PERALES VWVW.DOS.NY.GOV SECRETARY OF STATE SOUTHERN REGION —BOARD OF REVIEW In the Matter of the Petition of: DECISION FRANK NOTARO For a Variance to the New York State Uniform Fire Prevention & Building Code PETITION NO. 2015-0242 Upon the application of Frank Notaro, filed pursuant to 19 NYCRR 1205 on July 1, 2015, and upon taking testimony and hearing argument thereon at a duly noticed hearing before the Southern Region—Board of Review held at the Perry B. Duryea Jr. State Office Building, 250 Veterans Memorial Highway, Hauppauge, New York, on July 9, 2015, and upon all other papers in this matter, the Board makes the following determination: NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to additions and alterations to an existing single-family dwelling, two stories in height, Type 5B wood frame construction, approximately 2,473 square feet in gross area, located at 125 Hilltop Path, Town of Southold, County of Suffolk, State of New York. Relief is requested from: 19 NYCRR Part 1220, The Residential Code of New York State, Section 802.3, which states Whenever a vertical addition is made to a building to create a third story above grade, or when the floor area of a legally existing third story is increased more than 10 percent, the building shall be equipped throughout with an automatic sprinkler system installed in accordance with NFPA 13D. [The petitioner requests relief to not install a sprinkler system throughout the building.] FINDINGS OF FACT 1. The building that is the subject of this petition is properly classified as a single-family dwelling of Type 5B construction and two stories in height. 2. At the present time, the building that is the subject of this petition is two stories in height with an open roof deck above the second story with an exterior stair leading to grade. The Petitioner wishes to fully enclose the roof deck, which will create a third story. 3. The architectural plans submitted with the application depict that the existing exterior stair will be used to access the new enclosed space, and there will be no access from the interior of the building. 4. That a new third story space is proposed to be approximately 240 square feet and unheated. NTATEEWYORK Department SOF OPPORTUNITY_ of State . Petition No. 2015-0242 Page 2 5. A variance was required from the Town of Southold Zoning Board of Appeals for the addition, because the building height within the Town is limited to two and one-half stories. The variance was granted with conditions that the new third story space will not be heated and will not be used for cooking or sleeping. 6. The Petitioner had proposed to provide a partial automatic sprinkler system, installed as per NFPA 13D, for the third story only. However, the installation of a sprinkler system would require a potentially costly dry system. 7. The Petitioner proposes, as an alternative, to install a rated floor/ceiling assembly between the proposed third story and second story below. 8. The Petitioner has not stated if new smoke alarms, interconnected with existing smoke alarms on the first and second stories, will be provided in the new third story. 9. The building in question will be a full three stories at the front and right side. The grade rises to the left side and rear of the building so that the finished floor of the new third story is only approximately 13 to 14 feet above the grade in that area. However, as calculated, per the definition of"Story Above Grade" found in the Residential Code of New York State, the building still qualifies as a three-story building. 10. The new third story space will be accessed by a hinged door, approximately three feet wide, that opens onto an exterior wood landing approximately four feet in width. 11. The exterior stair that will be used to access the new third story space is located at the rear of the building. At that location, the stair has only 17 risers from the small landing outside the new space to grade, which would allow occupants of the new space to exit rapidly in the case of an emergency. 12. The Petitioner proposes that the existing stair in question meet all applicable provisions of Section R311 of The Residential Code of New York State. 13. The Petitioner has stated that because the building is already constructed, installing a code-compliant automatic sprinkler system throughout the entire building would be both physically and economically impracticable. CONCLUSION OF LAW The proposed variance will not substantially adversely affect the Code's provisions for health, safety and security. Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would entail practical difficulty and unnecessary hardship, and would create an excessive and unreasonable economic burden, and would be unnecessary in light of alternatives which ensure the achievement of the Code's intended objective, or in light of alternatives which, without a loss in the level of safety, achieve the Code's intended objectives more efficiently, effectively, or economically. Petition No. 2015-0242 Page 3 DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from the provisions of 19 NYCRR Part 1220, Section AJ802.3, be and is hereby proposed to be GRANTED with the following conditions: 1. That a minimum one hour fire-rated floor/ceiling assembly between the proposed third story and a second story story below be installed. 2. That smoke alarms will be provided in the new third story and be interconnected with existing smoke alarms on the first and second stories. 3. That the new third story space will not be heated. 4. That the new third story space will not be used for cooking or sleeping. 5. That the existing stair meet all applicable provisions of Section R311 of The Residential Code of New York State. 6. That the addition and alterations will meet all other applicable provisions of The Residential Code of New York State. This decision is limited to the specific building and application before it, as contained within the petition, and should not be interpreted to give implied approval of any general plans or specifications presented in support of this application.
