A regular meeting of the Southold Town Board of Appeals was hel~ at 7:30 P. ~.
on Thursday, December 12th, in the Town Clerkls Office, Southold, N. Y.
There were 'presents

PUBLIC NEARING: Appeal No. 38 - Applic~,tion of L. Barr~u Hill, agent for Dr.
James F.DIWolf of Youngs Avenue Extension, Southold, ~. Y., for a variance to the
zoning ordinance, Article III, Section 307. Location of property: East Side of
private road, Youngs Avenue Extension, Southold, N. Y., on map of L. Barre~ Hill.
Application for appeal, letter to Dr. DtWolf advising him of date of public
hes,rlng and legal notices with affidavits from two local newspapers were read by the
C?~irman.
¢tmirman: "¥~. Terry is there anything you would like to s~y or any information
you might like to present regarding this a)pllcatton?"
Mr. Terry: "The first thing is tint they moved the garage from the old site
without a building permit. I notified the builders, Kwasneski and Powell, that this
was a violation and was told that it was being built at the owners command. Dr.
D~Wolf is the owner ~d L. Barren Hill is acting as agent. I disaoproved the aloplics.-
tion for permit to build on the grounds of insufficient side yar&s under Section 307
of Article III of the Zoning Ordinance."
Chairman: "Is there anyone present who wishes to speak "for" this appeal."
Dr. Betts: "Yes. Mr. Carstensen ~nd I came to represent the people of Hill's hill.
~e h~ve a group of houses on this little oeninsul~. The original g~rsEe which was on
the site prior to the adoption of the zoning ordinance was practically on the road,
about one or two feet from the road. Through moral persuasion we endeavored to have

Dr. DIWolf move the garage to the present site. We are pleading for him and hope that
this variance will be granted to him."
Chairman: "Is there ~nyone present who wishes to speak "against" this appeal?"
It was the unanimous decision of the Board to grant this appeal. It was the
determination of the Board that strict s. pplication of the Ordi~ance would produce
undue hardship because of insu£ficient room to locate gar~e ~nd breezeway otherwise
on this building lot, hardship created being unique because original garage, erected
before the enactment o£ the Ordinance, was erected in ~musuitable site and was moved
at the request of the ~urrounding neighbors. The variance does observe t~ spirit of
the Ordinance and wo~zld not change the character of the district because there are
other houses with attached garages ~nd breezeways in this development.
It was the decision of the Board to write the builders, Ewasneski ~nd Powell of
Southold, N.Y., advising them that in the future they obtain a building permit before
they proceed with any building or alterations to existing buildings.
Minutes of the November 14th meeting were read. On motion made by Mr. Rosenberg,
seconded by Mr. Bergen, ~nd carried, Minutes were approved.
The next meeting of the Board will be held on Thursday evening, December 19th,
at ?: 30 P. M. in Southold, N. Y.
Meeting adjourned at 9:50 P.M.
