Gorham Trust PROPERTY LOCATION: 162 Lower Shingle Hill Road(Fox-Avenue),Fishers Island,NY SCTM 1000-9-1-26 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The applicant's property is a non-conforming 10,019 sq. ft. parcel in the R- 40 zone. The northerly lot line measures 74.69 feet along Lower Shingle Hill Road. The easterly lot line measures 137.09 feet along a residential parcel, the southerly lot line measures 72.76 feet along Fox Avenue, and the westerly lot line measures 139.63 feet along another residential parcel. The property is improved with an existing single family dwelling, as shown, with the "as-built" porch and "as built" accessory shed, on the survey drawn by CME Associates,Engineering,Land Surveying&Architecture,PLLC, dated June 22,2015. BASIS OF APPLICATION: Request for Variances from Article XXIII Section 280-124 and Article III Section 280-15 and the Building Inspector's July 13, 2015 Notice of Disapproval based on an application for building permit for"as built"additions and alterations to an existing single family dwelling and an"as built"accessory shed, at; 1)"as built" additions and alterations at less than the code required minimum front yard setback of 35 feet, 2)"as built" shed located in other than the code required rear yard. RELIEF REQUESTED: The applicant requests variances to legalize a 110 sq. ft. non-conforming"as built"porch constructed in 1974, with a front yard setback of 4 feet, where 35 feet is required, and a 96 sq. ft. "as built" accessory shed originally constructed in 1978-9, in a side yard area,where a rear yard area is required. ADDITIONAL INFORMATION: The property straddles two streets, has two front yard areas, and does not have any conforming rear yard area. No letters were submitted by any of the neighbors that stated any objections to the applicant's request for the variances. The accessory shed did receive building permit #19180 issued July 9, 1990, for the replacement of the original shed that had been first constructed in approximately 1978-79. This happened apparently without the need for a variance, even though the shed existed in an actual side yard location. The "as built" porch and shed on the subject property were originally constructed in the 1970's. Otherwise, it is likely that the porch and shed would not have been constructed on this property without a permit, because as a consequence they became"as built" structures, a status that impairs the sale of the property to prospective new owners. Page 2 of 3—September 17,2015 ZBA#6880—Gorham Trust SCTM#1000-9-1-26 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 3,2015, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law $267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The "as built" porch and shed have existed since their construction, in their exact locations for almost 40 years. The neighborhood is comprised of approximately 24 single-family dwellings, almost all of them, if in fact not all, having non-conforming principal setbacks, and some also having non-conforming accessory building areas and setbacks. The quaint,upscale community was developed in the early 1900's as a clutter of"cottages" directly associated with a large resort hotel complex. The nearby main multi-story wood frame hotel structure was subsequently demolished shortly after WWII, when such grand buildings had become somewhat out of fashion. At that time the "cottages" were sold on separate parcels to individual owners. With the onset of modern zoning code, the "cottages" were each granted an existing, but non- conforming status. Because the construction took place many years ago, was done by the original owners who purchased the property from the hotel owners, and because there are numerous other non-conforming "cottages"/single-family dwellings and accessory structures also existing nearby, grant of these specific variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. 2. Town Law $267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The "as built" porch cannot be feasibly built without a variance for a non-conforming front yard setback because the existing single-family dwelling already has a non- conforming 3.9 ft. setback from Lower Shingle Hill Rd., and a large portion of the dwelling is actually constructed within a non-conforming front yard setback area. The"as built" accessory shed cannot be located in a conforming area because the property technically has two front yards and no rear yard area, therefore the shed requires a variance for the side yard location. 3. Town Law 267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 89% relief from the code for the 4 ft. front yard setback porch, and 100% relief for the side yard location of the shed. However, the existing dwelling was built in the early 1900's, with the existing 3.9 ft. front yard setback. Most of the house is actually within a non-conforming area because of the two front yards. The porch is a relatively small, 110 sq. ft. un-conditioned space, and has a slightly larger setback of 4 ft. The shed cannot be located in a conforming rear yard because such an area does not exist. Lower Shingle Hill Rd. is a private service road, generally traversed only by vehicles owned by the residents of the immediate neighborhood, their guests, and other vehicles occasionally required to be there for work related purposes. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an approximately 40 year old "as built" porch with a non-conforming front yard setback, and an "as built" shed located in a non-conforming side yard area, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Page 3 of 3—September 17,2015 ZBA#6880—Gorham Trust SCTM#1000-9-1-26 RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Horning, seconded by Member Dantes, and duly carried,to GRANT, the variances as applied for, and shown on the survey drawn by CME Associates, Engineering, Land Surveying&Architecture,PLLC, dated June 22,2015. CONDITIONS: 1. The porch will remain as un-conditioned space. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms.
