Bryan, last dated July 1, 2015, and determined that the proposed dwelling with sanitary system and driveway, proposed limits of clearing, grading, and ground disturbance located landward of the demarcated project limiting fencing and staked hay bales which are to be installed 100' landward from the top of the bluff is out of the Wetland jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code. Regarding the natural pond located on the south side of Soundview Avenue, any proposed project, clearing, grading or ground disturbance on the subject property would be exempt from the Board of Trustees' jurisdiction; and as per the current Wetlands Code, Chapter 275-4(A)(1)(m) — EXCEPTIONS: Operations landward of a public road whereby the public road is located between the water body that is the source of Trustee jurisdiction and the operations. Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, or within 100' landward from the 2 top of the bluff, without further authorization from the Southold Town Board of Trustees pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. Weber, 1975 Soundview Avenue, Mattituck: SCTM 1000-94-1-11 Dear Mr. Bredemeyer: July 24, 2015 We represent Gerald Weber, who wishes to formally document the jurisdictional boundaries of the Board of Trustees over his above referenced property pursuant to Chapters 111 and 275 of the Southold Town Code for the purposes of establishing where the property may be cleared and/or graded and/or improved with residential structures without a Town Wetlands or Coastal Erosion Management Permit. To that end, I enclose herewith the following documents: 1) A Board of Trustees agent authorization letter signed by Mr. Weber authorizing En -Consultants to apply for a Board of Trustees Letter of Non -Jurisdiction on his behalf; 2) A copy of a letter addressed to the Board of Trustees granting permission to the Trustees to enter onto his property in connection with his request for jurisdictional determination; 3) Two copies of a sealed survey/site plan prepared by Wallace T. Bryan, L.S., which depicts the top of bluff; the 100' top of bluff setback; the limit of freshwater wetlands located on the south side of Soundview Avenue; the 100' setback from that wetlands boundary; a proposed dwelling with sanitary system and driveway, all located beyond those 100' setbacks; and the proposed limits of clearing, grading, and ground disturbance equal to the 100' setbacks from those two natural features, demarcated with project limiting fencing and staked haybales. As all proposed structures and related construction activities, including clearing and grading, would therefore be situated a) landward of the Coastal Erosion Hazard Area boundary; and b) more than 100 feet from the top of bluff and thus beyond the jurisdiction of the Board of Trustees pursuant to §111-8 and §275-3(C)(5), respectively, would you kindly prepare a Letter of Non -Jurisdiction accordingly. Please also include in the letter the fact that the subject property would be exempt from the Trustees' jurisdiction within 100 feet of the wetlands located on the south side of Soundview Avenue pursuant to §275-4(A)(1)(m) due to the separation of the subject property from those wetlands by a public road.
