the parcel above described and running thence North 18 degrees
07 minutes 30 seconds West along the easterly line of said 24 foot
right-of-way known as Raccoon Road a distance of 125. 0 feet to a

SUBJECT, however, to the reservation by William H. Wertenberg, his
heirs, administrators, executors, successors, assigns and grantees,
of a right-of-way for ingress and egress over such portion of said
24 foot right-of-way known as Raccoon Road above described and con-
veyed, and ALSO SUBJECT to all existing rights-of-way heretofore
conveyed by William H. Wertenberg over said portion of said 24 foot
right-of-way known as Raccoon Road.
I TOGETHER with a right-of-way for ingress and egress in common with ;
j all others now having or hereafter acquiring similar rights-of-way
j over the following:
1. A certain private road known as Miller' s Right-of-Way being
24 feet in width running in a general easterly direction from the
easterly side of Cox Neck Road (a public highway) to a point 1466.05
feet, more or less, from said easterly side of Cox Neck Road.
2. A certain 24 foot private right-of-way known as Raccoon Road
running from a point on the southerly line of said Miller' s Right-
of-Way South 18 degrees 07 minutes 30 seconds East a distance of
570.33 feet.
3. Another 24 foot right-of-way known as Deer Path Road, running
from a •point on the southerly line of said Miller's Right-of-Way
South 22 degrees 30 minutes East a distance of 449.50 feet.
4. Another 24 foot right-of-way known as Fox Hollow Road, running
South 71 degrees 52 minutes 30 seconds West a distance of 720.37
feet in a general _East-West direction completely across the property
now or formerly of William H. Wertenberg.
5. A certain parcel of land lying between the westerly end of the
last above-mentioned 24 foot right-of-way known as Fox Hollow Road
and the shores of Mattituck Creek bounded and described as follows ;
BEGINNING at a point on the southerly line of said 24 foot right-
of-way known as Fox Hollow Road, which point is located North 71
degrees 52 minutes 30 seconds East, a distance of 10. 06 feet from
the concrete monument set at the end of said Fox Hollow Road at the
southwesterly corner thereof; running thence South 12 degrees 07
minutes East, a distance of 244. 52 feet to a point; running thence
North 71 degrees 52 minutes 30 seconds East a distance of 60.87 feet
to a concrete monument; running thence South 18 degrees 07 minutes
30 seconds East, a distance of 84 feet, more or less, to the shores
of Mattituck Creek; running thence in a general westerly direction
along the shores of Mattituck Creek, a distance of 75 feet, more or
less, to a point and lands formerly of Young; running thence North
12 degrees 07 minutes West along said lands formerly of Young, a
distance of 305 feet, more or less, to a concrete monument set on
the southerly line of said 24 foot right-of-way known as Fox Hollow
Road ; running thence North 71 degrees 52 minutes 30 seconds East
along the southerly line, of said Fox Hollow Road, a distance of

6. A certain parcel of land lying between the easterly end of
the last above-mentioned 24 foot right-of-way known as Fox Hollow
Road and the shores of Mattituck Creek bounded and described as
follows :
BEGINNING at a point marking the easterly end of said 24 foot
right-of-way known as Fox Hollow Road at the southeasterly corner
thereof where the same is intersected by the westerly line of
premises now or formerly of William G. Miller; running thence
South 22 degrees 32 minutes 20 seconds East along said lAnds now
or formerly of W. G. Miller a distance of 300 feet,more or less,
to the shores of Mattituck Creek; running thence westerly along
the shores of Mattituck Creek a distance of 50 feet, more or less;
running thence North 18 degrees 07 minutes 30 seconds West across
the beach to the foot of the bank; running thence easterly along
the foot of the bank and parallel with the shores of Mattituck
Creek a distance of 40 feet, more or less, to a point which is
distant 10 feet from the boundary line of premises now or formerly
of William G. Miller; running thence North 22 degrees 32 minutes
20 seconds West to a point on the southerly line of said 24 foot
right-of-way known as Fox Hollow Road; running thence North 67
degrees 30 minutes East along the southerly line of said 24 foot
right-of-way known as Fox Hollow Road a distance of 10 feet to the
point or place of beginning.
SAID premises are sold and are hereby conveyed SUBJECT to the
following covenants and restrictions :
1. That the premises shall be used for residential use only and
no trade, business or commercial enterprise shall be carried on
upon the premises .
2. That the premises shall not be subdivided or sold except as
a single unit or parcel.
3. That any private dwelling house to be erected or placed on
said premises shall be erected only according to plans submitted
to and approved in writing by William H. Wertenberg, his heirs or
legal representatives. Any such private dwelling house shall con-
tain a minimum living space of not less than one thousand square
feet. No detached buildings or structures other than the private
dwelling house shall be erected or placed upon the premises, ex-
cepting stockade for screening purposes.
4. That no house trailers, tents or temporary building shall be
erected or placed upon the premises.
5. That all incinerators and garbage disposal areas shall be
enclosed or screened. That no commercial vehicle shall be stored
or parked upon the premises by the owners thereof.
6. That any private dwelling house to be erected or placed on
said premises shall be setback not less than thirty-five feet from
the easterly line of Raccoon Road and shall be set back not less
than ten feet from either side line of the premises .
7. That no vehicles shall be parked or left to remain standing in
or upon any of the rights-of-way hereinabove granted or upon the
common beach areas, nor shall any vehicles be driven over or upon
the rights-of-way leading to the shores of Mattituck Creek except
for the purpose of launching and recovery of boats.
