 square feet per unit of tenant or owner
occupied moderate income units (affordable). A land area density bonus up to 50%of the total
number of units in the development is permitted for small rental units<850 square feet in a
affordable tenant-occupied units.
The parcel being contemplated for a zone change from R120 to AHD equals .75 acre or 32,670 sq. ft.
The number of units and intensity of the future build out is limited. A total of four units with the

density bonus applied in the AHD district is achievable under the AHD zoning district. The build out is
not substantially different than existing conditions of the parcel (three buildings and parking area).
Parking for future residents could be located on-site.
No adverse impact on land is expected to occur as a result of the action.
Impact of Water
1. Water Supply
Public water is available to future development of the parcel via the Fishers Island Water Works
Corporation; a subsidiary of Fishers Island Utility Company. The source of water for the Fishers
Island Water Works Corporation is groundwater pumped from two wells located in the Middle Farms
area. Backup water supply to the wells is surface water from Barlow Pond and Middle Farms and
Treasure Ponds. Water consumption will be assessed to future development proposals.
2. Sanitary Disposal
Future development under the AHD zone will be required to connect to the Fishers Island sewer
system.
In 1978, the Long Island Regional Planning Board published the Long Island Comprehensive Waste
Treatment Management Plan (208 Study). The 208 Study identified eight (8) Hydrogeologic Zones in
Nassau and Suffolk Counties. These zones were distinguished based upon differences in underlying
groundwater flow patterns and water quality. The subject site is located within SCDHS Groundwater
Management Zone IV, which according to Article VI of the Suffolk County Sanitary Code, has an
allowable flow of 600 gallons per day(gpd) per acre in areas served by public water.
The allowable Nitrogen bearing flow for the overall .75 acre site is 450 gpd. Any proposed
development would be required to meet the maximum allowable flow permitted.
3. Ground or Surface Water Quality or Quantity
Long Island Sound/Fishers Island Sound is located west of the parcel. Small freshwater wetlands are
located to the south of the property.
Recognizing the significant impact that Nitrogen has on our groundwater and surface waters, Suffolk
County has developed and is implementing a plan to reduce the impacts of fertilizer on ground and
surface water. The Suffolk County Legislature established a goal of reducing fertilization in residential
areas by 10 to 25 percent, regardless of lot size and landscaped area, and passed Local Law 41-2007
in 2007 to reduce Nitrogen pollution by reducing the use of fertilizer throughout the County (SCDHS).
Any future development of the parcel will be required by the Planning Board to follow the below
Best Management Practices:
a. Require the use of native, drought-tolerant plants in landscaping.

b. Require only the use of organic fertilizers where the water-soluble nitrogen is no more than 20%
of the total Nitrogen in the mixture.
c. Require a maximum of 1 lb. of Nitrogen per 1000 square feet in any one application, with a
cumulative application of no more than 2 lbs. per 1,000 square feet per year.
d. Prohibit the application of fertilizer products containing Nitrogen, Phosphorus, or Potassium
between November 1st and April 1st.
e. Prohibit the use of Phosphorous containing lawn fertilizer unless establishing a new lawn or soil
test shows that the lawn does not have enough Phosphorus. Fertilizer labels have three bold
numbers. The number in the middle is the percentage of Phosphorus in the product, e.g. 22-0-15.
Use of products with 0.67 in the middle or lower is not restricted. Products with a number higher
than 0.67 may only be used if a new lawn is being established or a soil test indicates it is necessary.
4. Flooding
The parcel is located within the FEMA Flood Zones AE El 11 and 12 and X. The X mapped area is a
result of past earth manipulation from the construction of Fort Wright. There no ability to fully
locate structures outside of the AE flood zone on the parcel. Mitigation to future structures will be
achieved through FEMA First Floor Elevation requirements. Equipment should also be located
outside of flood risks. The potential impact from the threat of flooding is moderate to high based
on flood zone data. However,the change of zone to AHD will not impact the flooding potential of
the parcel. Rather future structure design and construction will be required to lessen potential
future impacts.
Impact on Air
No substantial adverse change in existing air quality is expected to occur.
Impact on Plants and Animals
The parcel is located within a New York State Department of Environmental Conservation Critical
Environmental Area but not within a New York State Department of State Significant Fish and
Wildlife Habitat Area. The New York State Department of Environmental Conservation
Environmental Resource Mapper was consulted to determine if the area is identified as containing
rare or endangered plants in the area. The area is included (Figure 1).

The parcel is improved with existing buildings and sanitary systems. The majority of the site is
cleared and little vegetation remains on site. Due to site development,the presence of animals is
expected to be low, therefore,the potential occurrence of rare or threatened plants or animals on
site or within the vicinity of the site is low.
No significant removal or destruction of large quantities of vegetation will occur as a result of this
action. Correspondingly, no substantial interference with the movement of any resident or migratory
fish or wildlife species nor impacts on a significant habitat area will occur as a result of this action.
Impact on Agricultural Land Resources
The parcel is not currently in agricultural production, therefore, no adverse impacts to agricultural
lands or soils will occur.
Impact on Aesthetic Resources
The parcel is located south of the Fishers Island Community Center and the Fishers Island School.
The area has been historically developed by the United States for coastal defense purposes. Barrack
and support brick buildings remain in the area.
Due to the parcel size the future build out density is expected to be low and consistent with
residential structure architecture. No substantial adverse impacts to aesthetic resources are
expected to occur.
Impact on Historical and Archeological Resources
The parcel is included within the Archeo-sensitive Area (MAPINFO GIS-Archeo-sensitive Layer),
however, due to past site improvements; the parcel is improved with three buildings, sanitary
systems. The parcel is not SPLIA listed.

The proposed action would allow the redevelopment of the parcel to meet Town affordable housing
plans and. Due to flood plain requirements, any future construction will require that minimize
subsurface construction be minimized. The action will not impact important historical or
archaeological resources.
Impact on Open Space and Recreation
No significant impacts to public open space or recreational areas will occur as a result of this action.
Impact on Critical Areas
The proposed action is not located within a New York Department of Environmental
Conservation Critical Environmental Area.
Impact on Transportation
The current use is residential and the proposed future use is residential. No significant traffic volume
(generation) or flow will occur as a result of this action.
Impact of Energy
No major change in the use of either the quantity or type of energy will occur.
Noise and Odor Impact
No substantial change in noise or odor is expected will occur.
Impact on Public Health
No creation of a hazard to human health is expected to occur. No substantial increase in solid waste
production, leaching or drainage problems is expected to occur if the proposed action is
implemented as planned.
The parcel is located in the Fishers Island Fire District and can potentially be served by sewer
operated by the Fishers Island Sewer District and public water. Future site improvements will be
required to comply with Chapter 236 Stormwater Management of the Southold Town Code.
Impact on Growth, Character of Community or Neighborhood
The action has been recommended as consistent (with Best Management Practices) with the policies
of the Town of Southold Local Waterfront Revitalization Program.
1. The action supports the purpose of the AHD zoning district and the comprehensive plan. The
parcel is currently blighted and a change of zone will not degrade the historic or aesthetic character
of the area, conversely, the new construction will expand on the intent of the community effort to
revitalize the area with the development of the iconic Fishers Island Community Center.

3. The infrastructure is in place to support the AHD zone. The parcel is proposed to be served by a
public road, public water and sewer.
4. The parcel is across the street from the Fishers Island School property and Fishers Island
Community Center, in close proximity to the Fishers Island Community Theatre and the Ferry
transportation hub.
5. The action is supported by the Fishers Island Strategic Plan (2007)
6. The action will further and/or meet Economic and Housing Chapter goals and objectives in the
draft Comprehensive Plan.
The proposed action is not in significant material conflict with a community's current plans or goals
as officially approved or adopted.
Based upon such, no significant adverse impacts to the environment are expected to occur should
the project be implemented as planned.

Introduction
Within the Town's ten hamlets, single-family detached housing is common among its
roughly 15,000 housing units. Typical of Long Island, home ownership is also the norm
in Southold; less than 20% of the housing stock is rental. The housing stock varies in
age across a broad range; a substantial portion was built before 1940 and another
substantial portion after 1990.
A critical factor in understanding the housing characteristics of Southold is the existence
of large numbers of second homes for seasonal and occasional use. The 2010 census
reported that 36% of all housing units within the Town were seasonal. The highest
inventory of year-round housing units is in Mattituck (68%)and the lowest, in Fishers
Island (18%). By contrast, across Suffolk County, less than 7% of its housing is
seasonal. In addition, within Southold, there are a growing proportion of retirees.
Southold's proximity to metropolitan New York City along with its rural character with
plentiful recreational opportunities makes the Town highly desirable for vacation homes. .
Home-buyers from New York City and its suburbs tend to have significantly higher
incomes than Southold residents. The buying power of these second-home purchasers
has pushed up home prices generally and drastically reduced the supply of affordable
housing for local residents.
The Town's attractiveness creates a demand from affluent second-home buyers that
limits the supply of housing available to year-round residents. Housing is generally
considered "affordable" if it is within the reach of families who earn no more than
median income. For Nassau/Suffolk counties $106,100 is the median income for a
household of four.
Other communities have tried to-solve housing shortages through zoning that allows
greater density(downzoning), thus reducing land costs per residence and making it
possible to build less costly housing. In Southold, however, density is linked to sanitary
flow which is regulated by The Suffolk County Department of Health who is charged
with protecting groundwater quality. This oversight poses challenges to the location in
which density would be permitted. In the Hamlet Centers, where affordable housing
concentration is most appropriate, the restrictions on sanitary flow in relation to the
current uses hinder the development of units.
Recognizing this, the Town initiated a Sanitary Flow Credit bank in 2005 to provide
opportunities to purchase sanitary flow credits to increase parcel density for affordable
housing purposes. The program allows the purchase of residential density credits that
the Town banked from the purchase of open space lands. The residential density credit
must be used in connection with the construction of affordable housing in the Business
(B), Hamlet Business (HB), Residential Office (RO), or land designated as Affordable
Island had fallen faster and further than in the rest of the country; it said that home
values in Suffolk County had declined 21% since the recession began, in December
2007.
According to demographic data gathered for the Economic Chapter, median household
income for the Town of Southold was $66,464 in 2009. By mortgage bankers' rules of
thumb, someone with an income of that amount could afford to pay no more than
$200,000 for a home (or carry a mortgage no greater than that amount). So half the
population of Southold — households earning less than the median $66,464 - would fall
under that $200,000 ceiling, when in fact today's median home value for the Town is
more than twice that ($440,000), and very few homes on the market sell for less than
$300,000. A great many Southold families, perhaps most, could not afford their
present home if they had to buy it at today's prices. This underscores the ongoing
discrepancy between local incomes and housing prices.
In January 2012 the Stony Brook University Center for Survey Research released its
polling results of the Long Island Index. The poll revealed sentiments of 810 Long
Islanders, in which many are struggling to live in an area with pervasively high housing
costs, as noted below:
• Six in ten reported having difficulty in paying mortgage or rent, with households
earning greater than $100,00 reporting that 47% are having difficulty.
• Fifty percent reported that they were "somewhat" or"very likely" to leave Long
Island in the next five years. This sentiment is much higher among younger
adults aged 18-34 with over two-thirds reporting a likelihood to leave.
• Regarding perceptions of the "serious problem of affordable housing", 66%
reported that it is "extremely serious" or"very serious."
Housing Needs of Residents
Safe, affordable housing is vital to a community's stability and growth. The Town of
Southold has grappled with the need for affordable housing to sustain its year-round
residents with moderate incomes. Home ownership is a core value of the "American
Dream" and research supports that it fosters community participation and citizenship, as
well as stabilizing families and neighborhoods. In addition, rental opportunities for
residents who cannot afford to buy a home (or don't want to) are not great. Available
rental subsidies do not come close to meeting current demand, as evidenced by the
North Fork Housing Alliance's December 2011 waiting list of 426 households.
The Town has long been a destination for second-homeowners, and it is increasingly so
for retirees. Over the past two decades home prices soared and far outstripped the
increase in the median income for Southold households, pushing home ownership
beyond the reach of many residents. From 1990 through 2005, single-family homes in
Southold tripled in price, as measured by median sales. While the current economic
slowdown has driven prices down, they remain far too high for most residents. The
disparity between their incomes and the cost of most single-family homes remains too
great.

little housing that younger residents can afford. Creating additional rental units in hamlet
centers or HALO zones would help keep these residents.
The severe recession of 2008 continues to affect the Town, with a genuine recovery
most likely a long way off. Mortgage tax receipts have declined for four years in a row.
Unemployment in Southold hovers around 10%. All signs are that housing prices will
generally remain weak for years to come, although still mismatched to local incomes.
The National Association of Realtors reports no shortage of housing inventory across
the country, and the North Fork mirrors that condition. Within today's buyers' market,
one would expect that depressed home prices would make home ownership more
affordable and available to year-round residents, yet most residents do not make
enough money to compete even in the current market. The glut of housing also
discourages new construction, which has fallen by half since the recession began, with
,serious consequences for the Town in reduced tax collections and less revenue from
various construction fees.
Nationally, foreclosures and pending foreclosures have skyrocketed over the past three
years, driven by a struggling economy, the loss of jobs, and declines of household
income, as well as by previous lending practices that allowed homeowners to over-
leverage the value of their homes. While Southold has fared much better than many
regions of the country, helping hard-pressed residents keep their homes has to be a
priority. The Long Island Board of Realtors estimates that as many as 4% of all homes
on Long Island are in active foreclosure. RealtyTrac reports that 1 in every 1,407
properties in Suffolk County received a foreclosure notice during September 2011.
All these factors —the high cost of houses, the lack of rental housing, the loss of jobs,
the sluggish economy- affect the ability of Southold's people to meet their housing
needs. Their unmet needs will continue to challenge the Town; they call for prudent but
far-sighted planning to address the Town's housing requirements in the years ahead.
Fiserv, the largest provider of information technology to the financial services industry,
projects that even if overall housing prices continue to decline, purchases of retirement
and vacation homes show some signs of increase. If so, this factor will continue to
curtail housing choices for year-round residents.
This Chapter of"Southold 2020" analyzes the sort of housing needed over the next ten
years to help ensure that housing is available, affordable, and in keeping with what
residents want.

establishes an amount that developers must pay in lieu of building the moderate-
income family dwelling unit. The amount is currently set at twice the amount of
the median income of Nassau/Suffolk County($212,250 per unit not built.)
• "Perpetual affordability" for affordable housing units that come for resale. These
restrictions limit how much the seller can ask, to prevent the units from rising to
market rate after subsidies have expired.
Goal 1.1: Provide additional diversified housing from existing stock to help meet the
needs of current year-round residents, including senior citizens, emergency services
volunteers, and other local workers.
Objectives:
1) Encourage the development of accessory apartments in existing barns and
garages that can be renovated into small apartments for singles or couples or
that allow the homeowners (retirees, etc.) to downsize and live in the accessory
apartment while renting their house to larger families. The Town's Community
Development Block Grant funding could provide pilot grants.
2) To maintain seniors in their homes, look into establishing Naturally Occurring
Retirement Communities (NORC) through grant funding for the Town's Senior
Services. A NORC is a neighborhood or locality where a great many elderly live;
it becomes eligible for various social services that make it easier for the elderly to
remain in their homes.
3) Continue to work with the Family Service League to expand its HomeShare Long
Island program, which provides affordable housing for both seniors and non-
seniors generally in the form of rooms within existing homes.
4) Promote universal design elements in the building code to accommodate seniors
ageing in place as well as persons with physical disabilities. Such elements
promote safety features and remove physical barriers that older people or the
disabled can't handle.
5) Establish loans and grants from the Town's CDBG funding to convert larger
homes from existing stock into units of affordable rental housing.
6) Encourage the development of diversified housing for artists and crafters in
hamlet centers in combination with galleries, etc., drawing on Suffolk County
Workforce Housing funding.
7) Consider using buyout funds from inclusionary zoning to partner with Habitat for
Humanity and other non-profits to acquire and rebuild substandard housing units.
Renovated units could be sold to households on the Housing Registry with
covenants and restrictions to ensure perpetual affordability. In addition, consider
using buyout funds for purchase of homes that are short-sale and/or foreclosed
to households on Housing Registry.
8) Consider using buyout funds to set up a revolving grant assistance program to
enable households on Housing Registry to rehabilitate and/or buy homes on the
existing market that would lower the purchase price to stimulate sales.

2. Education
Knowledge is power. Many residents are unaware of existing resources that might help
them obtain funding to buy a home, fend off foreclosure, or maintain their home.
Affordable housing (also known as "workforce housing") is often plagued by
misconceptions and myths.
Goal 2.1: Develop a series of educational forums to inform the public about housing
services, programs and resources
Objectives:
1) Teach skills to promote successful home ownership and landlord/tenant relations.
2) Working with banks and non-profit providers, inform homeowners about resources
to abate mortgage foreclosures.
3) Highlight resources and programs that promote energy efficiency and
weatherization.
4) Deepen public understanding of who needs affordable housing and why.
5) To promote conversion to affordable accessory apartments, create a one-page
flyer that simply explains how to create accessory apartments with information
about additional tax assessments, maximum rental charges, selection of tenants,
etc. This could include a checklist of what is needed along with offering the
services of the building department to visit prospective sites to offer suggestions
whether the concept is feasible. In addition, Town could host information and
discussion sessions with the public.
6) Strictly enforce fair housing laws so that every person has equal access to
housing without regard to race, color, religion, gender, sexual orientation, family or
marital status, disability, or national origin.

Furthermore, multi-tenant, rental structures/properties could also result in deteriorated
quality of life to neighborhood residents. However, the safety of tenants is paramount.
Many buildings and spaces currently occupied by multi-tenants were not constructed to
meet adequate safety standards. It is recommended that the Town create a pilot
program to work with property owners to allow Town Code Enforcers to inspect
properties and improve these situations.
Goal 4:1: Address the problems that result from blighted properties.
Objectives:
1) Strengthen the staffing of code enforcement to deal with blighted housing.
2) Develop pilot program to rehabilitate units of blighted housing with loans and
grants through the Town's CDBG funding.
Goal 4:2: Address the problems that result from illicit tenant overcrowding (fire safety,
parking, garbage and noise) in unpermitted and/or unsafe structures.
Objectives:
1) Create outreach program to inform property owners of code as well as ways to
address violations of properties to bring up to code
2) Strengthen staffing of code enforcement to address overcrowded housing.

5. Research and Development of Best Practices in Housing
For the Town to meet the housing needs of its residents, it must stay abreast of
legislation, policies and programs throughout the nation that could provide fresh
solutions for creating housing.
Goal 5.1: Continue to review and research policies and best practices elsewhere to
find solutions to meet housing needs of the Town's residents.
