Southold Town Clerk FINDINGS,DELIBERATIONS AND DETERMINATION MEETING OF SEPTEMBER 17,2015 ZBA FILE: 6884 NAME OF APPLICANT: Christopher&Elisabetta Coschignano PROPERTY LOCATION: 1110 Gillette Drive,East Marion,NY SCTM 1000-38-2-12 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated August 21, 2015, stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The applicant's property is a non-conforming 10,000 sq. ft. parcel in the R- 40 zone. The northerly lot line measures 100 feet along an adjacent parcel. The easterly lot line measures 100 feet along Gillette Drive, the southerly lot line measures 100 feet along another parcel, and the westerly lot line measures 100 feet along a 27 acre AC parcel, with the development rights to that parcel owned by Suffolk County. The property is shown, with the proposed new deck, on the survey drawn by Peconic Surveyors, PC, dated Sept. 26, 2012, and the site plan A-1 drawn by Frank W. Uellendahl, dated July 24,2015, last revised 7/25/2015. BASIS OF APPLICATION: Request for Variances from Article XXIII Section 280-124 and the Building Inspector's June 19,2015 Notice of Disapproval based on an application for building permit to construct a deck addition to existing single family dwelling, at; 1) less than the code required rear yard setback of 35 feet, 2)more than the maximum code allowable lot coverage of 20%. RELIEF REQUESTED: The applicant requests variances to construct a 545 sq. ft. deck with a non-conforming rear yard setback of 30.3 feet where 35 feet is required by code and with an increase of lot coverage to 22.65% where 20% is allowed. ADDITIONAL INFORMATION: There were no letters from any neighbors stating opposition to the applicant's proposed project. FINDINGS OF FACT/REASONS FOR BOARD ACTION: Page 2 of 3—September 17,2015 ZBA#6884—Coschignano SCTM#1000-38-2-12 The Zoning Board of Appeals held a public hearing on this application on September 3,2015, at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant's proposed deck will fill in a corner at the rear of the dwelling, and will not further decrease the existing rear yard setback. The rear yard deck will overlook a 27 acre parcel situated in the AC zone that cannot be developed and will not be visible from the road. There have been numerous similar variances granted, for rear yard setbacks and lot coverage of greater than 20%, in this long- established neighborhood. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant or cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant's single family dwelling was built in the 1950's and has existing non-conforming front yard and rear yard setbacks. The proposed rear yard deck can not be constructed without the grant of variances. 3. Town Law §267-b(3)(b)(3). The variances granted herein are not mathematically substantial, representing 13.4% relief from the code for the rear yard setback, and 13.3% relief for lot coverage. There have been numerous similar variances granted, for rear yard setbacks and lot coverage of greater than 20%, in this long-established neighborhood. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new deck in the rear yard, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Horning, seconded by Member Weisman, Chairperson, and duly carried,to GRANT the variances as applied for, and shown on the survey drawn by Peconic Surveyors, PC, dated Sept. 26, 2012, and the site plan A-1 drawn by Frank W. Uellendahl, dated July 24, 2015, last revised 7/24/2015. Subject to the following condition; CONDITION: 1. The deck shall remain open to the sky. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other Page 3 of 3—September 17,2015 ZBA#6884—Coschignano SCTM#1000-38-2-12 feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3)years from the date such variance was granted. The Board of Appeals may,upon written request prior to the date of expiration, grant an extension not to exceed three(3) consecutive one(1)year terms. The deck is very low to the ground,only two steps down to grade,and it is not visible from the street. E)gSIS OF APPLICATION: Building Inspector's January 20,2000 Notice of Disapproval for the reason that the proposed additions will exceed the lot coverage limitation of the Zoning Code. The Code requirement is 20%for building area (exclusive of ground level patios). The Notice of Disapproval states that the existing area is 1,960 sq:ft.(porch,garage and sun room included)and the proposed is 23.80%. ADDITIONAL INFORMATION: Applicants have furnished an updated survey prepared by Joseph A. Additionally the Board requested the front yard setbacks of the adjoining parcels on Gillette Drive. On November 12,2014 the agent provided the setbacks of the property on the north side at 29'4"and the south side at 35.3'. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 6,2014 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The home lies on the west side of Gillette Drive midway between SR25 and the Bay. The entire subdivision consists of non-conforming lots that are significantly smaller than present code requirements. As a result,the Board has seen many requests for similar area variances in this neighborhood. The proposed front porch is similar to others in the neighborhood and will improve the appearance of the subject dwelling. 2. Town Law 4267-b(31(b)(2).The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because of the non-conforming size of the parcel and the placement of the home on the site.It is not feasible for the applicant to move the dwelling with the proposed porch addition to a conforming front yard location, which would only result in a further reduction in the setback in the rear yard. 3. Town Law $267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 20% relief from the code for the setback and approximately the same for the lot coverage. However, a prior variance granted to this property permitted lot coverage of 23.8%, so the proposed lot coverage is an increase of less than 1%.The existing front yard setback is non-conforming at 32'3 %z",and the proposed front porch addition will result in an increase of 5 feet from the step to the front property line. 4. Town Law $267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will not have an adverse impact on the physical or environmental conditions in the neighborhood.The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Most additions and alterations into the rear yard area would require relief from the present zoning code.The rear yards of all of the lots on the easterly side of Gillette Drive in this subdivision are adjacent to tillable farmland which will remain in the Suffolk County agricultural land bank, which renders the farmland unbuildable. The proposed deck is not visible from the street. - 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant for the setback can be achieved by some method,feasible for the applicant to pursue,other than an area variance.The applicant could create a 6.7 foot deep deck along the portion of the dwelling that is 41.7 feet from the rear property line. However,the placement of a raised deck in that location is not logical or convenient to the layout of the interior of the house and an outside cellar entrance in that area makes it an impractical location.Because the applicant's house is 35.7 feet from the rear of the property line where the raised deck is proposed,a variance is required.The applicant must obtain a variance for excessive lot coverage because the existing lot coverage is already beyond what the code permits, so any addition to the subject dwelling will require a variance. 3. Town Law §267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 39% relief from the code in regards to the rear yard setback.However,the variance is mitigated by the small size of the lot,the existing location and interior layout of the dwelling,and the adjacency of the rear yard to property that will remain in agricultural use in perpetuity. The variance granted herein for the lot coverage is mathematically substantial, representing 33% relief from the code. However, a review of the immediate area indicates that this Board has granted variances for lot coverage on several improved properties. The excessive lot coverage is based upon the non-conforming size of most of the lots in this subdivision,which average 10,000 square feet in size. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. All run off will be retained on site per Chapter 236 of the code. 5. Town Law 6267-b(3)(b)(5). The difficulty has been self-created.The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Grant of alternative relief will not produce an undesirable change in character of neighborhood or a detriment to nearby properties. The proposed dwelling measures 33.3 feet depth at its deepest measurement, including the front porch, by 74 feet in length (width) inclusive of the garage. The alternative will maintain the minimum 35 ft. code requirement in the front yard setback and will conform to the code's required minimum side yard setbacks (proposed at 11 and 15 feet). The applicants' proposal for a reduction in the rear setback by four (4) feet, for a 31 ft. setback, and increase in the lot coverage by 2.55%,are both similar to others in this vicinity of this property. 2. The benefit sought by the applicants cannot be achieved by some method,feasible for applicants to pursue, other than an area variance. This lot is wide and narrow, and a variance is necessary to allow for a narrow front porch and 27.3 ft. depth of the proposed home, while meeting all remaining setbacks. Minor variances are necessary for the alternative relief requested for a 31 ft. rear setback and for the 255 sq. ft increase (2.55%) of lot coverage for the applicant's layout and design of the home with a front porch. 3. The alternative relief is minimal with a 2.5% expansion of the current code limitation of 20% lot coverage and four ft. reduction from the 35 ft. rear yard setback requirement. 4. The difficulty has been self-created and is related to applicants plan to build on a 10,000 sq. ft. lot, without meeting the limitations of the zoning code. 5.
