I would invite anybody that would like to address the Town Board on any issue to please feel free. Linda Goldsmith,East Marion LINDA GOLDSMITH: Hi, Linda Goldsmith, East Marion. I wanted to talk to you a minute about the situation with night fishing particularly the situation at Trumans beach. I know Mr. Russell you were there on Sunday and you spoke with the woman who owns the house just east of the beach, almost on the beach and I know you spoke with several of our beach attendants. But I wanted to give you a little perspective, I is getting pretty bad. I was a former parks commissioner and now they have taken pity on me and given me a job a couple of days a week. Albie DeKirrilis and I used to go down at 10:00on the weekends, Friday, Saturday and Sunday at night and ask people to leave who weren't supposed to be there and they would usually go and then Albie would go down again at midnight after work and do the same but what is happening now is when we ask them to leave, they will not. The problem is,just to the west of Truman's is the State launching ramp. It is not necessarily used as a launching ramp, some of the people use it for that but generally the parking area is taken up by vans of people who, while we are there till 6:00, stay a little bit to the west of the fence and then after 6, migrate way down. We get a lot of discontent I guess you would say, from the neighbors at the east because people are on their property and I know that the debris that's left is extremely, there's a lot of it, let's put it that way. There are glassine envelopes, fishing hooks, fishing knives. When I was a commissioner they set the park on fire. It was a dry season and the meadow went on fire one morning at 5:00. There are camp fires down there, overnight camping, there is fishing and I have actually even this year taken buckets that have been hidden in the wetlands area of fish about that big. And I have taken them and dumped them back in the water I don't know what you can do about that. One of the things I think would be signage, there used to be a sign on the state side saying no picnicking, no swimming, no camping, no overnight fires but that sign I think was destroyed during hurricane Sandy. The other thing I did want to say is that the park district from what the commissioners have been speaking to me about, are making attempts to put no trespassing signs up, no parking after dusk, people usually wait for me to leave and then go back on, so I go back and ask them for a permit, they don't have one, so they wait until I have been gone for an hour and then come back. Making an attempt to go down there at night and ask people to leave. People say at the high water mark, okay, below the high water mark I understand. But they can't walk across our property to get to it. They have to walk in the water. But I do want to tell you and I think this is important. That your local police department has been very, very responsive, they have been responsive, they have been courteous, they have been there every time that we have called. I know this is a problem all over Southold Town, I understand that and I know they must get at least 15 calls a day but I did want to tell you they have been extremely responsive and very, very courteous. And we really do appreciate it. I know it's a lot of work for them, they have to come down to the beach and they have to walk all the way down because you can't get through the wetlands. The other problem we have is people in the wetlands. I had to pull someone out the other day, someone actually didn't understand it is not grass, it is not a lawn and into the wetlands and I was trying to explain but there was a language barrier and they July 28, 2015 page 31 Southold Town Board Meeting walked forward and up to their knees in the muck and I had to pull them out. And I guess that would help with the understanding but I was wondering if you had any influence with the State to have them put some signage up there. It would be very, very helpful because if there is no open fires and stuff there maybe even though we have the signs I think that would help a little bit, I think maybe they have to be in two languages. I don't think one language is going to work, I don't know what can be done except to keep calling the police. We are going to see with the park district about getting people towed and things like that. I don't know exactly because the problem wasn't so severe when I was a commissioner. I am just having a hard time taking off my commissioner's hat. So if you could at least possibly maybe help out with the state, I know you were there and there were tickets given, there' were tickets given on Sunday afternoon, I don't think it was necessarily for being on the beach but some of the vehicles weren't in tiptop shape. So there were some tickets given. That would be very helpful. Take a ride down there some early morning, the fires, the overnight camping and the noise is, I know a friend, Beverly Green, who lives, part of that property to the east, that beach is hers and she woke up one morning and she was about to call the fire department, her house was full of smoke from the bonfires. And we get blamed, of course, the beach gets blamed you know, if we didn't have this beach here but they gave us the beach, so.... SUPERVISOR RUSSELL: The town board talked about it today, it's a problem throughout town we did talk about it a few years ago, we took some initiatives then that were reasonably successful, obviously the problem is back, we need to address it. I think, we understand the public trust doctrine I've talked to those owners, they are not looking to thwart it, they are looking to support it but some of these activities go beyond the scope of what's allowed under the public trust doctrine. And we are talking to the police chief about a coordinated effort with the park district and private property owners and the DEC, who should be out there issuing violations for people fishing without permits and have no conception of size limits, and everything else so it is going to be a coordinated effort. I am going to talk to the DEC about re- signage in that parking lot because it is completely gone but obviously when someone goes down on the shoreline someone has the right to traverse it because of the public trust doctrine but the signage in the parking lot is completely gone so we are going to try a series of initiatives to address it. MS. GOLDSMITH: I mean, we have had some luck by, I know it sounds crazy, removing our dumpsters and our garbage cans. We have cut down on our garbage to one yellow bag a week. We used to have the dumpster emptied twice a week. It is not there and people don't seem to drop their garbage anymore but go a little west to the state side and theirs are always full, I don't know what they can do about that. And Brian from the DEC, he's the one who replaced Tom Gadomski, he is also very responsive but you know, 15 or 20 times a day. I mean, you can't... SUPERVISOR RUSSELL: It needs to be a coordinated effort and it needs to be a sustained effort to make any difference, that's what we plan on doing. MS. GOLDSMITH: Well, what we can do is, I am a beach attendant this year, I am not a park commissioner but whatever we can do, if you have any suggestions for us. July 28, 2015 page 32 Southold Town Board Meeting SUPERVISOR RUSSELL: I think a regular presence would help, I know there's one homeowners association out here, that has plenty of beach where people can access but they have a regular presence and they don't have a problem with overnight fishing and stuff but that's easier said than done, because it costs money. So we are looking at those. MS. GOLDSMITH: Our biggest problem is that we are right there. You can't miss the entrance to Trumans, we are right there. You'd have to be blind to miss it. Whether you are going east or west, we are right there. The other quick point, that as you are going west from orient point to wherever, right after you go past the DEC part of the beach, there's a curve, almost like an S curve, and we have noticed for some reason on that curve there is more and more passing. It is a disaster waiting to happen. I am not sure why they don't pass on the straight away between the little crab shack and the beach, I am not quite sure but they wait until the curve. The other day we saw 4 cars pass within two hours and one car passed two cars. But I do want to say that the Police Department has been more than cooperative, you know, I would be getting annoyed at this point if I was them, and so has Brian from the DEC. But whatever you can do, whatever we can do as citizens or whatever the commissioners can do, I am sure they would be more than happy to talk to you about it.
