The Trustees, as owner in Trust of the underwater lands of Pipe's Cove Creek, Greenport, New York, hereby grant you, non -transferable, provisional permission to place not more than 5 "SPAT/SMELC style" shellfish cages 10 yards offshore of your residence located at 805 Bay Shore Road, Greenport, NY. Having considered your proposal, the Board does not see the need for a formal agreement for the use of the small area occupied by the cages for a project we consider having potential multiple public resource benefits, including improved water quality and wild stock replenishment. The provisional nature of this grant draws from the Board's prerogatives to protect natural resources and the possibility that change(s) in environmental conditions, shellfish disease or the waters sanitary harvest status and/or public policy may compel the Board to withdraw or modify such approval in the future. Please share this with all trustees prior to their visit on August 12. I have been involved with the SPAT program for over five years and have invested a considerable amount of time and money in this worthwhile program. In the past, I understood that DEC permits were obtained by Cornell. Two years ago, the DEC ordered Cornell to remove all cages from Pipes Creek as there wasn't a permit on file for them. I complied and now reluctantly grow the oysters at Cornell. I would much rather grow them in Pipes Creek as there are more oysters than you can ever count at Cedar Beach. This year Cornell asked me to directly apply for a DEC permit. It was denied in April because I requested to grow ten cages (I did not know the SPAT participants were limited to only five cages). CCE met in person with the local DEC on May 29 and, I was told by Kim Tetrault that they had reached a verbal understanding, and the DEC would approve my application for five cages without a need for a dock or bulkhead. I then submitted another application in June requesting only to grow five cages. This time I was denied based on not providing permission from the owner (I guess that is the Town of Southold). Please review my latest DEC application and denial that is attached. I called Jen Odyer (local DEC) on July 14 and she said that she would find out if the trustees permission was indeed what the DEC wanted. I have not heard back from her. My request is extremely modest. The oysters will be grown for environmental and personal use only. The five cages will be within ten yards of my 100 foot shoreline, monitored by me in person and will not impede navigation. I have and will comply with all SPAT requirements. Unfortunately, the DEC has not been cooperative at all with me or Cornell on this simple process. First of all, I can't understand their reasoning on blocking such an environmentally great project — to improve the water quality in Pipes creek on a very limited trial basis. I don't know why they require a dock or bulkhead to do this. I don't know what their issue is or what they want from me to resolve it. Lastly, they have not returned my phone calls from three weeks ago on this. In short, I am extremely frustrated by their tactics and lack of communication from them over the past few years. As a result, I respectfully request your support and permission as the Southold Trustees on this very reasonable matter. I can assure you that I am a good environmental steward and have the ultimate respect for our town's resources. I look forward to your visit with me on August 12.
