SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated June 2, 2015, stating that this application is considered a matter for local determination as there appears to be no significant county -wide or inter -community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated June 18, 2015, determining that the proposed project was INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP, solely because of the fact that the FEMA flood zone boundaries were not shown on the survey that the applicant provided to the LWRP Coordinator. However, based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as other records available to us, most importantly an updated survey delineating the flood zone line that shows that the applicant's entire proposed construction is outside of the flood zone, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The applicant's property is a non -conforming 19,250 sq. ft. waterfront parcel in the R-40 Zone. The northerly lot line measures 110 feet along a bulkhead on a saltwater canal. The easterly lot line measures 175 feet along an adjacent residential parcel, the southerly line measures 110. feet along Albacore Drive, and the westerly line measures 175 feet along another parcel. The property is improved with a single-family dwelling, as is shown, with proposed new deck and swimming pool, on the survey drawn by John T. Metzger, Licensed Surveyor, dated January 21, 2015, updated on June 24, 2015 showing the FEMA flood zone line. y - BASIS OF APPLICATION: Request for Variance from Article XXII Section 280-116B and the Building Inspector's April 23, 2015 Notice of Disapproval based on an application for building permit for additions/alterations to existing single family dwelling (deck and in -ground swimming pool) at; 1) less than the code required bulkhead setback of 75 feet. Page 2 of 3 — July 16, 2015 ZBA#6864 — Cole SCTM# 1000-57-1-17 RELIEF REQUESTED: The applicant requests a variance in order to construct a new deck and swimming pool with a bulkhead setback of 50 feet, where 75 feet is required by Code. ADDITIONAL INFORMATION: The applicant provided information that the neighborhood contains numerous properties that have been granted variances for bulkhead setbacks and other types of area variances. FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 2, 2015, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Numerous properties in the neighborhood have been granted variances for similar bulkhead setbacks. A swimming pool and deck are customary accessories in residential zones. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing dwelling is setback 74.8 feet from the bulkhead so any additions to the rear of the dwelling would require variance relief. The site selected for the pool and deck is the only practical area on the property suitable for this construction. The code conforming front yard area, where the applicant could conceivably located a pool on this waterfront property, is encumbered by a circular driveway, and also the location of the septic system. 3. Town Law &267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 33% relief from the code. However, all of the proposed construction is landward of the FEMA flood zone line, there is no other location on the property suitable for such construction, and numerous properties in the neighborhood have been granted similar bulkhead setbacks. 4. Town Law X267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and will install a dlywell for the purpose of emptying water from the pool whenever it becomes necessary. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law $267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an in -ground swimming pool and a new deck, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Horning, seconded by Member Weisman (Chairperson), and duly carried, to GRANT, the variance as applied for, and shown on the survey drawn by on the survey drawn by John T. Metzger, Licensed Surveyor, dated January 21, 2015, updated on June 24, 2015 showing the FEMA flood zone line. CONDITIONS: 1. Pool mechanicals shall be placed ina sound deadening enclosure. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, dre not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk, within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. Name of Owner: Nancy & Denis Cole ZBA File # REASONS FOR APPEAL (additional sheets may be used with prenarer's sienature): AREA VARIANCE REASONS: (1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: The Cole property is Lot number 30 in the Subdivision of Southold Shores filed in the Suffolk County Clerk on August 29, 1963. The original house was constructed (started in 1986) still under construction in 1989 (see attached Jaeger survey Exhibit A—) and received a c.o. in 1991 (attached exhibit B—). The house is located at approximately 75 feet from the bulkhead. The under construction survey shows a patio, but the patio was replaced with a wood deck by the prior owners. That deck is being replaced with the proposed raised stone patio and swimming pool. The numerous properties on Albacore Drive and Blue Marlin Drive have obtained setback variances from the Bulkhead for additions, decks, hot tubs and swimming pools. In one of the many appeals, appeal # 4365 in 1996 for Joseph A. Pottgen the Board listed the neighboring setbacks on Blue Marlin Drive, and noted that while the variance relief requested was considered substantial, nevertheless, the board found that the setback request was similar to those setbacks generally existing in the neighborhood. (Attached Exhibit C—jThe neighborhood remains developed by homes with decks and accessory structures which are less then 75 to the bulkhead. The setback of 50 feet from the bulkhead includes a 5' raised walkway along the northerly and southerly side of the swimming pool giving access around the swimming pool. The swimming pool is only 16' in width. A very strong effort was made to limit the size of the swimming pool with the minimum safe walkway around the pool to conform to the existing character and development of the community at 50' from the bulkhead. The plans of the pool and decking were redesigned several times, prior to making the application, in order to conform to the 20% lot coverage and to maximize the setback. The swimming pool is proposed at 55' from the bulkhead with only a 5 foot walkway around the northerly side of the pool. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: REUtiftU MAY 2 0 205 BOAR® OF APPEAL The property slopes gradually towards the water, the house is elevated, so the proposed stone patio and pool will be raised above the grade approximately 3'11 "for a level area. The walkways around the proposed pool are the minimum which provide a safe and comfortable area around the pool for the applicant and his family. Castillo landscaping has provided the proposed plans for the project (attached as exhibit Di (3) The amount of relief requested is not substantial because: The house is at 75' from the bulkhead, therefore any improvements on the waterfront side of the house will require a variance. The applicant has requested the minimal variance feasible. WHEREAS, a public hearing was held on March 6, 1996, at which time all persons who desired to be heard were heard and their testimony recorded; WHEREAS, the Board has carefully considered all testimony and documentation submitted concerning this application; WHEREAS, Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following findings of fact: 1. By this application, appellants seek a variance under Article XXIII , Section 100-239.411 of the Zoning Code for the location of an open deck addition in a rear yard area, proposed at between 50 and 52 feet from the existing bulkhead, all as shown on a copy of a map, as sketched to show the proposed setback. The original survey was prepared by Hawkins and Webb, Surveyors, dated May 1966. 2. The premises in question is identified on the Suffolk County Tax Maps as District 1000, Section 57, Block 1, Lot 27, and is known and referred to as Lot No. 6 on the Map of Southold Shores. 3. This parcel contains a total lot area of approxinately one-half acre, and is improve3d with a one-story frame dwelling built by a. previous owner in about 1968. 4. For the record, Section 100-239.4B of the. Zoning Code was initially adopted under "Local Law #4-1985 Section 100-119.2B" pertaining to building setbacks from water bodies, and readded on May 17, 1988, (after removal (printer's error) during an amendment for about six weeks) under Local Law #15-1988. Article XXIII, Section 100-239.4B (re -numbered from 100-119.2B on January 10, 1989 under the Master Plan revisions) continues to require that all buildings and structures located on lots upon which a bulkhead, concrete wall, rip -rap or similar structure exists and which are adjacent to tidal water bodies other than the Long Island Sound, to be set back not less than seventy-five (75 ) feet. The exception to this requirement is shown to be when new construction is located landward of existing building(s) on the lot. 6. In viewing the history of permits and existing buildings in this waterfront community, the following information was found (preexisting of the subject code provision unless otherwise noted below) : a) CTM Lot 429 ( Kelly) 53' setback (1992 variance issued) ; b) CTM Lot #30 (Mesbah) - (no variance needed per building permit issued in 1988) ; c) CTM Lot #33 (Burke/Weitman) deck at 50+- feet (no variance needed); d) CTM Lot #34 (Pacifico) - setback 48+- feet (no variance found for bulkhead setback; building permits found of record issued under code at that time) ; e) Lot #34 - 50+- ft. to outside edge of bulkhead. 7. The Board of Southold Town Trustees has issued a Waiver tinder the Wetlands Regulations of the Southold Town Code at its September. 28, 1995 meeting for a 1,000 square ft. deck. 8. It is the position of this Board in considering this application: (a) the relief requested for a setback at 50, 51 or 52 feet is not the minimum necessary to afford relief, and the alternative is more reasonable under the circumstances of the area; (b) the setback granted is substantial at 22 feet less than the requirement, or 29%; however, this setback is similar to those generally existing in the neighborhood, as noted above; (c the variance requested is not self-created; (d) the relief, as alternatively granted, will not create a substantial change in the character of the neighborhood along this bulkhead and waterway, and although there will be a minor visual effect, there will not be an adverse detriment created in the neighborhood or district for the type of construction (restricted herein for an open deck) ; Page 3 - Appl . Accordingly, on motion by Member Villa, seconded by Member Dinizio, it was RESOLVED, to DENY the relief requested, and to GRANT ALTERNATIVE RELIEF for a setback at not less than 53 feet from the closest point between the proposed deck at the rear of the dwelling and the bulkhead.
