A regular meeting of the'South01d Town Board of Appeals was held at 7:30
P.N. on Thursday, December 19, 1957, in the Town Clerkls O££ice, $outhold, N. Y.
There were present: Nr' R. W. Gillispie, ~r. - Chairman
Nr. Robert Bergen
Nr. Herbert Rosenberg
Mr. Ch~.rles Gregonis, Jr.
Absent: Mr. Serge Doyen, Jr.
Also Present: Mr. Howard N. Terry, Buildin~ Inspector.
PUBLIC ~r~,AEI~G: Appeal No. 39 -. Application of Juli~u and Bert~Ftedler
of $27 7th Street, Greenport, N. Y., for a variance to the Zoning Ordinance,
ARTICLE III, Sections 303, 306 and 308. Location of property: 1751 x 100~ on
Bes,ch and Bay Ro~uis, Greenport, N. Y. Variance requested in order to permit
~p~icants to move two sm~.ll bungalows to the property in question. ~r. & Mrs.
Ftedler bought the land in 1951 with the intention of erecting several sm~ll
stu~mer cottages.
Application for appeal, letter to aLoplicants advising them of date of Public
hearing and legal notices with affidavits from two local newsp~~pers were re~xl by
the Chairman:
Chairman: "Is there anyone present who wo,~Lld like to speak "for" this aopeal?
Mr. Fiedler: ,~e would like to place one bungalow on each corner of the lot
or would place them wherever you ~entlemen decided would be best. I would like to
s~y that most of the neighboring lots are 50 foot lots."
Chairman: "Is there 2~0.yone else who wishes to speak "for" this appeal.
Mr. J. A. ~,~ir of East ]Z~rion, 7. Y.: "As the owners of adjoiningproperty
we have no objection to the v~io~uce beln~ granted."

Chairm~.n: "Is there anyone prevent who would like to speak "against" this
Appeal?"
It was the decision of the Board that this ~ppeal be granted with the stipula-
tion that the jointly owned lots in question be transferred separately t0 Mr. & Mrs.
Fiedler and recorded, at which time the variance will be issued and the applicants
can proceed with plans to move the houses on to the property as located on map of
December 4, 1957, w!~ch accompanied the application.

303. Location of property: Irregular shaped lot 80/83! x 220/245~ on e~st side of
01d Jule Lane, Mattituck, N. Y. Variance requested On Lot No. 4 on m~p of O. W.
Va~Tuyl dated J=~ry 29,. 1951 (revised September 13, 1951).
Application for appeal, letter to applicatn advising of date of public hearing

~. Zanowski: "I bought the lots in 1950 and ~xi them surveyed in 1951. I
would like to h~ve the varL%uce on that lot in order to sell

~ppsal was un~mimously granted. It was the feeling of the Board that strict
application of the ordlnsnce would produce undue and unique D~rdship as lotm was
purchased before the enactment of the Zoning Ordinance for the purpose of resale
and has been held in single and separate ownership since that time. The variance
does observe the spirit of the Ordina~ce and would not ch~nge the character of the
district as all other lots in this immediate area are of similar or sm~ller size.
Minutes'of the December 12th Meetin~ were read. On motion made by
~. Gregonis, seconded by Mr. Bergen, and carried, Minutes were approved.
The next meetin~~ will be held at the s~e time and place on Janue~y 9, 1958.
Meeting adjourned at 9:15 P. M.
