Other amendments noted where applicable.] r 3001 12-25-76 § 30-1 SOUTHOLD CODE § 30-4 ARTICLE I Bingo [Adopted 7-28-581 30-1. Purpose. The purpose of this Article is to amend an ordinance adopted by the Town Board of the Town of Southold, Suffolk County, New York, dated July 28, 1958, authorizing the conduct of bingo in such town, to change the reference in such ordinance from Article 14-G of the General Municipal Law to Article 14-H of the General Municipal Law, as so renumbered by Chapter 438 of the Laws of 1962, and to set forth herein the following additional amended and renumbered restrictions concerning the conduct of the, game of bingo by an authorized organization in such town, as required by § 479 of the General Municipal Law of the State of New York, as amended by Chapter 438 of the Laws of 1962. § 30-2. Bingo permitted. It shall be lawful for any authorized organization, as defined in § 476 of Article 14-H of the General Municipal Law, upon ob- taining the required license, to conduct the game of bingo within the territorial limits of the Town of Southold, subject to the provisions of this Article, Article 14-H of the General Municipal Law and Article 19-B of the Executive Law. § 30-3. License required. No person, ' firm, association, corporation -or organization, other than a licensee under the provisions of Article 14-H of the General Municipal Law shall conduct such game or shall lease or otherwise make available for conducting bingo a hall or other premises for any consideration whatsoever, direct or indirect. §_;30-4. Leased premises. No bingo games shall be held, operated or conducted on or within any leased premises if rental under such lease is to be paid, 8002 12-25-76 § 30-4 BINGO AND GAMES OF CHANCE § 30-10 wholly or partly, on the basis of a percentage of the receipts or net profits derived from the operation of such game. § 30-5. Purchase of bingo equipment. No authorized organization licensed under the provisions of Article 14-H of the General Municipal Law shall purchase or receive any supplies or equipment specifically designed or adapted for use in the conduct of bingo games from other than a supplier licensed under the' Bingo Control Law or another authorized organization. § 30-6. Use of proceeds. The entire net proceeds of any game of bingo and of any rental shall be exclusively devoted to the lawful purposes of the organization permitted to conduct the same. = § 30-7. Maximum value of single prize. No prize shall exceed the sum or value of two hundred fifty dollars ($250.) in -any single game of bingo. § 30-8. Maximum value of all prizes on one occasion. No series of prizes on any one (1) bingo occasion shall aggregate more than one thousand dollars ($1,000.). § 30-9. Management and operation. No person except a bona fide member of any such organization shall participate in the management or operation of such game: § 30-10. Remuneration prohibited. No person shall receive any remuneration for participating in the management or operation of any game of bingo. 3003 12-25-76 § 30-11 SOUTHOLD CODE § 30-22 = § 30-11. Penalties for offenses. The unauthorized conduct of a bingo game and any willful violation of any provision of this Article shall constitute and be punishable as a misdemeanor. §§ 30-12 through 30-19. (Reserved) ARTICLE II Games of Chance [Adopted 10-1-76 as. L.L. No. ,i 1976] § 30-20. Definitions. The words and phrases used in this Article shall, for the pur- pose of this Article, have the meanings respectively ascribed to them by Article 9-A of the General Municipal'Law. § .30-21. -Games of chance authorized. It shall be lawful for any authorized organization, as defined in § 186 of Article 9-A of the General Municipal Law, upon ob- taining the required license therefor, to conduct games of chance within the territorial limits of the Town of Southold, subject to the provisions of this Article and Article 9-A of the General Municipal Law. § 30.22. Restrictions. . The conduct of games of, chance authorized by this Article shall be subject to the following restrictions: A. No person, firm, association, corporation or organization, other than a licensee under the provisions of Article 9-A of the General Municipal :Law shall conduct such game or shall lease or otherwise make available for conducting 3004 12-25-76 § 85-1 TAXATION Chapter 85 TAXATION § 85-1. Penalties for offenses. § 85-2 [HISTORY: Adopted by the Town Board of, the Town of Southold 4-20-71. Amendments noted where applicable.] § 85-1. Partial exemption for senior citizens. Real property owned by one. (1) or more persons, each of whom is sixty-five (65) years of age or over, or real property owned by husband and wife, one (1.) or whom is sixty-five (65) years of age or over, shall be exempt from town taxes to the extent of fifty percent (50%) of the assessed valuation thereof. § 85-2. Conditions. No exemption shall be granted: A. If the income of the owner or the combined income of the owners of the property for the income tax year immediately • preceding the date of making application for exemption exceeds the sum of five thousand dollars ($5,000.). "In- come tax year" shall mean the twelve-month period for which the owner or owners filed a federal personal income tax return; or if no such return is filed, the calendar year. Where title is vested in either the husband or the wife, their combined income may not exceed such sum. Such income shall include social security and retirement benefits, in - 8501 § 85-2 SOUTHOLD CODE § 85-3 terest, dividends, net rental income, salary or earnings, and net income from self-employment, but shall not include gifts or inheritances. B. Unless the title of the property shall have been vested in the owner or all of the owners of the property for at least sixty (60) consecutive months prior to the date of making application for exemption; provided, however, that in the • event of the death of either a husband or wife in whose name title of the property shall have .been vested at the time of death and then becomes vested solely in the sur- vivor by virtue of devise by or descent from the deceased husband or wife, the time of ownership of the property by the deceased husband or wife shall be deemed also a time of ownership by the survivor and such ownership shall be deemed continuous for the purposes of computing such period of sixty (60) consecutive months, and provided further that where property of the owner or owners has been acquired to replace property formerly owned by such owner or owners and taken by eminent domain or other involuntary proceedings, except a tax sale, the period of ownership of the former property shall be combined with the period of ownership of the property for which ap- plication is made for exemption and such periods of ownership shall be deemed to be consecutive for purposes of this chapter. i C. Unless the property is used exclusively for residential purposes. D. Unless the real property is the legal residence of and is occupied in whole or in part by the owner or by all of the owners of the property. • § 85-3. Applications. Application for such exemption must be made by the owner or all of the owners of the property, on forms prescribed by the State Board, to be furnished by the appropriate assessing authority, and shall furnish the information and be executed in the manner 8502 C� t § 85-3 TAXATION § 85-5 required or prescribed in such forms, and shall be filed in such assessor's office on or before the appropriate taxable status date. § 85-4. Reapplications. At least sixty (60) days prior to the appropriate taxable status date, the assessing authority shall mail to each person who was granted exemption pursuant to this chapter on the latest com- pleted assessment roll or application form and a notice that such application must be filed on or before taxable status date and be approved in order for the exemption to be granted. Failure to mail such application form and notice or the failure of such person to receive the same shall not prevent the levy, collection and en- forcement of the payment of the taxes on property owned by such person. § 85-5. Penalties for offenses.
