SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated June 19, 2015 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: Property consists of a two+story frame home and an accessory 24X24 two story garage (under construction) on a non-conforming lot of 20,796 square feet, with two front yards, having 135.00 along Sound View Road, 147.97 feet on the easterly side, 125.00 along Ryder Farm Lane, and 162.00 on southern property line. All shown on a survey dated October 20, 1987, last revised July 15, 2015 prepared by John T.Metzger,LLS. BASIS OF APPLICATION: Request for Variance(s) from Sections 280-124 and the Building Inspectors Notice of Disapproval Amended June 5, 2015, from May 29,2015, and April 21, 2015. Based upon an application for a building permit to amend building permit #396462 (construction of a single family dwelling) to include additional porches, decks, and an accessory in—ground swimming pool, at; 1) legs than the code required front yard setback of 40 feet (Sound View Avenue), 2) less than the code required front yard setback 40 feet (Ryder Farm Road, 3) less than the code required rear yard setback of 50 feet, 4) lot coverage at more than code maximum allowed of 20%, located at, 110 Sound View Avenue(corner Ryder Road) Orient,NY, SCTM#1000-15-3-33. RELIEF REQUESTED: The applicant was issued a building permit to construct a two story single family dwelling and accessory two story garage in 2013. The permit was issued in error because the decks and porches were not included in the setbacks and because the submitted plans were not clearly labeled. Applicant is requesting a front yard setback of 34 feet from Sound View Avenue where the code requires 40 feet, a front yard setback of 32.6 feet from Ryder Farm Road where the code requires 40 feet, a rear yard setback of 37.7 feet where the code requires 50 feet and lot coverage of 23.68%where the code allows a maximum of 20% lot coverage. Page 2 of 3—August 6,2015 ZBA#6870—DeFiore SCTM#1000-15-3-33 AMENDED APPLICATION: At r the hearing, the applicant was asked to bring the plan into more conformity with the code. The applicant, on July 16, 2015, submitted a plan that eliminated all but one variance. The applicant reduced the size of the decks and porches in the front yard and relocated the rear deck to a conforming setback. The reduction of the porches and decks reduced the lot coverage to create conforming lot coverage. The applicant is requesting a front yard setback of 36.7 feet from Ryder Farm Road for a 4ft. X 9.4 ft. wood stoop. ADDITIONAL INFORMATION: At the hearing a question arose regarding the height of the dwelling and the percentage of dormer on the accessory garage roof. The applicant provided certified plans noting code conforming height and the garage roof was conforming to code per the building department. At the Public Hearing many neighbors spoke against the application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 2, 2015 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance as amended will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The majority of the improved parcels in the area of this subdivision along the south side of Sound View Road are more modest in size than the dwelling under construction on the subject property. However, many of the homes across the street on Sound front parcels are large in size and the one variance for a front yard setback on the applicant's corner lot is consist with other setback variance relief in the neighborhood. 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant's amended survey removed all but one variance, for a front yard setback, which essentially serves as an elongated landing entry to the dwelling. 3. Town Law $267-b(3)(b)(3). The variance granted herein is not mathematically substantial, representing 8% relief from the code. 4. Town Law §261-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the relief as amended is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new dwelling while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman (Chairperson), seconded by Member Horning, and duly carried,to GRANT, the variance as amended and shown on the Survey by Peconic Surveyors John T. Metzger, LLS October 20, 1987 last revised July 15, 2015. Any deviation from the variances)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three(3) consecutive one(1)year terms. The history of our neighborhood is available online at www.orientbythesea org The overwhelming majority of the 116 custom built homes in our community met the established criteria for town building code without need for variances. One of our key concerns is that the ZBA may grant a variance for the wrong reasons. A variance should not be granted to compensate for building plan omissions,for a permit approved in error or to avoid public embarrassment. The result of that variance may set a new,far worse and unfair precedent for future development of the twenty-two remaining lots in our neighborhood. It will have a detrimental effect on our community if granted. After reviewing Mr. DeFiore's 2013 plans for 110 Sound View Road, it appears that errors were made by the Southold Town building department in granting the permit. For example, more than 1500 sq.ft.of decks and porches were approved even though they were out of setback compliance. It can also be said that the builder created his own hardship by submitting a complex set of building plans that did not meet the code requirements.A most important detail was omitted in his plan—the measurements (setbacks)for all the decks and porches from the property lines. As an experienced builder, it is his responsibility to read and understand the code,submit correct plans and build to the specifications. Estoppel rarely granted "An applicant is not automatically entitled to receive relief. Estoppel is very rarely granted by the courts and those who have achieved it are peculiarly deserving of its benefits." Builder's responsibility "The builder has the burden of ensuring that the requested construction falls within the permitted zoning uses, and is.required to submit plans and specifications showing compliance with all applicable ordinances." Doctrine of Estoppel - Four factual categories must be satisfied: 1. Good Faith The builder implied, at the July 2 hearing, that he relied on the permit without knowledge that his plans violated zoning ordinances. The law states: "Persons dealing with agencies of government are presumed to know the legal limitations upon their power and cannot plead estoppel on the theory that they have been misled as to the extent of that power". • Builders who, based on their experience and expertise, should have known that the proposed development violated local zoning ordinances, cannot invoke the doctrine of estoppel, even if there was no actual knowledge. Developers are considered to have constructive notice of the zoning laws and will.not be able to, in good faith, claim they did not know. • Builder must have submitted the application for the permit in good faith, making full disclosure and accurate measurements of the proposed development. If any information was withheld, good faith does not apply. • Even if builder did not intentionally misstate in application, he will be in violation of the good faith requirement if the mistake was later discovered and not disclosed. 2. Act or Omission of the Government Developer must demonstrate that an act or omission by the government was relied upon. But developers are presumed to have constructive knowledge of the nature and extent of the powers of governmental agents who issue permits 3. Substantial Reliance Resulting in a Loss How much has the developer expended or committed to the development while relying on the government act? 4. I know the Town of Southold is already grappling with the issues created by these short-term rentals on the North Fork, and I feel granting the permit for this additional construction is highly likely to add to these problems. BASIS OF APPLICATION: Building Department's February 4, 2005 Notice of Disapproval, citing Sections 100-242A and 100-244 in its denial of an application for a building permit regarding existing deck construction. The reason stated for disapproving the application is that the as-built deck addition is less than 35 feet from rear lot line. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on June 2, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants are applying for building permits for nonconforming deck construction shown on the 4-15-2005 survey prepared by John C. Ehlers, with setbacks at 26 and 27 feet from the rear property line, at its closest points. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicants stated that the original deck was built in 1969 before their purchase of the property in 2002, and it was built at 26 feet from the rear yard lot line. This nonconformity has existed in the neighborhood without incident since that time. The existing nonconforming setback of 26 feet represents a 26% reduction from the required 35 ft. setback to the rear lot line, and the width/length of the deck at 37.2 ft along the rear yard line represents a 35% variance in the degree of nonconformity. 4. The difficulty has been self-created. While the existing deck had existed in this location since 1969, the applicants expanded the deck without the benefit of a building permit, thereby creating the hardship of removing it in order to comply with the zoning code. 5. No evidence has been submitted to suggest that the relief granted will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of deck construction, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. There will be no significant increase in the non-conformity of this pre-existing accessory building by the granting of the alterative relief offered herein, and with the conditions described within this decision. The status as an accessory pool structure, designed primarily for seasonal use, and with no habitable space, will not substantially change the use of the building as it existed prior to proposed renovations. 4. I have often wondered, looking out my kitchen window,why the house looked so odd...like a looming black space ship that had landed on the corner. It was only in riding my bike past the construction that I realized that the house was built without easements and I wondered how this could happen. A couple of years earlier I had worked with a local architect, Ira Haskel, and we designed a garage to fit on my property. I wanted 2 studios and a second floor, so code required that the garage be attached to the house.We also had to work with 50' easements on all edges. So it was with absolute dumbfounded-ness that I saw this construction going up with a un-attached garage which clearly had a second floor and upstairs rooms, and with way less than a 50' easement from the backyard of a neighbor, and from the road. One day as I was cycling by, the builder shouted out to me and asked if I knew anyone who wanted to buy a multi-generational (?) home. "You're building this on spec," I said? "Know anybody who'd be interested?" he said. This construction is a blight not only on our block, but to the combined parcels that make up Orient By the Sea.When I bought my house in 2008 there was a special sub-set of by-laws which determined easements and property use. I profess I don't know what"multi-generational" means in 2015 parlance, but this 'house' is so large that if an extended family did NOT buy it, the only use would be for a hostel, hotel or nursing home. To add porches, decks AND an in-ground swimming pool confirms for me that this builder has NO spacial sense. There clearly isn't any land left for a in-ground swimming pool unless he uses the front yard and even then it will be a mere few feet from the edge of the road. I strongly urge the city of Southold to send an inspector out to view this project. We love our end of the island and celebrate the the balance it has maintained between private and commercial land use. It would be a shame to see this property, so close to the Sound,vacant or just turning into a revolving door of VRBO rentals. And while I would have liked to add some changes to my plan, I did not, I made sure I followed the rules. And while I am sympathetic to the needs of a home owner/builder, I am amazed that this structure has been allowed to be constructed. This owner truly does not appear to understand the concept of neighbor and community as is evidenced by his newly erected 4 signs street side on his property. While I am sure all proper permits and variances have been currently adhered to date, I can not support the owners attempt to further push the issue when it comes to additional structures and or construction. Our house is directly across the street from the home under construction at the corner of Ryder Farm Lane and Soundview. I wanted to take this opportunity to write to express my strong opposition to the granting of an additional variance to further overbuild this already overbuilt home, which looks awful, is grossly disproportionate to the size of the lot on which it sits, and is entirely inconsistent with the character and aesthetic of the neighborhood. I am the last person to impose burdensome restrictions on others, but everyone who has seen this house considers it a monstrosity that absolutely shouldn't be there, even as it stands now, much less as it would look if it were overbuilt still further. Indeed, if you have not seen this awful visage in person, I encourage you to do so ... particularly if you are considering granting the requested variance. Unfortunately, I will not be able to attend the public hearing on July 2, at 1:45, as I have other pressing commitments, or else I would surely do so to speak out personally. I have been working with the Building Inspector to address open items with the permit and submitted plans of the same to the building department for review. I was informed yesterday that the building review is complete, however, before they could move forward I would need to request an extension of the ZBA decision. In consideration of this request,please allow me to explain to the best my understanding of how it came to be that the property has gone to date without obtaining the CofO. The original applicant, Pasquale Nathony DeFiore,borrowed money from Wisdom Capital in order to purchase the property and finance the construction. Within the years that the property was in Mr. Defiore's possession, he borrowed additional sums from Wisdom Capital and continued construction until a point where he was no longer able to secure loans. Since Mr. DeFiore was not able to repay his debt,Wisdom Capital has since taken possession,of the property and-the Deed.Since I have been retained by the new owner we've been working with the building department to remedy the open items on site,and plans were created to amend the permit to include the deck and stoop that was granted as part of decision#6870. As a result of this joint effort with the building department,the owners are removing all trellises and gates constructed along the street frontage,as well as removing the plumbing futures and maintaining unfinished/non-habitable storage at the upper level of the garage. The home itself will be maintained as a(5) bedroom structure,and any deficiencies or open items with the building department-have either been remedied or will be in the next few weeks. The Health Department final sign off is also imminent.: The owners are now in contract with new buyers and are working to close by the end of the summer,pending your approval to extend the ZBA hearing,Health Department Final, and Building Final.
