County of. Suffolk, State of"New York, bounded anddescribed
as follows: On the North by the center of Mattituck Pond,
on the East by land of Charles W. Wickham, on the South by
�r Peconic Bay, on the West by lands of George B. Reeve and J.
Wood Wickham, containing forty-five and one half acres, more
!�y or less, with the houses and improvements thereon, subject to
the reservation to the heirs or assigns of Irad Reeve, of a
way through gates and bars, as contained in a deed given by
Irad Reeve to George L. Conklin, Jr. , and subject also to a

public highway called Suffolk Avenue across the above described
premises.
Being also the same premises conveyed to Frank M.
Lupton by deed recorded in the office of the Clerk of the. .
County of Suffolk, in Liber 463, of Deeds, page 370 on the
\ 17th day of January, 1898 and devised to the party of the first
part hereto by and under the last Will and Testament of said
Frank M. Lupton, which was admitted to probate by the Sur-
rogate' s Court for the County of Kings, State of New York on
the 3rd day of November, 1910.

All that parcel of land now or formerly(under the
waters of Great Peconic Bay)i.n the Town of Southold, County
of Suffolk and State of New York, bounded and described as
follows:
BEGINNING at the point of intersection of the high
water line of Great Peconic Bay with the,boundary line between
the property of J. Wickham Reeve and the property of James
Norris, said point being south twenty-one degrees, fifty-four
minutes east, fifty-five and five-tenths feet from a granite
monument in said boundary line; thence along said high water
" line north seventy-one degrees, fourteen minutes east, five
s� hundred sixty-three and eight one-hundredths feet to an inter-
section with the boundary line between the property of Charles
W. Wickham and the property of James Norris; thence into the
waters of Great Peconic Bay south seventeen degrees east, ` fifty
feet; thence south seventy-one degrees, fourteen minutes west,
five hundred forty-three and eight one-hundredths feet; thence
south seventeen degrees east, two hundred and sixty-one one-
hundredths feet; thence south seventy-three degrees west,
twenty feet; thence north seventeen degrees west, two hundred
fifty feet to the point of beginning; containing thirty-two
thousand one hundred forth-seven square feet, more or less.
All bearings are referred to the true meridian.
These letters-patent are issued, however, and this
grant is made accepted:
FIRST: Upon the express condition that if at the
end of five years from the date of these presents or at any
time thereafter, any part of said lands hereby granted are
not improved as follows:
