Warranty Deed
THIS INDENTURE, made the Z day of January, nineteen hundred and ninety-four

and
PATRICIA A. HAMILTON-JONES, residing at 26 Springdale Avenue, Massapequa, New
York 11758 and
RICHARD B.BACKOFEN, residing at228 Collins Avenue,Williston Park,New York 11596
party of the first part, and
RICHARD B.BACKOFEN,,residing at228 Collins Avenue,Williston Park,New York 11596
party of the second part,
Witnesseth, that the party of the first part, in consideration of Ten Dollars and other
valuable consideration paid by the party of the second part, does hereby grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the
second parr forever,
All that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being on Indian Neck near Peconic, Town of Southold, County
of Suffolk and State of New York, known as Lot Number 19 on certain map entitled 'Map
of Indian Neck Park, George W. Smith, owner, office of the Clerk of the County of Suffolk
on the 27th day of May, 1913, as and by the map No. 551; which said lot is bounded with
reference to said map as follows: Northerly by Lot Number Seventeen (17); Easterly by a
Private Road laid down on said Map One Hundred (100) feet; Southerly by Lot Number
Twenty-one (21) and Westerly by land of Phillip H. Horton.
TOGETHER with a right of way from the easterly side of said premises over the two rod
road laid down on said map and designated as "Private Road' to and from Little Peconic
Bay. TOGETHER with whatever rights the parties of the first part herein have in and to the
said Private Road and in and to the Beach adjoining Little Peconic Bay between said
Private Road on the East and the land of the heirs of Samuel Davids, deceased, on the
West. Including the privileges and rights to use the beach formerly owned by George W.
Smith and Rose M. Smith, his wife which rights and privileges were given to Paul L.
Chapman and Mabel A. Chapman, his wife by deed dated January 26, 1924 recorded in
the Suffolk County Clerk's Office on February 5, 1924 at Liber 1091 of Deeds, Page 456.
SAID premises being know as 930 Smith Road, Peconic, New York 11958 and designated
on the official Tax Map of the Town of Southold by Tax Map No. 473889 98. -3 -29.
BEING the same premises the parties of the first part acquired on April 25, 1981 as

distributees of the estate of Ruth L. Backofen which premises had previously been
conveyed to Ruth L. Backofen by Sterling R. Chapman, Paul L. Chapman and Ruth L.
Backofen by deed dated August 13, 1971 and recorded in the Suffolk County Clerk's Office
on September 27, 1971 in Liber 7013 of Deeds, Page 540.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof;
TOGETHER; with the appurtenances and all the estate and rights of the party of the first
part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto
the party of the second part,the heirs or successors and assigns of the party of the second
part forever.
AND the party of the first part covenants that the party of the first part is seized of the
described property in fee simple, and has good right to convey such property, the party of
the second part shall quietly enjoy the described property, the described property is free
from encumbrances, and the party of the first part will execute or procure any further
necessary assurance of the title to the described property.
AND the party of the first part, in compliance with Section 13 of the Lien Law,
covenantsthat the party of the first part will receive the consideration for this conveyance
and will hold the right to receive such consideration as a trust fund to be applied first for the
purpose of paying the cost of the improvement and will apply the same first to the payment
of the cost of the improvement before using any part of the total of the same for any other
purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this
indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day
and year first above written.
