Sanders �lj�`,ou Fax(631) 765-6641 April 20, 2016 BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD Jeffrey Patanjo 106 Hewitt Blvd. Center Moriches, NY 11934 RE: KUHL FAMILY TRUST 1790 NORTH BAYVIEW ROAD, SOUTHOLD SCTM# 1000-70-12-38.1 Dear Mr. Patanjo: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, April 20, 2016 regarding the above matter: WHEREAS, Jeffrey Patanjo on behalf of KUHL FAMILY TRUST applied to the Southold Town Trustees for an Amendment to Wetland Permit#8644 under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated March 24, 2016, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policies 6.3 and 9.3 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: that the proposed reconfiguration of the floating dock to an "L" shape will move the boat and dock away from the channel, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on April 20, 2016, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, 2 WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, BE IT FURTHER RESOLVED, that the Board of Trustees APPROVE the Amendment to Wetland Permit #8644 to add a 4' wide by 6' long cantilevered platform adjacent to the bulkhead; and relocate existing aluminum ramp and floating dock 6' to the south off of seaward end of proposed platform; and as depicted on the site plan prepared by Jeffrey Patanjo last dated March 15, 2016, and stamped approved on April 20, 2016. Located: 1790 North Bayview Road, Southold. SCTM# 1000-70-12-38.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my determination that the proposed actions are INCONSISTENT with the below listed LWRP policies 6 and 9.3 and therefore is INCONSISTENT with the LWRP: Policy 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. A permit for an existing dock was not found. Policy 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. A. Limit grants, leases, easements, permits or lesser interest in lands underwater in accordance with an assessment of potential adverse impacts of the proposed use, structure, or facility on public interest in public lands under water. Use the following factors in assessing potential adverse impact: The applicant fails to prove that the action meets the following requirements § 275-11 Construction and operation standards C. 2 (d) of the Southold Town Code: (d) Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: [1] Whether the dock will impair navigation or be located in areas of high vessel traffic or vessel congestion; 1. The navigable channel is limited and close to the shoreline. Even with the proposed alteration, this dock will obstruct the navigable channel. If a larger vessel is moored, -greater impacts will occur. Note that the existing channel shown on the plans does not align with the aerials. The channel is wider than shown and bathymetry of the channel should be required. The below aerial shows the existing channel and encroachment. An alternative to the dock could be a mooring. SCTM#70-12-38.1 Inspected by: Jack McGreevy The CAC does Not Support the application consistent with the report from June 2015: The CAC does not Support the application because the current structure is sited on public property and has destroyed/removed the natural marshland that is apparent in the area. The plans have been revised to reflect the addition of a 4' wide x 6' long platform adjacent to the bulkhead along with relocating the aluminum ramp and floating dock 6' to the south. In its' current approved location there is insufficient water depth for docking a boat during seasonal low tides. As you will see on the attached plan there is still adequate separation from the channel to allow for passing vessels. As their adjacent neighbor at 1690 North Bayview Road, we fully support the Kuhl's request for a permit to replace their bulkhead. We have serious concerns, however, regarding the current placement of their floating dock because it obstructs the channel and is not in compliance with existing permits. The I-shaped dock that is currently in place at 1790 N. Bayview (and is shown on the bulkhead permit plan submitted for the above referenced application) does not comply with the permits that were issued to the Kuhl family and has not been approved by the Town. We respect and appreciate our neighbor's use and enjoyment of the channel and creek. However, this dock partially blocks the channel, making it very difficult for us and other neighbors to navigate through the channel and to access our docks. The Town previously approved a T-shaped dock at 1790 North Bayview Road, one that did not extend as far out and did not block the channel. Compliance with existing permits and the approved T-shape dock, not blocking the channel, is important to allow for everyone's use and enjoyment of the channel. Of course dredging the creek and channel could potentially provide some relief to all.
