PURPOSE: • Increases from$50,000 to $80,000 maximum annual budget appropriation that the Town of Southold, Suffolk County, may make to Orient Mosquito District. SUMMARY OF PROVISIONS: Increases amount to be included in annual budget of Town of Southold for the Orient Mosquito District to be levied by the county legislative body of Suffolk County from$50,000 to$80,000 fbr the extermination of mosquitoes in such district. JUSTIFICATION: • By way of history,the Orient Mosquito District was established by the Southold Town Board on September 5, 1916,pursuant to the provisions of Chapter 246 of the laws of 1916. When first enacted,this special act provided for an annual levy of$800. Thereafter,this was increased to$3,000 by Chapter 156 of the Laws of 1951; to $5,000 by Chapter 1024 of the laws of 1956; to$7,000 by Chapter 561 of the Laws of 1974;to$10,000 by Chapter 902 of the Laws of 1981;to$15,000 by the Chapter 228 of the Laws of 1985; and to$30,000 by Chapter 153 of the Laws of 1989,$40,000 by Chapter 196 of the Laws of 1996; and to$50,000 by Chapter 462 of the Laws of 1997. The Mosquito District is the only such district in Suffolk County. It provides for all services necessary for the control of mosquitoes in and around the hamlet of Orient. Due to rising costs and expenses,the District finds it impossible to perform the duty imposed on it with its annual budget. Accordingly,the District requests that the statute be amended to raise from$50,000 to $80,000 the annual amount which may be expended for mosquito control. LEGISLATIVE HISTORY: 1999 00. Section 1 of. chapter 246 of the laws of 1916 relating to 2 the extermination of mosquitoes and the establishment of districts 3 therefor, as amended by chapter 164 of the laws of 1996, is amended to 4 read as follows: 5 Section 1. The town board of any town in the county of Suffolk may 6 establish one or more districts for the purposes of this, act within the 7 town and outside the boundaries of any incorporated village on the peti- 8 tion of a majority of the owners of taxable real property in the 9 proposed district. The petition must be signed by the petitioners and la acknowledged in the same manner as a deed to be recorded. Such petition, 11 accompanied with a map showing the boundaries of the proposed district, 12 shall be filed with the -town clerk. PURPOSE OF BILL: Increases to $50,000 the maximum annual budget appropriation that the Town of Southold, Suffolk County, may make to Orient Mosquito District. SUMMARY OF SPECIFIC PROVISIONS: Increases amount to be included in annual budget of Town of Southold for the Orient Mosquito District to be levied by the county legislative body of Suffolk County from $40,000 to $50,000 maximum. JUSTIFICATION: By way of history, the Orient Mosquito District was established by the Southold Town Board on September 5, 1916, pursuant to the provisions of Chapter 240 of the laws of 1916. When first enacted, this special act provided for an annual levy of $800. Thereafter, this was increased to $3,000 by Chapter 156 of the Laws of 1951;.to $5,000 by Chapter 1024 of the laws of 1956; to $7,000 by Chapter 561 of the Laws of 1974; to $10,000 by Chapter 902 of the Laws of 1981; to $15,000 by Chapter 228 of the Laws of 1985; to $30,000 by Chapter 153 of the Laws of 1989; and $40,000 by Chapter 164 of the Laws of 1996. The Mosquito District is the only such district in Suffolk County. It provides for all services necessary for the control of mosquitoes in and around the hamlet of Orient. Due to rising costs and expenses, the District finds it impossible to perform the duty imposed on it with its annual budget. Accordingly, the District requests that the statute be amended to raise from $40,000 to $50,000 the annual amount which may be expended for mosquito control. Purpose and Summary: This bill amends chapter 246 of the Laws of 1916 relative to the amount that may be raised for the purposes of the Orient Mosquito District from $15,000 to $30,000. Effects of Present Law which This Bill would Alter: Section one of chapter 246 of the laws of 1916, as amended by chapter 228 of the laws of 1985. Justification: By way of history, the Orient Mosquito District was established by the Southold Town Board on September 5, 1916, pursuant to the provisions of Chapter 246 of the Laws of 1916. When first enacted, this special act provided for an annual levy of $800. Thereafter, this was increased to $3,000 by chapter 156 of the laws of 1951; to $5,000 by chapter 1024 of the laws of 1956; to $7,000 by chapter 561 of the laws of 1974; to $10,000 by chapter 902 of the laws of 1981; and to $15,000 by chapter 228 of the laws of 1985. The Mosquito District is the only such district in Suffolk County. It provides for all of the services necessary for the control of mosquitoes in and around the hamlet of Orient. Due to rising costs and expenses, the District finds it impossible to perform the duty imposed upon it with its annual budget. Accordingly, the District requests that the statute be amended to raise from $15,000 to $30,000, the annual amount which may be expended for mosquito control. Section one-of chapter two hundred forty-six of the laws 2 of nineteen hundred sixteen, relating to the extermination of mosquitoes 3 and the establishment of districts therefor, as amended by chapter nine 4 hundred two of the laws of nineteen hundred eighty-one, is amended to 5 read as follows: 6 Section 1. The town board of any town in the county of Suffolk may 7 establish one or more districts for the purposes of this act within the 8 town and outside the boundaries of any incorporated village[ , ] on the 9 petition of a majority of the owners of taxable real property in the 10 proposed district. The petition must be signed by the petitioners and 11 acknowledged in the same manner as a deed to be recorded. Such petition, 12 accompanied with a map showing the boundaries of the proposed district, 13 shall be filed with the town clerk. If any such district be established, 14 the town board shall thereafter include in the annual budget of taxes to 15 be levied by the board of supervisors a sum not exceeding three thousand 16 dollars[ ,] except that in the town of Southold, the town board shall 17 thereafter include in its annual budget for the Orient mosquito dis- 18 tricti established pursuant to this chapter, a sum not exceeding [ten] 19 fifteen thousand dollars[ ,] for the extermination of mosquitoes in such 20 district, which sum shall be levied by such board of supervisors upon 21 the property subject to taxation in the district as so established. For 22 the purpose of the levying of such tax, the board shall apportion the 23 same pro rata upon such taxable property and transmit a certified state- 24 ment thereof to the board of supervisors. Such apportionment shall be on 25 the basis of the valuation of such property as fixed by the last preced- 26 ing assessment roll of the town. When first enacted, this special act provided for an annual levy of $800.00. Thereafter, this was increased to $3,000.00 by Chapter 156 of the Laws of 1951; to $5,000.00 by Chapter 1024 of the laws of 1956;, to $7,000.00 by Chapter 561 of the Laws of 1974 and to $10,000.00by Chapter 902 of the Laws of 1981. The Mosquito District is the only such district in Suffolk County. It provides for all of the services necessary for the control of mosquitoes in and around the Hamlet of Orient. Due to rising costs and expenses, the District finds it impossible to perform the duties imposed upon it with its annual budget. Purpose or General Idea of Bill: To allow the Orient mosquito district to increase its annual. appropriation from the Town of Southold to $10,000. • • • Summary of Specific Provisions: • • Special Act. • • • • • • • • Effects of Present Law which This Bill would Alter: Raises from $7,000 to $10,000 the amount that can be appropriated for the Orient mosquito district.. • • • Justification: Under Chapter 246 of the laws of 1916 , the' towns in Suffolk County •are allowed to form districts to provide for the extermination of mosquitoes. The hamlet of Orient at the extreme eastern tip of Long Island' s north fork has the only existing district. The law also provides the maximum amount that can be appropriated for such purposes. In Orient that amount is currently $7,000 . Since 1916, it has been increased from the original ';cap of $800 three times in 1951, 1956 and 1974 . • Again because of increasing costs , Orient requires additional taxing authority to adequately serve the public. This legislation would accomplish this goal. Prior Legislative History: New bill. Fiscal Implications for State and Local Governments: Maximum of $3, 000 to the residents of the Orient mosquito district.
