Boundary Line Agreement & Scenic Easements
This Agreement, made the 5- day of a L4 N E , 2015, between David M. Skwara and
Chester H. Skwara, Jr., co-executors of the Estate of Joyce M. Skwara, having an address at 466
Penwood Drive, Edgewater, MD 21037 and 200 Crawford Glen Ct.,Greenville, SC 29615,
respectively (herein referred as to "Skwara"), and Pellegrini Peconic LLC, owner, having an
address at 23005 Main Road, Cutchogue, NY 11935(herein referred to as "Pellegrini");
WITNESSETH THAT
WHEREAS the aforesaid parties are the owners of contiguous parcels of real estate in
the Town of Southold, County of Suffolk and State of New York, on the north side of Wells
Road, Peconic, NY
WHEREAS the Skwara is the owner of Lot 1 of Final Plat Land Division of the Estate
of Skwara, filed on February 17, 2015 in the Office of the Suffolk County Clerk as file #11985;
and known as Suffolk County Tax Map parcel District 1000 -Section 86-BIock 1 and lot 14.1
(Schedule A-1 attached hereto) (the Skwara Premises); and Pellegrini is the owner of a parcel
known as Lot I of Richmond Creek Farms minor subdivision, Peconic NY, further described as
Suffolk County Tax Map parcels District 1000 -Section 86 -Block 1 and lot 9.3 (Schedule A-2
attached hereto) (the Pellegrini Parcel); and
WHEREAS a survey map dated April 25, 2015 of the boundary between the Skwara
Premises and Pellegrini Premises has been prepared by Kenneth M. Woychuk, Licensed Land
Surveyor of the State of New York, (the "Map), a reduced copy of which survey map is annexed
hereto and made a part hereof as Schedule B; the Pelligrini parcel being that referred to as "now
or formerly Peconic Land Trust", and
WHEREAS, the Map indicates that a post and wire deer fence is Iocated and grape vines
planted on the northerly end of the Skwara Premises, inside the northwesterly property line a
distance of 51 feet and the northeasterly property line 40 feet from the true line of division
between the Skwara Premises and the Pellegrini Premises; and
WHEREAS, the Map also indicates that in two areas on the southerly end of the
Pellegrini Premises, the deer fence is located north of the Skwara Premises, which area has not
been cultivated and remains natural and wooded; and
WHEREAS, the true line of division between the Skwara Premises and the Pellegrini
Premises is the line shown as the northerly property line of the Skwara Premises and southerly
line of the Pellegrini Premises shown on the Map;
WHEREAS, Skwara has been advised of Southold Town Code Section 280-99, Right to
Farming Practices, the Notice of which is annexed hereto as Schedule Q
NOW THEREFORE in consideration of the mutual promises and conveyances herein
contained, and other good and valuable consideration, the receipt of which is hereby mutually
acknowledged, the parties agree as follows:
That the true line of division between the said parcels, i.e. between the northerly
boundary of the Skwara Premises and the southerly boundary of Pellegrini
Premises a line commencing at a point on the northerly side of the Skwara
Premises and Wells Road North 30 degrees, 14 minutes, 30 seconds East a
distance of 226 (175' + 5 F)feet, thence running at a ninety degree angle South 59
degrees, 45 minutes, 30 seconds East 74.93 feet thence; running North 65
degrees, 47 minutes, 40 seconds East a distance of 69.81 feet as shown on the
survey. No claim of right, title, or interest to the land of each party is made by the
other party, except as set forth in this agreement.
2. This agreement shall run with the lands comprising the-Skwara Premises and the
Pellegrini Premises and shall also be binding upon and inure to the benefit of the
parties hereto, and their respective heirs, executors, administrators, trustees,
beneficiaries, distributees, tenants, grantees, licensees, invitees, successors, and
assigns.
3. An easement is hereby granted from Skwara to Pellegrini within the area on the
Map labeled "Agricultural Easement" to maintain deer fence, grape vines, and
farm road on the Skwara parcel; to maintain the grape vines; and to conduct such
other agricultural operations thereon which are permitted by the Southold Town
Code. Pellegrini may install above ground or underground utilities in the
easement area for agricultural use only. No other structures shall be constructed
in the easement area. The area is described on the attached Schedule D;
4. An easement is granted from Pellegrini to Skwara over the areas north of the
Skwara Premises and south of the deer fence, identified on the survey as Scenic
Easement Area I and Scenic Easement Area 2, which lands are -hereby intended
as a buffer between the Pellegrini Premises, and the Skwara Premises. This
easement is a scenic easement in favor of Skwara, their heirs successors and
assigns. No fences, structures, walkways, fireplaces, tree houses, or statuary may
be constructed or placed in the easement area. No temporary structures, including
without limitation, greenhouses, trampolines, outdoor furniture or barbeque pits
or equipment, or any type of lighting, electrical accessories or other utilities are
permitted. No structures shall be constructed, or placed in the easement area.
Except as provided in Paragraph 5, Scenic Easement Areas l and 2 shall remain as
a wooded buffer.
5. Pellegrini reserves the right to use Scenic Easement Areas # 1 and #2, or any part
thereof, for agricultural operations permitted under the Southold Town Code,
except that no buildings shall be constructed thereon, and no storage of items shall
be permitted.
6. This agreement contains the entire understanding between the parties hereto with
respect to the matters set forth herein. This agreement may not be modified,
alterdd, terminated, waived, abandoned, or discharged in any manner, except by
an instrument in writing signed by all the parties hereto or their respective heirs,
executors, administrators, trustees, distributees, grantees, successors, or assigns.

7. Each party, for themselves, their heirs, successors and assigns, as the dominant
party to any easement granted herein, hereby releases the other (servient) party
from any claim for injury, damage, expense or loss against the servient party and
indemnifies and holds the servient party harmless from all such claims, including
without Iimitation, reasonable attorneys fees, by the dominant party, its heirs,
legal representatives, successors, assigns, guests, invitees, agents and contractors.
8. It is understood and agreed that all understandings and agreements heretofore had
between and among the parties hereto are merged in this agreement, which alone
fully and completely expresses their agreement, and that the same is entered into
after full investigation, no party hereto relying upon any statement or
representation made by any other party except as specifically set forth in this
agreement.
9. This Agreement is subject to and subordinate to Deed of Development Rights
dated November 25, 1997 to the Town of Southold, recorded in the Suffolk
County CIerk's Office in Liber * cp
10. The parties agree that this Agreement may be signed in counterparts.

SCHEDULE C
§ 280-99 Right to undertake protected farm practices.
A. Farmers shall have the right to undertake protected farm practices in the active pursuit of agricultural operations,
including, but not limited to: clearing; grading; plowing; aerial and ground spraying; the use of legal agricultural chemicals
(including herbicides, pesticides and fertilizers); raising horses, poultry, small livestock and cattle; processing and
marketing produce; installing water and soil conservation facilities; utilizing farm crop protection devices; designing and
constructing and using farm structures, including barns, stables, paddocks, fences, greenhouses and pump houses; using
water; pumping; spraying; pruning and harvesting; disposing of organic wastes on the farm; extensive use of farm
laborers; training and others in the use and care of farm equipment, animals; traveling local roads in properly marked
vehicles; and providing local farm produce markets near farming areas.
B. These activities can and do generate dust, smoke, noise, vibration and odor. These activities may occur on holidays,
Sundays and weekends, at night and in the day. Such activities are presumed to be reasonable. Such activities do not
constitute a nuisance unless the activity has a substantial adverse effect on the public health, safety and welfare.

Scenic Easement Area #1
All that certain plot, piece or parcel of land, lying and being at Peconic, Town of
Southold, Suffolk County, New York, being more particularly bounded and described as
follows:
Beginning at a monument on the northerly side of Wells Road at the southeasterly
corner of the premises described, at the southwesterly corner of the premises described in
Schedule A-1 herein.
Running thence North 59 degrees 45' 30" West 72.45 feet;
Thence North 30 degrees 14' 30" East 26.25 feet;
Thence North 67 degrees 19' 47" East 120.14 feet;
Thence South 30 degrees 14' 30" West 124 feet to the point or place of beginning.
