PROPERTY LOCATION: 430 West Shore Drive(adj.to Southold Bay), Southold,NY SCTM# 1000-80-05-2.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated August 3, 2015, stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated August 21, 2015. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: Subject parcel is non-conforming containing 19,905 sq. ft. (18,200 buildable) located in an r40 zone district. It is improved with a concrete foundation of a new dwelling under construction with a proposed attached porch and accessory in-ground pool. It has 100.03 feet of frontage on West Shore Drive, 202.11 feet along the eastern property line, 100.00 feet on Southold Bay, 195.99 feet along the western property line as shown on the survey dated February 14, 2012, last revised September 9, 2015 prepared by John T. Metzger, LLS. BASIS OF APPLICATION: Request for Variances from Article XXIII Section 280-124,Article XXII Section 280-116B, and Article III Section 280-15 and the Building Inspector's June 19, 2015 amended June 22, 2015 Notice of Disapproval based on an application for building permit to construct a porch addition to an under construction single family dwelling and an accessory in-ground swimming pool, at; 1)more than the code permitted maximum lot coverage of 20%, 2)proposed porch and accessory swimming pool at less than the code required bulkhead setback of 75 feet, 3)proposed accessory in-ground swimming pool located in other than the code required rear yard or front yard for waterfront property. RELIEF REQUESTED: The applicant requests a variances to: 1) for a total proposed lot coverage of 24.4%where the code permits a maximum of 20%, 2) to construct an in-ground swimming pool and an attached porch at 63.1 Page 2 of 3—September 17,2015 ZBA#6877—430 WSD,LLC SCTM#1000-80-5-2.1 feet from a bulkhead where the code requires a minimum distance of 75 feet, and 3) for locating a pool in a side yard where the code only permits a rear yard or front yard (on waterfront parcels) location. ADDITIONAL INFORMATION: The applicant's agent provided other variances granted in the area similar to these requests. AMENDED APPLICATION: At the hearing the applicant was asked to bring the request into more conformity with the code. On September 15, 2015 applicant's agent submitted a revised survey showing the in-ground pool reduced in size and the lot coverage at 23.6% thereby bringing the variance request in more conformity with the code. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 3, 2015, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 267-b(3)(b)(1). Grant of the variances for: 1) constructing an in-ground swimming pool and proposed porch at 63.1 feet to an existing bulkhead and 2) constructing an in-ground swimming pool in a side yard, and Grant of the relief as amended for a maximum lot coverage of 23.6%will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The in-ground pool is proposed to be well screened from view by the adjoining property owner and the proposed bulkhead setback is greater than that of other parcels in this neighborhood. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicants desire to construct an in-ground pool on this parcel has in most part created the need for a lot coverage variance and a side yard location variance. Without the proposed in-ground swimming pool, lot coverage would be at a conforming 20%. A front yard location for the in- ground pool would not be feasible due to the location of the septic system and therefore, the applicant cannot meet the principal front yard setback without the benefit of a variance. 3. Town Law $267-b(3)(b)(3). The variance granted herein for a bulkhead setback is mathematically substantial, representing 16% relief from the code. However, other parcels in this neighborhood have lesser setbacks to a bulkhead. The variance granted herein for an accessory in-ground pool in a side yard is mathematically substantial representing 100% relief from the code. However,the proposed in-ground pool will be well screened by an existing row of evergreens and not visible from the street. The variance granting the relief as amended for lot coverage of 23.6% is mathematically substantial, representing 18% relief from the code. However, the relief as amended is reducing the pool size to 648 square feet (18 x 36) and the in-ground pool is close to grade and will be screened from street view and the adjoining neighbors view. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law $267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief for bulkhead setbacks and to locate an in-ground swimming pool in a side yard location and to Grant the relief as amended for lot coverage of 23.6% is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an in-ground swimming pool and a porch addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Page 3 of 3—September 17,2015 ZBA#6877—430 WSD,LLC SCTM#1000-80-5-2.1 RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman (Chairperson), seconded by Member Goehringer, and duly carried,to GRANTS the variances as applied for, regarding the bulkhead setbacks and to locate the in=ground swimming pool in the side yard and shown on the Survey/Site Plan, prepared by John T. Metzger, L.S., dated February 14, 2012 and last revised September 9,2015 (revisions). DENY, the lot coverage as applied for, and GRANT RELIEF AS AMENDED, the proposed in-ground swimming shall be no larger than 18'X36' and the lot coverage shall be 23.6% maximum, as shown on the Survey/Site Plan, prepared by John T. Metzger, L.S., dated February 14, 2012 and last revised September 9, 2015 (revisions). Subject to the following conditions; CONDITIONS: 1. The proposed porch shall remain unheated and open on three sides. 2. Evergreen screening. 3. Pool mechanicals shall be placed iia sound deadening enclosure 4. Drywell for pool de-watering shall be installed. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3)years from the date such variance was granted. The Board of Appeals may,upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one(1)year terms. The zoning setbacks for an undersized parcel requires 35 feet,however,because the parcel is on the water with a bulkhead the rear yard setback increases to 75'. The depth of the lot to the bulkhead is only 170' therefore adding a porch to the house requires a variance from the distance to the bulkhead. The house was pushed forward to the maximum extent possible to leave room for the new sanitary system in the front yard. The pool is proposed in the side yard and behind the garage maintaining the distance of the porch and pool to 63.1', the maximum extent practical. All structures have been pushed away from the bulkhead. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: The house is at 75'from the bulkhead,a porch addition is not possible without a variance from setbacks to the bulkhead. As to the swimming pool it is tucked in an area behind the garage which was left open for a future pool. The swimming pool is pushed back away from the bulkhead the maximum practical and in line with the proposed porch. (3) The amount of relief requested is not substantial because: In 2013 the bulkhead was replaced. As a condition of a wetland permit from the Trustees to restore the bulkhead and protect the property, an existing 18' x 27'wood deck located on the bank @15' from the bulkhead was removed. (See photo of deck) The applicant did not want to remove a preexisting deck, however, his only choice was to remove the deck in order to r\f rebuild a storm damaged bulkhead, or litigate with the Trustees their authority to require removal of a legal preexisting structure unrelated to the bulkhead. ADDITIONAL INFORMATION: The neighbor to the East of the property spoke at the public hearing and in his opinion granting this variance will allow the owner to improve his property by demolishing the existing structures and building a new home and accessory garage, fixing the existing bulkhead and bringing the home into conformance with other similar houses to the west and east of his in keeping with the character of the neighborhood. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 6,2013 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law§267-b(3)(b)(1). Grant of amended relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Granting alternative relief for the bulkhead setback cannot be achieved without a variance because the applicant proposes to use a portion of the existing foundation which has a non-conforming bulkhead setback. However, the amended bulkhead setback is more conforming to the code and similar to others in the neighborhood 3. Town Law 4267-b(3)(b)(3). The variance granted herein for the bulkhead setback is mathematically substantial, representing 23% relief from the code. However the alternative relief increased the bulkhead setback by over 6 feet and a landscaped buffer will control run off from the slope of the bank. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The grant of alternative relief has addressed the concerns and has eliminated one variance. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and install drywells, leader and gutters, and re- build the existing bulkhead. 5. Town Law $267-b(3)(b)(5). The difficulty has been self-created. The property is improved with a two-story frame house,shown on the August 18,2005 survey prepared by John C.Ehlers. BASIS OF APPLICATION: Building Department's July 21,2005 Notice of Disapproval,citing Section 100-244 in its denial of an application for a building permit to construct a proposed addition and alterations to the existing dwelling for the reasons that the total side yards will be less than the code requirement, proposing 12.9 feet, and the lot coverage will exceed 20%, proposing 21+- percent. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 15,527 square foot lot in the Residential R-40 District with a 70.55 ft. frontage along West Shore Drive, 63.28 ft. along Peconic (Southold) Bay, 269.7 ft. on the easterly,.property boundary, and 227.12 ft on the westerly property boundary. It is improved with a single family dwelling arid attached seaward deck. BASIS OF APPLICATION: Requests for Variances under Sections 280-116-B and 280-122, based on the Building Inspector's November 19, 2008 Notice of Disapproval concerning proposed additions and alterations to the existing single-family dwelling. The reasons stated for disapproving the building permit application are that the new construction will constitute an increase in the degree of nonconformance on a single side yard, on total (both) side yard setbacks,and at less than 75 feet from the bulkhead. LWRP DETERMINATION: A Letter dated May 12, 2009 from Mark Terry, LWRP Coordinator, confirming inconsistency was subniltted to the Board of Appeals under Chapter 95,Waterfront Consistency Review of the Town of Southold Code and Lacal Waterfront Revitalization Program (LWRP)standards. A letter dated May 20,2009 from Nicole Spinelli, District technician, of Suffolk County Soil and Water noted that upon site inspection on May 19, 2009, there were no observed natural resources concerns with regard to the construction of additions to the residence. The existingf bluff is stable and well vegetated. Potential adverse environmental impacts by granting the relief requested will be mitigated by the applicant's proposed removal of the existing non-conforming sanitary system located less than 100 ft from the bulkhead and replacement with an upgraded sanitary system located more than 100 ft from the bulkhead; addition of new gutters and leaders and drywells to capture and recharge roof runoff; and establishment of a six-foot wide non-turf buffer at the top of the slope leading to Southold Bay. These proposed additions and alterations will maintain the existing non-conforming single side yard setback of 9.7 ft from the corner of the existing dwelling and 8.8 ft from the corner of the existing deck where 10 ft. is required, maintain the existing non-conforming total side yard setback of 20.1 feet where 25 is required,and maintain the existing non-conforming setback from the bulkhead of+1-47 feet. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections,the Board makes the following findings: 1. Town Law§267-b(3)(b)(3)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Proposed additions and alterations will all take place within the existing structural footprint with no further encroachment on the pre-existing non-conforming setbacks. The renovations will improve the appearance of the dwelling and correct substandard construction. The proposed architectural design is in keeping with other homes in the neighborhood. 2. Town Law§267-b(3)('b)(2).The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue; other than area variances because the existing dwelling has pre-existing non-conforming setbacks.Therefore,anjt new construction or replacement of existing structures will require variances. 3. Town Law§267-b(3)(b)(3). The variances granted herein are not substantial in so far as no increase in the pre- existing nonconforming'setbacks is being proposed. The setback relief of 47.8 ft. from the bulkhead represents 28 feet or 37%from the required 75 ft.and is mathematically substantial;the relief for the single side yard setback of 8.8 ft where 10 feet is the minimum required, is 1.2 feet or 12%, which is not substantial; the relief for a total side yard setback of 20.1 ft where.25 feet is required represents 4.9 ft.or 19.6%,and is substantial. 4. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The existing bluff is stable and well vegetated.
