SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated June 25, 2015 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued his recommendation dated July 21, 2015. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: Subject property is located in the R40 Zone and is non-conforming at 14,235.17 sq. ft. It is improved with a single family dwelling and accessory garage all of which is to be demolished. It has 68.00 feet on MacDonald Crossing, 189.31 along MacDonald Road, 76.00 feet on the Great Peconic Bay and 179.17 on the northern property line as shown on the survey dated June 5, 2014 prepared by Michael K. Wicks, LLS. BASIS OF APPLICATION: Request for Variance under section 280-124, and the Building Inspector's May 29, 2015 Notice of Disapproval based upon an application for a building permit for a demolition of an existing single family dwelling and construction of a new single family dwelling, at: 1) less than minimum code required front yard setback of 35 feet, 2) less than the code required bulkhead setback of 75 feet. RELIEF REQUESTED: The applicant requests a variance to demolish a single family dwelling, and replace it with a new single family dwelling with a non-conforming front yard setback of 20 feet from MacDonald Road where the code requires 35 feet and a bulkhead setback of 33 feet where the code requires 75 feet. Page 2 of 3—August 20,2015 ZBA#6875—Ariens SCTM#1000-145-4-17 AMENDED APPLICATION: At the hearing the agent for the applicant was asked to bring the proposal more into conformity with the code. On August 12, 2015 the agent submitted a revised site plan noting the bulkhead setback at 37.77. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 6, 2015, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). The grant of the amended relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed front yard setback on MacDonald Road is more than the existing home footprint. Due to the flood zone this is the only place the new home can be placed to mitigate damage from possible future flooding. This section of MacDonald Road is a dead end and there is only one other home on this road. Several homes have non-conforming setbacks similar to this request. 2. Town Law$267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. However, the home can be moved further from the bulkhead. The applicant's amended survey created more conformity with the code required bulkhead setback of 75 feet. 3. Town Law$267-b(3)(b)(3). The variance granted herein for the front yard is mathematically substantial, representing 43% relief from the code for the front yard setback. However, the property is a corner lot with two front yards and the existing home has a lesser setback from MacDonald Road id than the new proposal. The bulkhead setback represents a 50% relief from the code for the bulkhead setback. However, the applicant is moving the dwelling further from the bulkhead to reduce the amount of relief while still maintaining a conforming front yard setback from MacDonald Crossing. 4. Town Law§267-b(3)(b)(4) No substantial evidence has been submitted to suggest that the variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 267-b(3)(b)(5) The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law $267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of constructing a new home while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes, seconded by Member Horning, and duly carried, to GRANT the variances as amended, and shown on the proposed site plan and building location dated July 17, 2015 last revised August 12, 2015, prepared by Charles W. Southard, RA. Subject to the following condition: CONDITIONS: The attached deck as granted shall remain open to the sky. That the above condition be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Despite repeated attempts to clear up the final sanitary, electric and Trustees inspections with him, my calls/emails went unanswered. I hired Dynamic Permits in June of 2020 to finalize the SCHD permit for the sanitary system. That process took more than a year, with new plans needed to be drawn up. Final approval was received on Sept. 27, 2021. In the meantime, I worked on the final electrical inspection, a process which began in July, 2020. We passed that inspection in Oct, 2020. 1 also arranged for the Trustees inspection which we received in the summer of 2020. The biggest delay was the sanitary system, once that was received in Sept. 2021 we went back to the town for the C/O. With sincere apologies for not keeping the Board up to date, I was unfortunately caught off guard by a contractor who had been handing permits and extensions until he walked off the job in the Spring of 2020. As you are aware, it was later determined that the site plan presented with the ZBA application, last revised August 12, 2015, incorrectly depicted the proposed lot coverage of 14.6%. The error was discovered when the applicant's design professional submitted a copy of the amended plan(approved by the NYSDEC ori 3/7/2016), to the Building Department, last revised January 20, 2016, showing the lot coverage as 21.07%. As a result,the applicant submitted to the Zoning Board of Appeals a letter dated June 27, 2016, along with an amended site plan revised June 21, 2016, describing his error in lot coverage calculations, and denoted a reduction in size of the proposed deck in order to comply with the Town Code's minimum lot coverage provision of 20%.
