SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated July 31,2015 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated August 19, 2015. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP with respect to the proposed second story additions and alterations, and is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP with respect to the non-conforming side yard setbacks of both the as-built deck addition and as-built accessory deck. The applicant proposes to reconstruct both of the subject non-conforming as-built decks to conforming side yard setbacks which will make them CONSISTENT with the LWRP as well as the code, as shown on the Architectural Site Plan entitled "General Arrangement proposed bedroom extension", Sheet 1, dated 5/12/2015 and last revised (Rev.3) 7/20/2015,ZBA Submission 2, prepared by Robert O. Barratt, P.E. PROPERTY FACTS/DESCRIPTION: Subject parcel is a non-conforming 13,610 sq. ft. lot located in the R40 zone district. It is improved with a 1 1/2 story frame house with attached deck, accessory deck, accessory shed and accessory 1 '/2 story frame garage. It has 30 feet of frontage on Holbrook Road, 332.11 feet along the eastern property line, 51.79 feet along West Branch of Mattituck Creek and 336.81 feet on the western property line as shown on the survey dated July 6, 2015 prepared by Nathan Taft Corwin, III, LS. BASIS OF APPLICATION: Request for Variances from Article XXIII Section 280-124 and the Building Inspector's June 12, 2015 Notice of Disapproval based on an application for building permit for second story addition/alterations to existing single family dwelling and legalize 'as built' deck addition and 'as built' accessory deck, at; 1) addition and 'as built' deck addition less than the code required minimum side yard setback of 10 feet, 2) addition and 'as built' deck addition less than the code required total side yard setbacks of 25 feet, 3) 'as built' accessory deck less than the code required minimum side yard setback of 5 feet. Page 2 of 3—September 17,2015 ZBA#6881—Cacchioli SCTM#1000-113-6-13 RELIEF REQUESTED: The applicant requests variances to construct a second story addition which will have the same non-conforming side yard setback and non-conforming combined side yard setback as the existing first story. The applicant amended the application before the public hearing so as to eliminate the need for variance relief for an attached as-built deck and an as-built accessory deck. AMENDED APPLICATION: Before the Public hearing, the applicant proposed a plan which has brought both the non-conforming as-built attached deck and non-conforming as-built accessory deck into conformance with the code, as shown on the Architectural Site Plan entitled "General Arrangement proposed bedroom extension", Sheet 1, dated 5/12/2015 and last revised(Rev.3) 7/20/2015,ZBA Submission 2,prepared by Robert O.Barratt,P.E. ADDITIONAL INFORMATION: The Town Engineer submitted a letter dated August 20, 2015 recommending the site comply with Chapter 236 for Storm-water Management. During the hearing the agent was asked to provide certified information verifying the lot coverage. On September 4, 2015 the agent submit lot coverage calculations of 19% certified by Robert O. Barratt,LPE. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 3,2015, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Many homes in this neighborhood have a second story and what is proposed is similar to what exists in the neighborhood. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing 1-1/2 story dwelling exists in its non- conforming side yard and non-conforming combined side yard locations. Therefore any proposed second story addition and alteration will require variances. The subject parcel is long and narrow, having only 30 feet of road frontage and 52 feet of width at the high water mark. 3. Town Law 267-b(3)(b)(3). The variances granted herein for a side yard and combined side yard are mathematically substantial, respectively representing 48% and 57% relief from the code. However, this parcel is long and narrow as are other parcels in this neighborhood having similar non-conforming side yard setbacks. 4. Town Law $267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 267-b. Grant of the amended relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a second story addition and alteration, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. Due to a 6% slope in this property, a majority of stormwater runoff from this site is directed to the West Branch of Mattituck Creek. Once the ZBA has determined which variances will be approved,the applicant will be required to submit stormwater plans for compliance with Chapter 236 along with their application for Building Permit. At that time,the Building Department will forward those plans to my office for review and comment. At this time, I would recommend a covenant and or prerequisite from the ZBA requiring this site to comply with Chapter 236 for Stormwater Management, in a manner that would encompass the entire site, including all existing impervious surfaces as well as the new modifications and/or additions. If this site has existing drainage structures or systems that have not been shown or indicated, they can be certified as to size and location by incorporating them into a Stormwater Plan which must be submitted to the Building Department. This plan will then be reviewed for compliance by my office.
