ing from the northwesterly line of the hereinabove described right of way north-
easterly to Mattituck Creek, the northwesterly line of which is more particularly;,
described as follows:
BEGINNING at a point on the southerly line of the land of John I.Pope, which point
of beginning is the following courses and distances from a monument set at the
intersection of the northeasterly line of Westphalia Road with the southeasterly line ,
of the land of John I. Pope:
(1) N. 390 42' E. 116. 34 feet;
(2) N. 460 45' E. 151. 15 feet;
(3) N. 450 58' 20" E. 62. 10 feet
and running thence from said point of beginning N. 450 58' 20" E. along the land of
John I. Pope 393 feet more or less to Mattituck Creek.
SUBJECT TO the following Covenants and Restrictions:
1. No building other than one private dwelling for the use and occupancy of one
family and one private garage shall be erected on said premises. Any dwelling
erected thereon shall not be less than 1200 square feet habitable area, excluding
garages, on ore level and not less than 840 square feet if a two-level home is
built with the second story having not less than 440 square feet. Garages shall
be attached or connected by a breezeway.
2. The premises shall not be used for the manufacture or sale of merchandise or
goods of any kind or for any trade or business whatsoever for the display of any
advertising or commercial signs.
3. No stables or outside toilets shall be erected on said premises and no nuisance
shall be created or allowed on said premises and no use shall be made thereof that
shall be dangerous to the health of or offensive to the senses of sight or smell of
the party of the first part, their heirs and assigns, as owners of the premises
adjoining the premises hereof and neighboring properties.
4. No fences of hedges over 4 foot in height shall be erected on any said premises
and said fences or hedges shall be maintained and kept in good appearance. However
in no event shall wire chain link fences be permitted, except to enclose a swimming
pool.
5. No fowl, poultry, animals or livestock shall be kept on said premises other than
domestic pets.
6. No trailers shall be kept, used or allowed on said premises. except when kept '
within an enclosed garage, except for a boat trailer.
7. The plans and specifications of each dwelling are subject to the approval of the
grantors, which approval shall not be unreasonably withheld.
8. No building may be built less than 75 feet from the private road.
These covenants and restrictions shall run with the land hereby conveyed and
shall bind and inure to the benefit of said parties thereto, their heirs, administra-
tors and assigns until 1/l/96 and said covenants and restrictions may be enforced in
by action for damages or injunctions or both until 1/1/96.
These covenants'and restrictions herein imposed shall apply solely to the premises
