CLARKE, residing at 20 Gillies Lane, South Norwalk, Connecticut 06854, party of the second part, WITNESSETH,that the party of the first part,in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, .DISTRICT lying-and beirre i h- at Nassau Doin3t in--Cutchogue,_Town_of Southold, County of 1000 Suffolk and State of New York, more particularly bounded and described as follows: SECTION +L . BEGINNING at `a point in the northerly side of the premises 118 about to be described where the same is intersected by the division lit between the easterly side of Vanston Road and the westerly line of lot : BLOCK 250 as shown on a certain map entitled, "Amended Map A of Nassau Point' 1 and filed in the Office of the Clerk of the County of Suffolk as Map #156; running thence from said point or place of beginning the follow- LOT ing courses and distances: (1) Along the southerly terminus of Vanston 1.4 Road South 80° 40 ' 30" West, 25 feet; (2) South 211 54' 00" East, 97 .7 feet; (3) North 80° 40 ' 30" East, 262 .41 feet; and (4) North 80140 ' 30 East 25.59 feet, more or less, to the bulkhead at the high water mark of Wunneweta Pond; running thence northerly, northwesterly and norther 00 ly along said bulkhead and along the ordinary high water mark of CQ Wunneweta Pond, to a point on the southerly side of Lot 250 first abov referred to, which point is distant 95.56 feet, when measured on a CSD bearing of North 12° 44 ' 20" West from the Easterly terminus of the aforementioned course (3) ; running thence along said southerly side of Lot 250 on said map, South 800 ' 40 ' 30" West, 253.0 feet to the easterly side of Vanston Road at the point or place of beginning. TOGETHER with an easement five foot in width running along the southerly line of land conveyed to Constance D. Moore by deed dated August 20, 1973 from John A. Clarke, Constance D. Moore, Joan Darby Munkenbeck and Elizabeth C. Hohnhorst for access to Peconic Bay. SUBJECT to the use of the circular drive along the westerly portion of said premises for use by property of Ferend to the South. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances f and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- lv1 eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other Purpose. The word "party" shall he construed as if it read"parties" whenever the sense of this indenture so requires.
