SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated August 3, 2015 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The applicant's property is a conforming 119,872 S.F. parcel in the R-40 zone. The northerly lot line measures 405.60 feet along New Suffolk Ave. and the easterly lot line measures 301.02 feet along adjacent residential parcels. The southerly lot line measures 445.10 feet along Jackson Street and the westerly lot line measures 267.65 feet along other adjacent residential parcels. The property is improved with a new house currently under construction, as shown, with the proposed swimming pool, proposed pergola and proposed garage on the survey drawn by BBV Civil Engineers & Surveyors, dated 6/29/15, last updated on 8/7/15 to show increased setbacks and side yard evergreen screening for the proposed detached garage. BASIS OF APPLICATION: Request for Variances from Article III Code Section 280-15 and the Building Inspector's June 19, 2015 Notice of Disapproval based on an application for building permit to construct an accessory garage and an in-ground swimming pool, at: locations in other than the code required rear yard. RELIEF REQUESTED: The applicant requests two variances in order to construct a proposed swimming pool in a side yard, where a rear yard area is required by code; and a proposed detached garage in a front yard area where a rear yard area is required by code. AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the code. The applicant on August 7, 2015 submitted a survey increasing the new garage front yard setback to 55 feet on New Suffolk Ave., from the originally proposed 50 feet, and increasing the easterly side yard setback to 30 feet, from the originally proposed 25 feet, bringing the plan into more conformity with the codes. The applicant also indicated that 10 foot high evergreens would be planted on the easterly property line to provide evergreen screening from the neighboring house, as shown on the newly submitted survey dated August 7, 2015. The Page 2 of 3—August 20,2015 ZBA#6876—Warlan SCTM#1000-117-9-8.1 applicant also agreed to reduce the conforming ridge height of the proposed accessory garage from approximately 20 feet to 16 feet, as shown on the amended survey dated May 8, 2015 last revised 8/7/15 prepared by Barrett, Bonacci &VanWeele, PC and on the amended elevations dated 6/12/15 pages 1 &2, prepared by Digital Design. ADDITIONAL INFORMATION: The easterly neighbor expressed concerns at the public hearing about the need for evergreen screening along the property line. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 6, 2015, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law $267-b(3)(b)(1). Grant of the variances as shown on the amended application will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Several variances have been granted in the past within the neighborhood for the location of accessory garages in front yard areas. The applicant has a large, 2.75 acre conforming parcel, and lot coverage will be 4.0% after the proposed construction, where 20% coverage is allowed by code. Both the swimming pool and garage will be screened from view from the streets and neighboring houses. 2. Town Law $267-b(3)(b)(2). The benefit sought by the applicant as shown on the amended application cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The property is characterized by having two front yard areas, and there is no rear yard area in which a conforming swimming pool or garage can be located. 3. Town Law $267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 100% relief from the code. However, there is no conforming rear yard where the pool and garage could be located. An existing, non-conforming accessory garage located closer to New Suffolk Ave., and closer to the easterly side yard has been removed. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law $267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief, as shown on the amended application, is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new swimming pool, and accessory garage, located in other than the code required rear yard, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Horning, seconded by Member Dantes, and duly carried,to GRANT, the variances as applied for in the amended application, and shown on the survey drawn by BBV Civil Engineers & Surveyors, dated 6/29/15, last updated on 8/7/15 to show increased setbacks and side yard evergreen screening for the proposed detached garage. Subject to the following conditions; Conditions: Page 3 of 3—August 20,2015 ZBA#6876—Warlan SCTM#1000-117-9-8.1 1. Evergreen screening shall be continuously maintained. 2. Accessory garage shall not exceed 16 feet in height. 3. Pool mechanicals shall be placed ista sound deadening enclosure. 4. Drywell for pool de-watering shall be installed. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three(3)consecutive one(1)year terms. The issue we have is that the average height of the garage slightly exceeds 16' . My client agreed to not exceed 16' of height and he and I were under the impression that was from the "existing grade of the driveway" and not the average from front to back as it states 16' in height on the zba approval. As a contractor I also believed it was to be no more then 16' from the "pre existing" grade and the most important grade was the existing grade of the driveway and "off'the front porch of the existing house. Not at any point did we think differently as we would never want to have the garage lower then the existing driveway and completely wrong when it comes to topography, drainage and overall layout. To be honest as a contractor I "always" and"only"thought it had to be 16' from the existing driveway since the garage connects to the existing driveway Here are the numbers exactly as they stand now The front elevation that is touching the driveway the height from the existing grade to the top of the garage at the peaks is 15'-8" The Rear of the garage to the existing grade is 16' -10" inches 1 SO from front to back the grade lowers by 12" inches which we plan to improve g We thought we were doing exactly what we agreed to at the ZBA meeting and we built it 16' from existing driveway grade. Since we are a little off when it comes to the average height we are asking you for permission to move forward. When we are done we plan on adding a little soil and mulch around the garage to make up any difference and this will improve the look and will not effect drainage. I would like to point out that my client compromised in every way he could the day of that meeting in order to make the neighbor happy . He agreed to the 16' height limit when he did not need to, he agreed to cedar shake roof verses a metal roof like the rest of the house, he did not remove a single tree and actually added trees and a burm to add privacy and improve drainage between the two neighbors, he changed the architectural appearance of the garage to keep his neighbor happy by having a roof pitch that doesn't match the the main house. Knowing this is even an issue I don't think he would have ever agreed to build the garage lower then what code allows. He increased the side yard setback as well All's we are trying to do a build a garage that replaced an older detached garage, We thought that we were within right to go 16' from existing driveway entrance and did not think this would be an issue at all. Attached are some pictures showing you how and why the average height is a little higher then 16' and it is mainly because of the natural drop off. Please note that this garage is shorter then allowable by code, shorter then the pre-existing trees that we said we would keep, and much shorter then the neighboring homes. For my client and myself and speaking, as the contractor please know that we thought we were doing the right thing as agreed upon and in no way want to create an issue. We are not trying to do more then what we agreed to do. We simply can not have the garage lower as it will not look good at all and we can not drive down into the garage or there will be water flowing into it, I have attached pictures showing you the situation and please know that we are no higher then 15'-8'" inches to the top of garage from the floor of the garage. I have resided here since 1987 and during that time I have enjoyed the vista and plantings extending west of my residence including the bay window on my first floor and the bedroom windows on the second floor I write to you in opposition to this application. In a nutshell the applicants are locating a garage out of their view but directly in my view First I wish to point out there are alternatives that are reasonable and feasible The applicants demolished the garage that had stood on this property for many years A new garage could be located next to the existing garage on the property behind or south of my residence This is a three acre parcel locating a new garage atop my side yard will serve the visual convenience of the applicants but diminish the view I have enjoyed and the public has enjoyed of the New Suffolk Avenue side of this property Second, the proposed garage location is not a desirable change in this immediate neighborhood Traveling from the bridge by Kimogenor Point to the easterly end of New Suffolk Avenue - the entire length of the hamlet - there is not one If front yard garage New Suffolk Avenue and the applicant' s property in particular is historically a place of architecture and building placement consistent with the character of the hamlet.
