BEGINNING at a point on the southerly side of New Suffolk Avenue,
distant 434.0 more or less feet westerly when measured along
the southerly side of New Suffolk Avenue from its intersection
with the westerly side of Deep Hole Drive said point of beginning
also being where westerly line of land now or formerly of Russell
Tuthill intersects the southerly side of New Suffolk Avenue;
"5 and running thence South 07 degrees 06 minutes 00 seconds west
along the westerly side of lands, now or formerly of Russell
Tuthill a distance of 98.00 feet to Deep Hole Creek; thence
North 62 degrees 24 minutes 00 seconds west along the waters
of Deep Hole Creek a distance of 85.00 feet to lands formerly
of Philip R. Tuthill, now or formerly of Richard Green; thence
North 10 degrees 58 minutes 30 seconds East along the last men-
tioned lands a distance of 68.39 feet to the southerly side of
New Suffolk Avenue; thence South 82 degrees 54 minutes 00 seconds
East along the southerly side of New Suffolk Avenue a distance
of 75.00 feet to the point or place of beginning.
SUBJECT TO:
1. Any state of facts shown on survey dated March 19, 1976
by Roderick Van Tuyl.
2 . Rights of the U.S. or other governmental authority to
relocate the bulkhead along the shores of Deep Hole Creek without
compensation.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of tho improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
