WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being at Arshamomoque, Village of Greenport (not incorporated) , in
the Town of Southold, Suffolk County, New York, bounded and described
as follows:
BEGINNING at a pipe set on the southerly line of Island View Lane,
366 feet (deed) (366.24 feet survey) westerly along said line from a
concrete monument set at the northwesterly corner of land now or
formerly of Michael Schuster and Shing Shing Yeh; running thence along
said last mentioned land South 4° 19' 30" west 256.17 feet to the tie
line of "the creek"; thence southwesterly and then southeasterly along
said tie line of "the creek" the following four courses and distances:
(1) South 83° 29' 57" West 11.02 feet; (2) South 45° 41' 59" West
60.73 feet; (3) South 47° 04' 43" East 27.44 feet; (4) South 67° 08'
45" East 31.13 feet; thence South 4° 19' 30" west 39.18 feet; thence
North 85° 40' 30" West 75.00 feet to land now or formerly of John H.
Mulholland Living Trust; thence along said last mentioned land North
4° 19' .30" East 370.00 feet to a monument found and the southerly side
of Island View Lane; thence along said southerly side of Island View
Lane South 85° 40' 30" East 75.00 feet to another monument found the
point and or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of
the first part by deed dated December 20, 1999 and recorded in the
Suffolk County Clerk's Office on June 19, 2000 in Liber 12049 Page
865.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second
part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to
the payment of the cost of the improvement before using -any part of the total of the same for any other purpose.-- -
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
