Upon demolition of the existing structure the current floor system is structurally deficient and not properly tied to the foundation. I am requesting approval to replace the existing floor joists and girders. Sill plates will be added to properly tie the structure to the foundation. We understand that 25% of the existing structure must remain. In complying with that we plan to maintain the original foundation plan and remove the existing exterior walls intact and reinstall upon completion of a new floor system. Multiple safety issues were discovered upon demolition and include: - No Sill Plates - Floor system is not tied to the foundation - there is no box beam - the existing walls sit on a single 2x8 ledger around the entire perimeter,causing shifting of the structure - 2x8 floor joists are over spanned and deflecting over 1" - East side of structure has 2x6 floor joists which are insufficient to carry any load - Existing girders consist of 2-2x6's with splice made in center span and are deflecting over 1" and cracking Replacing the floor system would allow us to properly tie the foundation, the sill, the floor beams and wall systems together. It will give a stable and secure platform for the two-story renovation. It would also prevent us from having to do unorthodox repairs that would lead to future problems with the structure. The homeowners have worked diligently and tirelessly for three years with the town and county for all the approvals they acquired for their renovation. We have set an October completion date and are looking for an expedited approval to keep the job moving forward to keep said date. Your prompt attention to this matter is greatly appreciated. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated December 29, 2014 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. PROPERTY FACTS/DESCRIPTION: Subject parcel is a non-conforming 22,660 square foot parcel located in an R-40 Zone. The parcel has 96.00 feet of bulkhead frontage on the Long Island Sound. It runs 219.39 feet on the East side, 117.86 feet along Soundview Avenue, and 200.84 feet on the West side. The parcel is improved with an existing 1 story frame house. The existing structure is 51'2"from the top of the bluff. The survey shows there is a concrete cover seaward of the existing house. All is shown on the survey by Peconic Surveyors P.C. dated May 16, 2006 and last updated August 8,2013 and on a site plan by Ural Talgat,Architect dated 10-29-2014. BASIS OF APPLICATION: Request for Variance from Article XXII Section 280-116A(1) and the Building Inspector's November 12, 2014 Notice of Disapproval based on an application for building permit for additions and alterations to a single family dwelling, at; 1) less than the code required setback of 100 feet from the top of bluff. RELIEF REQUESTED: The applicant requests a variance to construct additions and alterations resulting in a setback of+/-47 feet from the top of the bluff where a 100 foot setback is required. Page 2 of 3—January 22,2015 ZBA#6825—Nikolakakos SUMk1000-51-4-13 ADDITIONAL INFORMATION: Testimony was taken that the concrete cover in the rear yard is the cover of an active water well. County water is not available on this section of Soundview Avenue. Testimony as well as site inspection showed that other homes in the neighborhood are less than 100 feet from the bluff. Further, Suffolk County Soil and Water Conservation District issued a report dated December 29, 2014. The report stated: "The bluff was found in stable condition with good vegetative cover. The foreground (yard) leading to the bluff ° top is in turf grasses. The retaining wall built into the bluff face is in fair condition. The stairwell leading to the beach is also in fair condition.... The general topography of the property is sloping away from the bluff face and the land itself is entirely vegetated turf grass and some trees. It is recommended that the building plans include diverting landward any runoff that may develop during construction. During construction, it is further recommended that heavy machinery, or supplies be stored...a minimum if a 25' setback from the top of the bluff." FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 8,2014 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby,properties. The area consists of single family homes many of which are set back less than 100 feet from the top of the bluff. The additions and alterations will increase the nonconformity by 3.3'. This slight increase is for steps and a landing. The existing setback for the house is being maintained. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing setback for the house is non-conforming. Any additions and alterations to the existing residence would require variance relief. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 53%relief from the code. However, the additions and alterations are consistent with the LWRP, and the Soil and Water Conservation District Report found the property to be suitable for the current proposal. The existing footprint shall be maintained,the applicant is constructing a second story addition. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood.
