Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Granting of the requested variances will not_produce an undesirable change in the character of the neighborhood or a detriment to nearby properties.The new dwelling that the applicant proposes to construct in the proposed location is characteristic of the neighborhood and there is no evidence presented indicating that the proposed structure and its location will be a detriment to nearby properties. The proposed bulkhead setback is consistent with the dwellings on either side of the proposed subject dwelling. 2. Town Law 4267-b(3)(b)(2).The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than area variances. The applicant.proposes to demolish and remove the existing structures which would permit the applicant to construct a new dwelling at a code conforming bulkhead set back. The width of the parcel is approximately 65 feet which would permit a proposed dwelling having a 30 foot width to be located in a code conforming side yard and total side yard location. 3. Town Law 4267-b(3)(b)(3). The variance granted herein for a 64 foot bulkhead set back, requiring an I 1 foot or 15% relaxation of the code required 75 is not mathematically substantial. The adjacent parcels have lesser bulkhead setbacks than what the applicant proposes. The variances granted herein and as amended for a 10 foot side yard setback and a 22 foot total side yard, respectively requiring a 5 foot(33%) and 13 foot(37%) relaxation of the code required 15 feet and 35 feet are both mathematically substantial. However, their substantiality is mitigated when comparing the requested setbacks to the setbacks that which exist on similar parcels in this waterfront neighborhood. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. In fact, the applicant is proposing to demolish the existing accessory cottage and garage and install a new septic system and drvwells to contain storm water runoff on site which will improve the subject parcel. 5. Town Law &267-b(3)(b)(Q. The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law X267-b. Grant of the requested relief for a 64 foot bulkhead setback, a 10 foot side yard and a 22 foot total side yard (as amended) is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new dwelling with the applicants desired design, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
