• § 25-10. Title.
This chapter shall be known and may be cited as the
"Agricultural Lands Preservation Law of the Town of Southold."

§ 25-20 SOUTHOLD CODE § 25-30
§ 25-20. Purpose.
The Town Board of the Town of Southold finds that the
acquisition of development rights in lends located in.the Town of
Southold and used in bona fide agricultural production will
conserve, protect and encourage the: improvement of prime
agricultural lands, both for the production of food and the
preservation of open space, and is in the public interest and a
proper public purpose of the town in accordance with the findings
and determinations of the New York State Legislature, as set
forth in § 247 of the General Municipal Law.
§§ 25-21 through 25-29. (Reserved)
§ 25-30. Definitions.
As used in this chapter, the terms used herein are defined as
follows:
AGRICULTURAL LANDS — Lands used in bona fide
agricultural production.
AGRICULTURAL PRODUCTION — The production for
commercial purposes of crops, livestock and livestock
products, but not land or portions thereof used for
processing or retail merchandising of such crops, livestock
or livestock products. Land 'used. in "agricultural
production" shall also include fences, equipment storage
buildings, livestock barns,. irrigation systems and any
other structures used exclusively for agricultural purposes.
ALIENATION — The transfer of any development right
from the Town of Southold to another.
COMMITTEE — The Southold Town Farmland Com-
mittee. •
DEVELOPMENT RIGHT — The permanent legal in-
terest or right to prohibit or restrict the use of land for any
purpose other than agricultural production.
STRUCTURE — Anything constructed or erected in, on or
under the ground or attached to anything having a
location, on or under the ground, including fences.

§ 25-40. Acquisition of development rights.
A. Upon authorization by the Town Board, the Supervisor
shall solicit offers for the sale to the town of development
• rights in such agricultural lends as may be recommended
by the Committee.
B. Upon the receipt of such offer or offers, the Town Board
shall cause an appraisal or appraisals to be made of the
market value of the development rights being offered.
C. After ' receipt of such appraisal or appraisals, the Town
Board shall hold a public hearing on the question of the
acceptance of such. offer or offers.
D. Within sixty (60) days after such hearing, the Town Board
shall adopt a resolution either accepting or rejecting such
offer or offers.
§§ 25-41 through 25-49. (Reserved)
§ 25-50. Alienation of development rights.
A. Development rights acquired by the town pursuant to the
provisions of this chapter shall not thereafter be alienated,
except upon the affirmative vote of a majority of the Town
Board after a public hearing thereon and upon the approval
by the electors. of the town voting . on. a proposition sub-
mitted at a special or biennial town election. No sub-
sequent amendment of the provisions of this subsection
• shall alter the limitations imposed upon the alienation of
develoment rights acquired by the town prior to any such
amendment.
B. The instrument of conveyance transferring the develop-
ment rights to the Town of Southold shall be executed by
the Supervisor on behalf of the Town of Southold and the
grantors and shall contain a covenant specifically setting

forth the limitations on the alienation of the development
rights and the limitations on the use and enjoyment of the
estate or interest reserved by the grantor as the same are
set forth as of the date of the contract for the sale of said
development rights.
C. Farmland Committee.
(1) The Committee shall consist of five (5) members to be •
appointed by and serve at the pleasure of the Town
Board. The Chairman of the Committee shall be
designated by the Town Board.
(2) Duties of the Committee.
(a) The Committee shall perform the following
duties:
[1] To recommend to the Town Board
agricultural lands in which the development
rights should be -acquired by the town.
[2] To review all matters relevant to develop-
ment rights and .the agricultural economy in
general.
[3] To serve as a review board for the granting of
permits . for- the construction, reconstruction
and additions of and to structures in or on
agricultural lands in- which the development
rights .have been acquired by the town.
[4] To promulgate such rules and regulations as
may be deemed necessary to govern the
administration, procedures and duties of the
Committee, which rules and regulations shall
not become effective until approved by the .
Town Board.
[5] To prepare, amend and maintain appropriate
maps delineating agricultural lands, lands in
which development rights . have been
acquired, agricultural lands in which
development rights are proposed to be
acquired and such other information, as may
be deemed appropriate.

[6] To perform such other duties and functions
as may, from time to time, be directed by the
Town Board.
(b) The Committee shall be authorized to incur such
expenses in the performance of its duties as shall
be appropriated therefor by the Town Board.

§ 25-60. Severability.
Should any provision of this chapter beiadjudged invalid by a
court of competent jurisdiction, such adjudication shall not affect
the validity of any other provision of this chapter.

§ 26-1. Purpose.

tickets.
§ 26-3. Service of appearance ticket.

§ 26-1. Purpose.
The purpose of this chapter is to authorize public -servants of
the Town. of Southold to issue and serve appearance tickets in
connection with violations of state statutes, local laws, ordinances
or rules and regulations of the Town of Southold which the public
servants are authorized or required to enforce.
§ 26-2. Certain public servants authorized to issue appearance
tickets.
The following public servants of the Town of Southold are
hereby authorized to issue and serve an appearance ticket with
respect to the violation of a state statute, local law, ordinance, rule
or regulation of the Town of Southold 'that such public servants
• are, respectively, required to enforce:
A. Constables and Bay Constables. Any statute, local law,
ordinance, rule or regulation involving the public health, .
safety and welfare.
B. Dog control officers. Any statute, local law, ordinance, rule
or regulation involving the control of dogs.

C. Building Inspectors. Any statute, local law, ordinance, rule
or regulation relating to fire prevention and safety, health
and sanitation, buildings, zoning and planning. [Added 2-

§ 26-3. Service of appearance ticket.
An appearance ticket other than for a parking violation shall be
served personally.

C. No person shall ride on water skis, a surfboard or similar
device, or use or operate a boat to tow a person thereon,
within one hundred fifty (150) feet of any public or semi-
public bathing beach or public dock or within fifty (50) feet
of any swimmer or bather; nor shall any such persons
engaged in such activities come within three hundred (300)
feet of the shoreline unless they approach or depart per-
pendicularly to or from the shoreline solely for the purpose
of commencing or ending the ride.
§ 32-36. Speed limits; manner of operation.
A. The Town Board of the Town of Southold may, by
resolution, limit the speed of boats in any waters to which
this Article applies and shall cause notice of such speed
limit to be posted at appropriate places in the areas af-
fected. Any person who shall operate a boat in such areas
at a greater speed than the speed specified in such notice
shall be deemed to have violated this Article.
B. Every person operating a boat shall at all times operate the
same in a careful and prudent manner and at such a rate of
speed as not to unreasonably interfere with the free and
proper use of the waters or unreasonably endanger any
person or property.
§ 32-37. Internal-combustion engines; mufflers.
A. No boat propelled by an internal-combustion engine shall
be operated on any inland fresh waters in the Town of
Southold except in emergency or rescue operations or by
peace officers in the performance of their duties. [Added 8-

B. No, person shall operate a boat propelled wholly or partly
by an engine operated by the explosion of gas, gasoline,
naphtha or other substance without having the exhaust
from the engine run through, a muffling device so con-
structed and used as to muffle the noise of the exhaust in a
reasonable manner.

§ 32-38. Aquatic events.
Nothing herein contained shall prohibit the Town Board of the
Town of Southold from issuing special permits for aquatic events,
boat races or other such events under proper supervision in
limited areas for limited periods.
§ 32-39.' Mooring and anchoring. [Added 5-10-83 by L.L. No. 5-
19831
No boat shall be so moored or anchored that it at any time rests
within any channel or interferes with the full use of such channel,
nor shall any boat be moored or anchored within fifty- (50) feet of
any dock, pier or other boat docking facilities.
§ 32-39.1. Anchoring in Mattituck Creek. [Added 5-10-83 by L.L.
No. 5-1983]
All boats owned by nonresidents of the Town of Southold
temporarily anchoring in Mattituck Creek shall anchor only in the
federal anchorage area located near the head of said creek. The
Town Board of Trustees shall cause said anchorage area to be
suitably designated by appropriate buoys or markers and shall
also cause suitable signs to be placed at appropriate locations in
said creek to direct boaters to such anchorage area.
§ 32-39.2. Anchoring and mooring in West Harbor. [Added 5-10-
83 by L.L. No. 5-1983; 3-27-84 by L.L. No. 3-1984']
A. All boats temporarily anchored in West Harbor at Fishers
Island shall anchor north of Goose_ Island.
B. Permanent moorings in West Harbor at Fishers Island.
(1) All permanent moorings shall be located south of
Buoy No. 8.

(2) No permanent mooring shall be placed unless
authorized by a permit duly issued by a• Bay Constable
or Deputy or Assistant Bay Constable.
(3) The following fees shall be paid for the issuance of a
mooring permit:

(4) All mooring permits shall expire on December 31 of
the year of issuance.
(5) The location of each mooring sh& -- assigned by the
Fishers Island Harbor Master, who shall be appointed
by the Town Board.
(6) All -mooring buoys shall be assigned a number which.
shall be . affixed to the buoy by the permittee in
numbers at. least five (5) inches in height.
ARTICLE IV
Administration and Enforcement

§ 32-40.. Enforcing officer.
It shall be the duty of the Bay Constable and his deputies and
• assistants. to administer and enforce the provisions of this
chapter.
§ 32-41. Notice of violation.
A. Whenever the Bay Constable has reasonable grounds to
believe that operations regulated hereby are being con -

ducted in violation of the provisions of this chapter or not
in compliance with a permit issued pursuant to this
chapter, he may notify the owner of the property or the
owner's agent or the person performing such operations to
suspend all operations, and any such person shall forthwith
cease operations until such notice of violation has been
rescinded.
B. Such notice shall be in writing, shall specify the violation •
and shall state the conditions which must be complied with
and the time within which compliance must be completed
before operations may be resumed. Such notice shall also
inform the person to whom it is directed of his right to
apply for a hearing before the Board of Trustees of the
Town Southold, as hereinafter provided.
C. Such notice shall be served upon the person to whom it is
directed by delivering it to him personally or by posting
the same in a conspicuous place on the premises where
operations are being conducted and mailing a copy thereof
to such person by certified mail to his last known address.

Residential and Agricultural District according to the procedure
and requirements hereinafter set forth, without the requirement
that the owner make written application for 'the use of such
procedure.
A. [Amended 4-24-84 by L.L.- No.. 4-1984] The maximum
number of single-family lots that may be approved in a
cluster development shall be computed by subtracting
• from the total gross area a fixed percentage of twenty
percent (20%) of said area and dividing the remaining
eighty percent (80%) of the area by the minimum required
lot area set forth in the Bulk and Parking Schedule.'
(1) In computing the maximum number of lots that may
be created, any lands which are subject to flooding or
which are occupied by public utility easements in such
a manner as to prevent their use and development
shall not be considered part of the total gross area.
(2) In a cluster development, lot area shall not be reduced
by more than fifty percent (50%), and lot width and
depth, front yard, rear yard and side yards shall not be
reduced by more than thirty percent (30%) of the
minimum requirements set forth in the Bulk and
Parking Schedule.'
B. The area of a cluster development shall be in single
:ownership or under unified control.
C. Prior to the issuance of. a building . permit in a cluster
development, a site plan shall be. submitted :to ,and ap-
proved by the Planning Board in. accordance with Article
XIII of this chapter. and the following conditions:
(1) Said site plan .shall include areas within which
structures may be located, the height and spacing of
• buildings, open spaces and their landscaping, off-
street open and enclosed (if any) parking .spaces and
streets, driveways and any other physical features
relevant to the proposed plan.

(2) Said site: plan shall .include a statement setting forth
the nature of all proposed modifications of existing
zoning provisions.
D. Nothing contained in this chapter shall relieve the owner or
his agent or the developer of a proposed cluster develop-
ment from receiving final plat approval in accordance with
the Town Subdivision Regulations.' In approving the final •
plat for a cluster development, the Planning Board may
modify the acreage requirement for recreation areas as set
forth in the town's rules governing subdivision review,
provided that the common land dedicated meets all other
requirements of the Town Subdivision Regulations.
E. A cluster development shall be organized as one (1) _of the
following: a Homes Association approved by the Federal
Housing Administration for mortgage insurance as a
planned unit development and by the Town Board; a
Homes Association approved by the Town Attorney and
Town Board; or any other arrangements approved by the
Town Attorney and, Tow n Board as satisfying the intent of
this chapter. Whenever a Homes Association is proposed,
the Town Board shall retain the right to review and ap-
prove the articles of incorporation and charter of said
Homes Association and to require whatever conditions
deemed necessary to ensure that the intent and purpose of
this chapter are carried out. In consideration of said ap-
proval, the Town Board shall, in part, require the cluster
development to meet the following conditions:
(1) The Homes Association shall be established as an
incorporated nonprofit organization operating under
recorded land agreements through which each lot
owner and any succeeding owner is automatically a
member and each lot is automatically subject to a •
charge for a proportionate share of the expenses for
the organization's activities.
(2) Title to all common property shall be placed in the
Homes Association, or definite and acceptable
assurance shall be given that it automatically will be
so placed within a reasonable period of time.

same and the building conform to the provisions of this
chapter. [Amended 2-1-83 by L.L. No. 2-19831
H. A record of all certificates of occupancy shall be kept in the '
office of the Building -Inspector, and copies shall be fur-
nished on request to any agency of the town or to any
persons having an interest in the building or land affected.
§ 100-145. Penalties for offenses. [Amended 7-31-73; 4-24-84 by
___L.L. No. 5-1984'1
For each offense against any of the provisions of this chapter or
any regulations made pursuant thereto or for failure to comply
with a written notice or order of any Building Inspector within the
time fixed for compliance therewith, the owner, occupant, builder,
architect, contractor or their agents or any other person who
commits, takes part or assists in the commission of any such
offense or who shall fail to comply with a written order or notice of
any Building Inspector shall, upon a first conviction thereof; be
guilty of a violation punishable by a fine of not exceeding five
hundred dollars ($500.) or by imprisonment for a period not to
exceed fifteen (15) days, or both. Each day on which such
violation shall occur shall constitute a separate, additional of-
fense. For a second and subsequent conviction within eighteen
(18) months thereafter, such person shall be guilty of a violation
punishable by a fine not exceeding one thousand five hundred
dollars ($1,500.) or by imprisonment for a period not to exceed
fifteen (15) days, or by both such fine and imprisonment.
§ 100-146. Remedies.
In case any building or structure is erected, constructed,
• reconstructed, altered, repaired, converted or maintained, or any
building, structure or land is used, in violation of this chapter or of
any regulations made pursuant thereto, in addition to other
remedies provided by law, any appropriate action or proceeding,
whether by legal process. or otherwise, may be instituted or taken

to prevent such unlawful erection, construction, reconstruction,
alteration, repair, conversion, maintenance or use, or to restrain,
correct or abate such violation, or to prevent the occupancy of said
building, structure or land, or to prevent any illegal act, conduct,
business or use in or about such premises.
ARTICLE XV
Amendments.
§ 100-150. Procedures.
The Town Board, upon its own motion or by petition, may, from
time to time, amend, supplement, change, modify or repeal this
chapter, including the Zoning Map, by proceeding in the following
manner:
A. The Town Board, by ' resolution adopted at a stated
meeting, shall fix the time and place of a public hearing on
the proposed amendment and cause notice thereof to .be
given pursuant to the provisions of the Town Law.
B. The Town Board, before advertising for a public hearing,
shall, in a written request, instruct the Town Planning
Board to prepare an official report defining the conditions
described in a petition and to .determine the area so of-_
fected, with its recommendations.
§ 100-151. Fees. [Amended 11-15-$3 by L.L. No. 13-19831
Every petition for a change or amendment to this chapter or the
Zoning Map shall be filed with the Town Clerk and shall be ac-
companied by a fee of two hundred dollars ($200.). •
§ 100-152. Notice of proposed change of zone classification.

A. In the case of a petition requesting a change in zoning
district classification, in addition to the notice required by

law, a written notice containing the following information
shall be sent by the petitioner, or his agent, by either
certified or registered mail, to every owner of property
immediately adjacent thereto. In the event. that any
petitioner owns or has any interest in any property im-
mediately adjacent to the property, proposed to be changed
• in zoning district classification,. then written notice shall
also be given to the owners of the property adjacent to such
..other property of the petitioner. For the purpose of this
section, the words "owner" or "property owner" mean the
owner as shown on the current Southold'town assessment
roll. -The. notice required by this section shall be mailed by
the petitioner, or his agent, within five (5) days preceding
the filing of the petition in the Town Clerk's office. Proof of
mailing of such notice in the form of a sworn statement
shall be filed with the Town Clerk at the time of filing the
petition. Such notice shall contain the following in-
formation:
(1) A statement that the petitioner proposes . to file a
petition with the Southold Town Clerk requesting a
change of zone classification.
(2) A description of the property which is the subject of
such petition.
(3) The.present zone district classification of the property
and the proposed zone district classification.
(4) A statement that within five (5) days the petition.
requesting such change in zone district classification
will be filed in the Southold Town Clerk's office, Main
Road, Southold, New York, and may then be
examined during regular office hours..
• (5) A statement that a public hearing with respect to such
petition must be held by the Southold Town Board
before such change of zone can become effective; that
the person to whom the notice is addressed, or his
representative, has the right to appear and be heard at
such hearing; and that a notice of such hearing will be
published in the official town newspaper not less than
ten (10) days prior to such public hearing.

B. In lieu of complying with the provisions of this section,
written verified waivers of notice executed by the persons
entitled to receive such notice may be filed with the Town
Clerk at the time of filing the petition.
C. Failure to comply with the provisions of this. section shall
not affect the validity of any action with respect to such
petition. •
