Southold, NY Telephone: 631 765-1938 Fax: 631765-3136 Planning.Board staff has reviewed the revised yield plan dated July 13, 2007; last revised March 31, 2009 and submitted to the Office of the Planning Board on April 24, 2009 and has. determined that information presented on the plan still -remains incorrect as it does not accurately account for the wetland area as determined by Planning.. Board staff in .the calculations. However, even with adjusted calculations, the proposed yield of two lots cannot be achieved pursuant to: 1. Sufficient upland area to meet yield requirements pursuant -to § 240-10 Technical requirements, B. Yield plan (in part, below) has not been demonstrated: (2) Standard subdivision. A -yield plan shall be prepared for a standard subdivision in accordance with the requirements of this section and shall include a requirement to provide .affordable housing. (a) Density. The permitted number of dwelling units shall not exceed the number of units that, in the Planning Boar'd's judgment, would be permitted if the land were subdivided into lots conforming to the minimum lot size and density requirements of this. chapter applicable to the zoning district (or districts) in which such land is situated and conforming to all other requirements of the Town Code. (b) Total lot yield shall be determined on buildable lands only. Subdivision design shall exclude the following features, unless the applicant shall have obtained a permit from all relevant regulating authorities approving the applicant's right to place residential structures in the subject areas: [1] All underwater lands. [2] Tidal wetlands or freshwater wetlands, as -defined in state and local regulations. [101 -Areas which the Planning Board shall determine to be of such character that they cannot be used safely for building purposes without danger to health or peril from fire, flood, drainage or -other menace to neighboring properties or the public health, safety and welfare. 2. The yield map does .t, ;onform. to the requirements of § 275-3 idings; purpose; jurisdiction; setbacks, D, (1), (a), [2] of the Southold Town Code (in part, below) that requires a minimum driveway setback of 50"to a wetland. D. Setbacks. [Amended 10-11-2005 by L.L. No. 17-2005] (1) The following minimum setbacks apply to any. and. all operations proposed on residential property within the jurisdiction of the Board of Trustees: (a) Wetland boundary. [2] Driveway: 50 feet. 3.. On May .19, 2009 the Board of Trustees responded to the Planning Board's request to verify the extent.of Chapter 275,. Wetlands and Shorelines jurisdictional areas on -'site (attached). The Board of. Trustees found that; "The location of the proposed dwelling, sanitary system and driveway do not meet the minimum required setbacks pursuant 'to Chapter 275 Wetlands and Shorelines, of the Southold Town Code." the.Board further states that "Waiving or altering -these setbacks would not be justified given the sensitivity of the'environmental conditions that exist on this site." The Board of Trustees concluded that there is "no reasonable access to the dredge spoil area where the dwelling and sanitary system are being proposed". Dear Mr. Nicolazzi, -, On September 14, 2007 The Planning Board returned your application for a Re- subdivision of SCTM# 78.-7-8 and 78.-7-9 due to the inability of the proposal to comply with the Southold Town Code. On January 29, 2009 an amended plat was submitted for review. At the March 24, 2009 work session the. Planning - Board reviewed the amended plat, and, based -upon the information -submitted, the Planning Board supports the prior decision to not accept the application. The. decision was reached based on the following reasons: ` The amended plat dated July 7, 2007, last revised January 1; 2009, and received on January. 29, 2009 does not comply with § 240-10 Technical requirements, item B. Yield Plan 2(a) of the Southold Town Code which defines density as: Density. The permitted number of dwelling units shall not exceed the number of units that, in the Planning Board's judgment, would be permitted 'if the land were subdivided into lots conforming to the minimum lot size and densi . requirements of this chapter applicable to the zoning district (or districts) in which such land is situated and conforming to all other requirements of the Town Code. The amended plat. indicates that the proposed Lot 1 contains 39,568 sq. ft of buildable lands. Pursuant to § 240-10 Technical requirements of the Southold Town Code, it is required that a proposed lot meets the minimum lot area for the_ zoning district. The parcel is zoned R740, therefore, the required minimum lot area is 40,000 square feet of buildable land. Proposed Lot 1 does not conform to the zoning district. Further, site inspection 'revealed that the dredge, spoil island is separated by a jurisdictional wetland and required setbacks and therefore access to the proposed Lot 1 is not possible pursuant to the requirements of Southold Town Code. Note that a driveway is required to be at least 50' from wetlands. Lastly, as discussed, the amended plat submitted on January 12, 2009 does not accurately depict the wetland delineation .(flags) performed by. Town representatives. As discussed,. a joint meeting with all wetland jurisdictional agencies will be arranged by staff to attempt to resolve the disagreement. C-25 to 53 inches, light -gray (2.5Y 7/2) sand; single grain; loose; strongly acid. The thickness of the solum ranges from 18 to 30 inches. Texture ranges from sand to loamy sand in the solum. In the finer textured part, the solum thickness corresponds with the upper boundary of the underlying coarse sand or stratified sand and gravel. Volume of. coarse fragments in the solum is normally less than 5 percent. It ranges from 5 to 35 percent in the substratum. Reaction is very strongly acid to strongly acid throughout. The O horizons range from dark reddish brown (5YR 2/2) to black (10YR 2/1). A thin, black (10YR 2/1) Al horizon is present in some profiles. It is dotted with many, clean, white sand grains. The A2 horizon ranges from gray (10YR 5/1) to pinkish gray (5YR 7/2). Where present, the Ap horizon ranges from very dark brown (10YR-2/2) to very dark grayish brown (10YR 3/2): It ranges from 8 to 10 inches in thickness. The B21 horizon ranges from dark reddish brown (5YR 3/3) to strong brown (7.5YR 5/6). There is no mottling in the B21 horizon. Consistence of this horizon is friable, but a few firm lumps are in places. It is massive or single grain. The B22 and B23 horizons are light olive brown (2.5Y 5/4) or brownish yellow (10YR 6/6). These horizons may have a few mottles that have chromas greater than 2. They are sin- .. gle grain or massive. The C horizon ranges from olive gray (5Y 5/2) to very .:pale brown (10YR 7/4). Generally this soil has been left in woodland with adjoining areas of wetter soils; however, many areas in the southwestern part of the -county have been filled and are used as sites for housing develop- ments. Dune Land Dune land (Du) is made up of mounds or small hills of sand that have been piled up by wind. No soil horizons have formed in this sandy material. This land type is mainly along the barrier beach and the large area of dunes in the vicinity of Napeague and Hither Hills State Park. Smaller areas are along Long Island Sound and the bays at the east end of the Sound. Slope ranges from 1 to 35 percent. Vegetation is sparse in some areas, but other areas have a thick cover of pine. Included with this land type in mapping are low- lying, nearly level areas between dunes where ground water is at a depth of 18 to 30 inches in places. Also included are a few small, blown -out areas along the north shore. In these places sand dunes have migrated into the woodland surrounding the blowout. Duneland is suitable only for use as wildlife habitat or recreation. It should be stabilized and left undis- turbed to provide protection from storms and high tides. Structures on sand dunes are subject to damage from coastal storms. Capability unit VIIIs-1; woodland suit- ability group not assigned. Escarpments field sand (De).—This is the only Deerfield soil i, in the county.
