BEGINNING at a point on the westerly line of Deep Hole Drive dis-
tant 202.71 feet southerly from the corner formed by the intersection
of the southerly side of Theresa Drive and the westerly side of Deep
Hole Drive, said point of beginning being the southeasterly corner of
Lot l as shown on "Map of Deep Hole Creek Estates" filed in the Suffolk
County Clerk's Office as Map #4256 and from said point of beginning
running thence southerly, southwesterly and westerly along the westerly
northwesterly and northerly side of Deep Hole Drive the following
�. courses and distances: (1) S. 160 02' 20" W. 69.03 feet; (2) Southwest-
erly along the arc of.a circle bearing to the right having a radius of
97.85 feet, -a distance of 137.68 'feet; (3) N. 830 20' 40" W. 62 .00 feet
to land now or formerly of Robert E. Hiltz; running thence along the
last mentioned land N. 06° 39 ' 20 East 150 feet to the southerly line
of Lot 2 as shown on aforesaid-map; running thence along the southerly
line of said Lots l and 2 on the aforesaid map S. 831 20' 40" E. 169. 80
feet to the westerly side of Deep Hole Drive at the point or place of
BEGINNING.
BEING AND INTENDEDTOBE the same premises conveyed to the party of the
first part by deed dated July 8, 1974 and recorded in the Suffolk Count
Clerk's Office on July 10, 1974 in Liber 7671, page 546.
This conveyance is subject to a certain mortgage executed by the partie
of the first part as mortgagors, to Valley Bank-of New York, which' mort
gage is dated July 8, 1974 ,and recorded in Suffolk County Clerk's Offic
on July 10,. 1974 in Liber 7114, page 342; and on which mortgage there i
now due the sum of $27,000.00.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof;TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF,the party of the first part has duly executed this deed the day and year first above
written.
