WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable consideration

ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being kx0be at Southold, County of Suffolk and State of New York, shown and
designated as Lot No. 40 on a certain map entitled, "Map of Yennecott Park
situate at Southold, Town of Southold, Suffolk County, New York", surveyed by
Van Tuyl & Son, Greenport, New York, May 1, 1968, and filed in the Office of the
Clerk of the County of Suffolk on the 9th day of October 1968 as Map No. 5187,
being bounded and described as follows:
BEGINNING at a point on the southerly line of Yennecott Drive where same is
intersected by the common division line between Lots 39 and 40 on the above
captioned map;
RUNNING THENCE South 14 degrees 04 minutes 00 seconds East, along said common
division line, 113.35 feet;
THENCE South 84 degrees 38 minutes 30 seconds West, 283.83 feet to Lot 41 on
the above captioned map;
THENCE North 15 degrees minutes West, along said Lot 41, 24.80 feet to
the southerly line of Yennecott Drive;
THENCE North 61 degrees 27 minutes 20 seconds East along the southerly line
of Yennecott Drive, 182.32 feet;
THENCE still along the southerly line of Yennecott Drive North 75 degrees
56 minutes East, 104.65 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises as conveyed to the party of the
first part by deed dated December 21, 1987, and recorded in the Suffolk
County Clerk's Office on December 29, 1987 in Liber 10504 page 34.

OGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
butting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
he estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
remises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the
DEecond part forever.
DisND the party of the first part covenants that the party of the first part has not done or suffered anything
serhereby the said premises have been encumbered in any way whatever, except as aforesaid.
ND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
Blk. 04.00 rst part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
Lot(s)034.0 purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
