Street Excavations [L.L..No. 10-1985] ............. 8301 X 4-25-86 § 48-2 GARBAGE, RUBBISH AND REFUSE § 48-4 (4) The engaging in secondhand junk and auto parts activities and businesses when a license therefor has been obtained pursuant to the provisions of the Southold town ordinance licensing and regulating secondhand junk and auto parts activities and businesses.' ® § 48-3. Town refuse disposal area. A. No person shall deposit or cause to be deposited in or on any refuse disposal area maintained by the Town of Southold any substance of any kind except in the areas designated by and under the direction of the attendant in charge, whether such direction is given personally or by another person by his authority, or by a sign or signs erected in the refuse disposal area by the authority of the Town Board or such attendant. B. No garbage, refuse, rubbish or other material that does not have its origin within the Town of Southold shall be deposited or disposed of in the town refuse disposal area. [Added 7-31-731 C. No vehicle shall be permitted to transport refuse into any refuse disposal area maintained by the Town of Southold unless such vehicle displays a valid permit and/or license issued pursuant to the provisions of this chapter. [Added 7- 24-79 by L.L. No. 1-1979; amended 10-9-84 by L.L. No. 9- 19841 § 48-4. Fees; issuance and duration of permits and licenses. [Added 10-9-84 by L.L. No. 9-1984'] • A. The fees for the issuance of permits and/or licenses for vehicles transporting refuse into any refuse disposal area maintained by the Town of Southold shall be as follows: (1) Parking permit: for noncommercial vehicles of less than one -ton capacity owned by a resident and/or Editor's Note: See Ch. 54, Junkyards. Editor's Note: This local law also renumbered former §§ 48.4 and 48.5 as §§ 48.5 and 48.8, respectively. 4803 12-25-84 § 48-4 SOUTHOLD CODE § 48-4 taxpayer of the Town of Southold and transporting only household refuse, provided that such vehicle dispays a valid parking permit issued pursuant to the provisions of §65-3 of the Code of the Town of Southold. (2) Per -load fee of fifty cents ($0.50) for each non- commercial vehicle of less than one -ton capacity, which possesses no permit. (3) Per -load fee of fifteen dollars ($15.) for each single -axle truck which does not possess a permit. (4) Annual fee of twenty-five dollars ($25.) for each commercial vehicle transporting liquid septic waste, together with an additional fee of one cent ($0.01) for each gallon of liquid waste discharged. (5) Annual fee of twenty-five dollars ($25.) for each commercial contractor's vehicle of less than one -ton maximum gross vehicle weight. (6) Annual fee of twenty-five dollars ($25.) for each farm vehicle of one -ton or more capacity transporting agricultural waste. (7) Per -load fee of twenty-five dollars ($25.) for each double -axle truck which does not possess a permit. (8) Annual fee of one hundred dollars ($100.) for each single -axle vehicle transporting solid waste (garbage). (9) Annual fee of one hundred dollars ($100.) for each commercial contractor's vehicle of more than one -ton capacity. (10) Annual fee of two hundred fifty dollars ($250.) for each double -axle and/or compactor -type vehicle trans- • porting solid waste (garbage). Zoning - See Ch. 100. ! § 50-1. Title. This chapter shall be known and may be cited as. the "Home Improvement Contractors Law of the Town. of Southold." 5001 7-25-75 § 50-2 SOUTHOLD CODE § 50-2 § 50-2. Definitions. As used in this chapter, the following terms shall have the meanings indicated: BUILDING INSPECTOR — The Building Inspector of the Town of Southold or arty duly appointed deputy or assistant building inspector of the Town of Southold. ROME IMPROVEMENT — Any repair, remodeling, alteration, conversion, modernization, improvement or addition to residential property; includes but is not limited to alarm systems, awnings, basements, bathrooms, cabinetmakers, carpentry, central vacuum cleaning, cesspools, dormers, driveways, extensions, exterminating, fencing, flagpoles, flooring, fumigation, garages, heating, ventilating, air conditioning, kitchens, masonry, railings, roofing, septic tanks, siding, sprinklers, storms and screens, swimming pools, tennis courts, termite control, tile installers, waterproofing and weatherproofing; but shall not include: A. The construction of a new home or work done by a .contractor in compliance with a guaranty of com- pletion on new residential property. B. The sale of goods by a seller who neither arranges- to perform nor performs directly or indirectly any work or labor in connection with the installation or ap. plication of the goods. C. Improvements to residences. owned or controlled by any government subdivision. D. The painting or decorating of residential property. E. The Iandscaping of residential property. HOME IMPROVEMENT CONTRACT'— An oral or written agreement between a home improvement con- tractor and an owner for the performance of a home im- provement, and includes all labor, services and materials to be furnished and performed thereunder. HOME IMPROVEMENT CONTRACTOR — A person who conducts or engages in a home improvement business 5002 7-25-75 § 50-2 HOME IMPROVEMENT CONTRACTORS § 50-4 and who performs or undertakes or agrees to perform or undertake a home improvement. LICENSEE — A person permitted to engage in the home improvement business under the provisions of this chapter. OWNER — Any owner of residential property, any tenant or any other person who orders, contracts for or purchases • the services of a home improvement contractor, or the person entitled to performance of the work of a home improvement contractor pursuant to a home improvement contract. PERSON — An individual, firm, partnership, corporation or other entity. PLACE OF BUSINESS — Any shop, residence, place or premises from which a home improvement business is transacted. RESIDENTIAL PROPERTY — One- or two-family houses and property associated therewith. § 50-3. License required. No person, shall. conduct or engage in any home ,improvement business without first obtaining and maintaining in effect at all times a license therefor, issued by the Building Inspector, as hereinafter ' provided: §'-504.'-` Exemptions from licensing requirement: ' No 'lice'nse shall be required under this chapter in the following instances: A. By an . individual who performs . labor or services for a licensed home improvement contractor for wages or salary. B. By a. member or partner of a firm, partnership or other entity which is a licensed home improvement contractor, who performs labor or services for such licensed home improvement contractor. 5003 7-25-75 § 50-4 SOUTHOLD CODE § 50-5 C. By a stockholder or officer of a corporation which is a licensed home improvement contractor, who performs labor or services for such licensed home improvement contractor. D. By a plumber, electrician, architect or professional engineer or any other person who is required by state or town law to attain standards of competency or experience • as a prerequisite to engaging in such craft or profession and who is acting exclusively within the scope of the craft or profession for which he is currently licensed. E. Any home improvement where the aggregate contract price for all labor, materials and other items is less than five hundred dollars ($500.). This exclusion does not apply where the work is only part of a larger or major operation, whether undertaken by the same or a different home im- provement contractor, or where a division of the operation is made in contracts of amounts less than five hundred dollars ($500.) for the purpose of evasion of this chapter or otherwise. § 50-5: Application -.fee; term, use and display of license. A. A fee of ten dollars (S10J shall be paid to the- Town of Southold upon the filing o€ each application,for a license or renewal thereof for . the purpose of defraying expenses Incidental to the processing of -said application and the. enforcement of the provisions.'of this- chapter. $. AnyIicenseissued hereunder shall expire one (1) year after its dateof, issuance, unless revoked as hereinafter provided. C. The issuance of- a license shall_ not create a presumption that the licensee is in compliance with the provisions of this chapter or that the licensee is entitled to the license. D. No Iicense issued under this chapter shall be transferred or assigned to any person or used by any person other than the licensee to whom it was issued-. E. A license issued hereunder shall not be deemed to authorize the licensee to perform any work or engage in any kind of 5004 7-25-75 § 50-5 HOME IMPROVEMENT CONTRACTORS § 50-6 business which is reserved to qualified licensees under separate provisions of state or town law. F. A license issued hereunder shall at all times be con- spicuously posted in the place of business of the licensee. G. The licensee shall, within ten (10) days after a change in the • ownership, management, control, address or trade name of the licensee, notify the Building Inspector thereof in writing. § 50-6. Application for license. Applicants for licenses or renewals thereof shall file a written, signed and verified application with the Building Inspector. If the applicant is a corporation, the application shall be signed and verified by an officer thereof. If the applicant is a firm, part- nership or other entity, the application shall be signed and verified by a member or partner thereof. Applications shall contain the following information: T A. The name, trade name and business address of the ap- plicant. B. If the applicant is an individual, his name and residence address; if the applicant is a corporation, the names and residence addresses of the officers thereof; ' if the applicant is a firm, partnership or `0't her entity, the. names and .residence addresses of the members or partners thereof. C.• Whether or not there are any :outstanding liens or judgments against the applicant. D. Such other reasonable information as" the 'Building In-spector may deem necessary or advisable to facilitate the purposes and enforcement of this chapter, including but not limited to the following: (1) The names and residence addresses of any employees of the applicant. (2) The . names and residence addresses of the 11 stockholders and directors of " a corporate applicant. 5005 7-25-75 § 50-6 SOUTHOLD CODE § 50-8 (3) Whether or not the applicant or any member, partner, officer, stockholder or employee thereof ever engaged in a home improvement business under another name or for another person and, if so, reasonable in- formation with respect thereto. (4) Information relating to the financial responsibility and character of the applicant. • § 50-7. Issuance or denial of license. After the filing of an application for a license or renewal thereof and payment of the required fee, the Building Inspector shall examine the application and make such investigation as he deems necessary or advisable. Upon completion of the same, the Building Inspector shall issue a license unless he finds that the applicant is unfit or undesirable to carry on such home im- provement business or is incapable of properly conducting such home improvement business, in which event he shall deny the license. § 50-8. Notice of denial; appeal. A. The Building Inspector shall notify the applicant of his denial of an application for a license. Service of such notice shall be made personally or by certified mail, directed to the address set forth in the application for a license. Such notice shall be in writing and shall specify the ground or grounds for the denial. The notice shall include or be ,ac- -companied by a statement that the applicant may request an appeal hearing before the Town Board. by filing a -written request therefor with the Town Clerk. The Town CIerk shall give the appealing.party at least five (5) days' • written notice of the time and place of such hearing. B. At the time and place set for the hearing upon the appeal from the determination of the Building Inspector, the Town Board shall give the appealing party and any other interested party a reasonable opportunity to be heard in order to show cause before said Board why the deter - 5006 7-25-75 § 50-8 HOME IMPROVEMENT CONTRACTORS § 50-9 mination of the Building Inspector should not be upheld. The decision of the Town Board shall be in writing, shall specify the ground or grounds upon which the decision is based and shall be final and conclusive. § 50-9. Licensing Review Board. • A. Formation and composition. (1) There is hereby established in and for the Town of Southold a Licensing Review Board consisting of either three (3) or five (5) members, as may be determined from time to time by the Town Board, who shall be appointed by the Town Board to serve at the pleasure of the Town Board. In no event shall a member serve for more than two (2) years unless reappointed by the Town Board. (2) The Town Board shall designate one (1) member of the Licensing Review Board to -serve as Chairman thereof. !' (3) A majority of -the members of such Board shall constitute a quorum. (4) Members of the Licensing Review Board shall be residents,of the.town and shall serve without salary or compensation. . (5) At least one (1) member of the Licensing Review Board ' shall be a home improvement contractor who resides and'has his place of business in the town. (6) The Licensing Review Board shall keep minutes of its proceedings and records of its hearings and other official actions. •B. Function. It shall be the function of this:Boar& to hear and determine any complaint. or .grievance that 'may be the basis for recommendation to the Town Board for suspension or revocation of the license upon a finding that the licensee has been guilty of any one (1) of the following: (1) Fraud, misrepresentation or bribery in securing a license. 5007 7-25-75 § 50-9 SOUTHOLD CODE § 50-9 (2) The making of any false statement as to a material matter in any application for a license. (3) The person or the management personnel of the home improvement contractor are untrustworthy or not of good character. (4) The business transactions of the home improvement contractor have been or are marked by a practice of is failure to timely perform or complete its contracts, or the manipulations of assets or accounts, or by fraud or bad faith, or are marked by an unwholesome method or practice of solicitation of business from owners. (5) Failure to display the license as provided in this chapter. (6) Failure to comply with any demand or requirement lawfully made by the Building Inspector, Licensing Review Board or Town Board. (7) An agent or employee of a licensee has been guilty of an act or omission, fraud or misrepresentation and the licensee has approved or had knowledge thereof. (8) Violation of any provision of this chapter. (9) Abandonment or willful failure to perform, without justification, any home improvement contract or - project engaged in or undertaken by a home im- provement contractor; or willful deviation from or disregard of plans or specifications in any material respect without the consent of the owner and, where required, from the Building Inspector. (10) Making a substantial misrepresentation in the : solicitation or procurement of a home -improvement contract, or making any false promise of character likely to influence, persuade or induce. (11) Any fraud in the execution of, or in the material alteration of, any contract, mortgage, promissory note or other document incident to a home improvement transaction. 5008 7-25-75 § 50-9 HOME IMPROVEMENT CONTRACTORS § 50-9 (12) Preparing' or accepting any mortgage, promissory note or other evidence of indebtedness upon the obligations of a home improvement transaction with knowledge that it recites a greater monetary obligation than the agreed consideration for the im- provement work. • (13) Directly or indirectly publishing any advertisement relating to home, which advertisement contains an assertion, representation or statement which is false, deceptive or misleading, provided that any ad- vertisement which is subject to and complies with the then existing rules, regulations or guides of the Federal Trade Commission shall not be deemed false, deceptive or misleading; or by any means advertising or purporting to offer the general public any home improvement work with the intent not to accept contracts for the particular work or at the price which is advertised or offered to the public. (14) Willful or deliberate disregard and violation of the y building, sanitary, fire and health laws of the town, county or state. (15) Failure to notify the Building Inspector of any change or control in ownership, management or business name or location. (16) Conducting a home improvement business in any name other than the one in which the home im- provement contractor is licensed. C. Procedure. (1) The Licensing Review Board shall have the right to determine whether or not it will take jurisdiction.of any complaint submitted to it. In the event it shall deny jurisdiction, such determination shall be in writing and a copy shall be mailed to the complainant. (2) If the Licensing Review Board, upon reasonable cause, should believe that any licensee has violated any of the provisions of this chapter, such Board shall have the 5009 7-25-75 § 50-9 SOUTHOLD CODE § 50-10 power to make such investigation as it shall deem necessary or advisable. (3) There shall be no recommendation that a license be suspended or revoked until after a hearing before the Licensing Review Board upon at least ten (10) days' written notice to the licensee. Such notice shall specify the time and place of the hearing and that the purpose • of the hearing is to determine whether a recom- mendation of suspension or revocation should be made to the Town Board and a statement of the grounds - therefor. Such notice shall be served personally or by certified mail, return receipt requested, addressed to the place of business of the licensee. The licensee and any other interested party shall be given a reasonable opportunity to be heard. A stenographic record of the hearing may be taken and preserved. The recom- mendation of the Licensing Review Board shall be in writing and shall specify the ground or grounds upon - which it is based. In lieu of a recommendation, the Licensing Review Board may accept a written —� assurance of a compromise between the parties. Vr § 50-10. Suspension or revocation of license. A. The Town Board shall have the power to revoke a license if it determines, after a public hearing as hereinafter provided, that the licensee is unfit or undesirable to carry on the home improvement business or is incapable of properly conducting such home improvement business. The Town Board shall have the power to suspend a license if it determines, after a public hearing as hereinafter provided, that the .licensee has been guilty of any act or circumstance set forth in § 50-913 of this chapter. B. If the Town Board determines to hold such a hearing, it shall notify the licensee that a hearing will be held before the Town Board to determine whether his license should be suspended or revoked. Such notice shall specify the time and place of the hearing and the ground or grounds for 5010 7-25-75 �1 § 50=10 HOME IMPROVEMENT CONTRACTORS § 50-11 suspension or revocation which will be the subject of the hearing. Such notice shall be in writing, shall be served at least ten (10) days prior to the date of the hearing and shall be served personally or by certified mail, return receipt requested, addressed to the place of business of the licensee. • C. At such hearing the licensee and any other interested party shall be given a reasonable opportunity to be heard. The decision of the Town Board shall be in writing, shall specify the ground or grounds upon which the decision is based and shall be final and conclusive. D. If the Town Board determines that the license of a licensee should be suspended or revoked, the Town Board shall direct the Building Inspector to notify the applicant that his license is suspended or revoked. Such notice shall be served personally or by certified mail, return receipt requested, addressed to the place of business of the licensee. A licensee shall immediately surrender his license to the Building Inspector upon its suspension or revocation by the Town Board. § 50-11. Penalties for offenses. A. Any person who shall conduct or engage in any home improvement business without having obtained a license therefor, in violation of this chapter, or who shall conduct or engage'in any home improvement, business while his license is suspended or revoked, in violation of this chapter, shall be guilty of a violation of this chapter, and, upon conviction, shall be punishable by a fine not exceeding two hundred fifty dollars ($250.) or by imprisonment for not more than fifteen (15) days, or both, for each and every violation. B. Each and every home improvement contract entered into or undertaken or performed by a home improvement contractor without having obtained or maintained in effect a license ,therefor, in violation of this chapter, shall be deemed a separate violation of this chapter. 5011 7-25-75 § 50-12 SOUTHOLD CODE § 50-14 § 50-12. Severability. The invalidity of any section, subsection or provision of this chapter shall not invalidate any other section, subsection or provision thereof. § 50-13. Reciprocity. • A. Any home improvement contractor whose principal place of business is located in the Town of East Hampton, Town of Riverhead, Town of Shelter Island or Town of Southampton or in any incorporated village within the Town of Southold or within any of the aforesaid towns and who holds a license, issued by such town or village in which his principal place of business is located, permitting him to conduct or engage in the home improvement business shall be exempt from the application fee provided for in this chapter and shall be entitled to a license under this chapter without payment of such application fee, upon filing, with his application, satisfactory proof that he meets the foregoing conditions. B. The application fee exemption provided for in § 50-13A of this chapter shall apply only to a home improvement contractor whose principal place of business is located in any such town or village which has adopted a local law or ordinance containing a reciprocal provision applicable to home improvement contractors having their principal place of business in the area of the Town of Southold outside the incorporated- villages therein. § 50-14. When effective; effect on prior contracts. Said map, indicating the latest amendments, shall be kept up-to-date, and a copy thereof shall be kept in the office of the Building Inspector for the use and benefit of the public. § 100-22. District boundaries. In determining the boundaries of districts shown on the Zoning Map, the following rules shall apply: A. Where district boundaries are indicated as approximately following the center lines of streets, highways, waterways or railroad rights-of-way, or such lines extended, such center lines shall be construed to be such boundaries. B. Where such boundaries are indicated as approximately • following the property lines of parks or other publicly owned lands, such lines shall be construed to be such boundaries. C. Unless otherwise shown, all district boundaries running parallel to streets shall be construed to be two hundred (200) feet back from the rights-of-way of said streets. 10016.2 4-25-83 § 100-30 ZONING § 100-30. (1) One -family detached dwellings, not to exceed one (1) dwelling on each lot. (2) The following commercial agricultural operations and accessory uses thereto, including irrigation, provided that there shall be no storage of manure or other odor - or dust -producing substance or use, except spraying and dusting to protect vegetation, within one hundred fifty (150) feet of any lot line: (a) The raising of. field and garden crops, vineyard and orchard farming, the maintenance of nurs- eries and the seasonal sale of products thereof in buildings, subject to the following special re- quirements: [1] All one-story buildings for display and retail sales of agricultural and nursery products grown primarily on the premises shall not exceed one thousand (1,000) square feet in floor area. Display of produce shall be not less than ten (10) feet from all street and lot lines. Any stand in excess of one hundred (100) square feet in floor area shall be set back twenty (20) feet from the street line. Any stand in -existence at the effective date of this chapter must, within one (1) year, comply with all of the provisions hereof. [2] .All signs shall conform to the provisions of § 100-30C(6)(b). (b) The keeping, breeding, raising and training of horses, domestic animals and fowl (except ducks)' ® on lots of ten (10) acres or more. [Amended 2-1-83 by L. -L. (2), Places of worship, including parish houses (but ex- cluding a rectory or parsonage, which shall conform to the requirements for a one -family dwelling), subject to the following requirements: (a) No building or part thereof shall be erected nearer than fifty (50) feet toany street line and nearer than twenty (20) feet to any lot line. (b) The total area covered by all principal and ac- cessory buildings shall not exceed twenty percent (20%) of the area of the lot. (3) Private schools, colleges and other educational in- stitutions, subject to the following requirements: (a) No building shall be less than fifty (50) feet from any street or lot line. (b) The total area occupied by all principal and ac- cessory buildings shall not exceed twenty percent (20%) of the area of the lot. • (c) Any such school shall be a nonprofit organization within the meaning of the Internal .Revenue Act and shall be registered effectively thereunder as such. ' Editor's Note: This local., law also repealed former Subsection A(2)(c), as amended 5.30-75 by L.L. 3.1975, which listed the keeping of not more than two (2)horses or ponies for personal use as a permitted use in an A District and redesignated former Subsection A(2)(d) as this Subsection A(2)(c). 10020 4-25-83 § 100-30 ZONING § 100-30 (f) A minimum of three (3) off-street parking spaces shall be provided. (g) Not more than one (1) accessory apartment shall be permitted on a lot. (h) The accessory apartment shall meet the require- ments of a dwelling unit as defined in § 100-13 j� hereof. (i) The exterior entry to the accessory apartment shall, to the maximum extent possible, retain the existing exterior appearance of a one -family dwelling. (j) All exterior alterations to the existing building, ex- cept for access to the apartment, shall be made on the existing foundation. (k) The certificate of occupancy shall terminate upon the transfer of title by the owner, or upon the owner ceasing to occupy one (1) of the dwelling units as the owner's principal residence. In the event of an own- er's demise, the occupant of an accessory apartment may continue in occupancy until a new owner shall occupy the balance of the dwelling or one (1) year from date of said demise, whichever shall first occur. (1) All conversions shall be subject to inspection of the Building Inspector and renewal of certificate of oc- cupancy annually. (m) The building which is converted to permit an acces- sory apartment shall be in existence and have a val- id certificate of occupancy issued prior to January 1, 1984. (n) The existing building, together with the accessory apartment, shall comply with all other requirements of Chapter 100 of the Town Code of the Town of Southold. . 10024.1 4.25.86 § 100-30 SOUTHOLD CODE § 100-30 (o) Notwithstanding the provisions of § 100-30B hereof, no site plan approval by the Planning Board shall be required for the establishment of an accessory apartment. C. [Amended 7-31-731 Accessory uses, limited to the follow- ing: (1) Home occupations, provided that: (a) No display of goods is visible from the street. (b) Such occupation is incidental to the residential use of the premises and is carried on in the main building by the resident therein with not more than one (1) nonresident assistant. (c) Such occupation is carried on in an area not exceeding thirty percent (30%) of the area of one (1) floor of the main building. (d) There shall be no exterior effect at the property line, such as noise, traffic, odor, dust, smoke, gas, fumes or radiation. (e) Studios where dancing or music instruction is offered to groups in excess of five (5). pupils at one (1) time, or where concerts or recitals are held, are prohibited.' Uses permitted by special exception by the Board of Appeals. The following uses .are permitted as a special exception by the Board of Appeals, as hereinafter provided, and subject to site plan approval by the Planning Board in accordance with Article XIII hereof: (1) Any special exception use set forth in, and as regulated by, § 100-30B of this chapter. C. Accessory uses. (1) Any accessory use set forth in, and as regulated by, § 100-30C of this chapter. ® (2) Accessory uses on the same lot with and customarily incidental to any permitted use and not involving a separate business. (3) Signs, subject to the. following requirements: (a) One (1)- advertising sign, either single- or doublefaced, not more than fifty (50) square feet 10029 4-25-83 § 100-40 SOUTHOLD CODE § 100-50 in area, the lower edge of which shall not be less than four (4) feet above the ground, exclusive of pillars and posts, and the upper edge of which shall not project more than fifteen (15) feet six (6) inches above the ground. Such sign shall ad- vertise only the business conducted on the premises upon which it is located. Such sign shall • be set back not less than five (5) feet from all street and lot lines. Such sign shall comply with all of the supplementary sign regulations hereinafter set forth. § 100-41. Bulk, area and parking requirements. No building or premises shall be used and no building or part thereof shall be erected or altered in the M Light Multiple - Residence District unless the same conforms with the Bulk and Parking Schedule incorporated into this chapter by reference, with the same force and effect as if such regulations were set forth.. herein in full.' § 100-42. No. 3-19751 Each dwelling unit in a multiple dwelling in the M-1 General Multiple -Residence District shall have a livable floor area of not less than eight hundred fifty (850) square feet, except that a one - bedroom or studio dwelling unit shall have a livable floor area of not less than six hundred (600) square feet. ARTICLE VI B Light Business District § 100-60. Use regulations. In a B District, no building or premises shall be used, and no building or part of a building shall be erected or altered which is arranged, intended or designed to be used, in whole or in part, for any uses except the following: A. Permitted uses, subject to site plan approval by the Planning Board in accordance with Article XIII hereof. • [Amended 10-26-76 by L.L. No. 5-1976; 2-1-83 by L.L. No. 2-19831 (1) Any permitted uses set forth in, and as regulated by, the following provisions of this chapter: (a) Subsection A(2) and (3) of § 100-30. (9) Marinas for the docking, mooring and accommodation of noncommercial boats, including the sale of fuel and oil primarily for the use of boats accommodated in . such marina." B. Uses permitted by special exception by the Board of Appeals. The following uses are permitted as a special exception by the Board of Appeals, as hereinafter provided, subject to site plan approval by the Planning Board in accordance with Article XIII hereof: r (1) [Amended 10-26-76 by L.L. No. 5-19761 Any special exception use set forth in, and as regulated by, the following provisions of this chapter: (a) Subsection B(2) to (13), inclusive, of § 100-30. (b) Subsection B(2), (4) and (5) of § 100-50. C. Accessory uses. [Amended 5-30-75 by L.L. No. 3-1975; 10- 26-76 by L.L. No. 5-19761 (1) Accessory uses on the same lot with and customarily incidental to any permitted use and not involving a separate business. (2) Signs, subject to the following requirements: (a) Detached or ground signs. As used in this subsection, the word • "premises" shall mean all contiguous property in common ownership. (b) Wall signs. One (1) sign attached to or in- corporated in each building wall on a public street and advertising only the business conducted in such building, provided that such sign does not: [1] Exceed two (2) square feet in total area for each horizontal foot of such wall. [2] Exceed in width one hundred percent (100%) of the horizontal measurement of such wall. [3] Exceed ten (10) feet in height. [4] Project more than one (1) foot from such wall. (c) Roof signs. In lieu of a wall sign authorized by the preceding Subsection C(3)(b), a roof sign shall be permitted, provided that the same is attached to or incorporated in a roof, which sign shall ad- vertise only the business conducted in the building upon which it is attached, and provided that such sign does not: [1] Exceed two (2) square feet in total area for each lineal foot of such roof. [2] Extend above the highest point of the roof in the case of a pitched roof, and in all other cases, exceed two (2) feet six (6) inches in height above the highest point of the roof. [3] Project beyond the edge of the roof. 10034 12-25-76 v § 100-61 ZONING § 100-62 • § 100-61. Bulk, area and parking requirements. No building or premises shall be used and no building or part thereof shall be erected or altered in the B Light Business District unless the same conforms with the "Bulk and Parking Schedule" incorporated into this chapter by reference, with. the same force and effect as if such regulations were set forth herein in full. § 100-62. Retail shopping centers. Notwithstanding any other provisions of this Article, a building or a combination of buildings containing retail stores, mercantile establishments, offices, banks and financial institutions, com- monly known as shopping centers, may be erected or altered in the B Business District, subject, however, to the following requirements: A. Approval of site development plans by the Planning_ Board in accordance with Article XIII hereof. B. The lot area shall be not less than one (1) acre and the lot width shall be not less than one hundred fifty (150) feet. C. At least twenty-five percent (25%) of the lot area shall be landscaped with grass and plantings. D. The required front yards shall be not less than thirty-five (35) feet, except that where the property in the vicinity is partly built up with permanent buildings and an average setback line has been established, no building shall project beyond the line of the average setback so established. E. The required side yards shall be not less than twenty-five (25) feet. F. The required rear yard shall be not less than twenty-five (25) feet. . G. Parking shall be provided in off-street parking areas which shall provide one (1). parking space, three hundred fifty (350) square feet in area, for each one hundred (100) square feet of sales floor area or office floor area in each building. [Amended 5-29-73] 10035 4-25-83 § 100-62 SOUTHOLD CODE § 100-70 H. All rainfall and stormwater accumulated on the premises shall be returned to the ground within the boundaries of the premises. I. The total floor area for each retail or service establishment located therein shall not exceed ten thousand (10,000) square feet. • § 100-63. Uses confined to enclosed buildings. [Amended 5-30-75 by L.L. No. 3-19751 All uses permitted in a B District, including the display and sale of merchandise and the storage of all property, except living plants, shrubs or trees, shall be confined to fully enclosed buildings on the premises. ARTICLE VII B-1 General Business District § 100-70. Use regulations. In the B-1 District, no building or premises shall be used, and no building or part thereof shall be erected or altered which is arranged, intended or designed to be used, in whole or in part, for any uses except the following: A. Permitted uses, subject to site plan approval by the Planning Board in accordance with Article XIII hereof. [Amended 7-31-73; 10-26-76 by L.L. No. 5-1976; 2-1-83 by L.L. No. 2-1983] (1) Any permitted use set forth in, and as regulated by, the following provisions of this chapter: (a) Subsection A(2) and (3) of § 100-30. (b) Subsection A(3) of § 100-40. (c) Subsection A(2) to (9), inclusive, of .§ 100-60. (d) Section 100-62. B. Uses permitted by special exception by the Board of Appeals. The following uses are permitted as a special exception by the Board of Appeals, as hereinafter 10036 4-25-83 § 100-70 ZONING § 100-70 provided, subject to site plan approval by the Planning Board in accordance with Article XIII hereof: (1) [Amended 10-26-76 by L.L. No. 5-19761 Any special exception use set forth in, and as regulated by, the following provisions of this chapter: • (a) Subsection B(2) to (13), inclusive, of § 100-30. (b) Subsection B(2), (4) and (5) of § 100-50. (2) Places of amusement. (3) Fishing stations. (4) Public garages, gasoline service stations and new and used car lots, all subject to the following requirements: (a) Entrance and exit driveways shall have an unrestricted width of not less than twelve (12) feet and not more than thirty (30) feet and shall be located not less than ten (10) feet from any property line, and shall be so laid out as -to avoid the necessity of any vehicle backing out across any public right-of-way. (b) Vehicle lifts or pits, dismantled automobiles and all parts or supplies shall be located within a building. (c) All service or repair of motor vehicles, other than such minor servicing as change of tires or sale of gasoline or oil, shall be conducted in a building. (d) The storage of gasoline or flammable oils in bulk shall be located fully underground and not less than thirty-five (35) feet from any property line other than the street line. (e) No gasoline or fuel pumps or tanks shall be located less than fifteen (15) feet from any street or property line. (f) No motor vehicle sales, used car lots, gasoline service or repair shops or similar businesses are to 10037 7-25-78 § 100-70 SOUTHOLD CODE § 100-70 be located within three hundred (300) feet of a church, public school, library, hospital, or- phanage or a rest home. [Amended 5-30-75 by L.L. No. 3-19751 (5) [Added 4-11-78 by L.L. No. 2-1978'] Partial self- service gasoline service stations shall be subject to all of the provisions of § 100-70B(4), and the following additional requirements: (a) Each partial self-service gasoline facility shall have a qualified attendant on duty whenever the station is open for business. It shall be the duty of the qualified attendant to control and operate both the console regulating the flow of gasoline to the dispensing equipment thereafter to be operated by the customer at the self-service pump island and the dispensing equipment on the other pump islands. (b) Gasoline shall at no time be dispensed without the direct supervision of the qualified attendant. A control shall be provided which will shut off the - flow of gasoline to the dispensing equipment at the self-service pump island whenever the qualified attendant is absent from the control console for any reason whatever, including when he is operating the dispensing equipment on the other pump islands. (c) The console regulating the flow of gasoline to the remote dispensing equipment thereafter operated by the customer at the self-service pump island shall be situated in such a manner as to give the qualified attendant controlling said console an unobstructed view of the operation of said remote dispensing equipment. (d) The self-service pump island shall have controls on all pumps that will .permit said pumps to ' Editor's Note: This local law also renumbered former Subsection B(5) to become B(8). 10038 7-25-78 1 § 100-70 _ ZONING § 100-71 operate only when a dispensing nozzle is removed from its bracket on the pump and the switch for this pump is manually operated. (e) The self-service pump island shall be protected by an automatic fire protection system in the form of an approved system of dry power release which • will act as an automatic fire extinguisher. (f) No customer shall be permitted to dispense gasoline unless he shall possess a valid motor vehicle operator's license. (g) There shall be no latch -open device on any self- service dispensing nozzle. " (6) Cabinet shops, carpenter shops, electrical shops, plumbing shops, furniture repair shops and bicycle and motorcycle shops. [Added 5-30-75 by L.L. No. 3- 19751 " C. Accessory uses. [Amended 10-26-76 by L.L. No. 5-1976] (1). Accessory uses on the same lot with and customarily incidental to any permitted use and not involving a separate business. (2) Research, design and development laboratories; office buildings. (3) Wholesale storage and warehousing. (4) Building contractors' yards. (5) Public utility structures and uses. (6) Newspaper and printing establishments. (7) Bus and truck terminals (garages, parking facilities, loading docks, etc.). (8) Food processing and packaging plants. (9) Marinas for the docking and mooring of all types of boats.14 (10) Launching facilities. (11) Ferry terminals. (12) Yacht clubs; charter fishing docks. (13) Eating and drinking establishments. (14) Retail sales of boats and marine items. (15) Boat building; boat servicing; boat storage facilities. (16) Yards for sale and storage of fuel and building materials. (17) Special exception use. [Repealed 10-26-76 by L.L. No. 5-1976] • C. Accessory uses. (1) Accessory uses on the same lot with and customarily incidental to any permitted use and not involving a separate business. (2) Acetylene gas manufacture or gas manufacture from coke, petroleum or from any other product, or the storage thereof. (3) Acid manufacture. • (4) Ammonia, bleaching powder or chlorine manufacture. (5) Arsenal. (6) Asphalt manufacture and asphalt mixing plants. (19) Gunpowder manufacture or storage. t' (20) Automobile wrecking yards and all other junkyards. (21) Oilcloth or linoleum manufacture. (22) Oil, rubber or leather manufacture. (23) Ore reduction. (29) Rubber or gutta-percha manufacture. (30) Saltworks. (31) Sauerkraut manufacture. (32) Shoeblacking or stove polish manufacture. (33) Smelting. (38) Sulfuric, nitric or hydrochloric acid manufacture. • (39) Sugar refining. (40) Tar distallation or manufacture. (41) Tar roofing or waterproofing manufacture. (42) Tallow, grease or lard manufacture. (43) Tanning, curing or storage of rawhides or skins. (44) Tobacco (chewing) manufacture or treatment. (45) Vinegar manufacture. (46) Yeast plant. (47) Airports and airfields. § 100-91. Special exception uses; site plan approval. Notwithstanding any of the provisions of this Article; where a use is permitted in any use district only as a special exception by the Board of Appeals, such use is not permitted in a C-1 District except as a special exception by the Board of Appeals, and where a use in any use district is subject to site plan approval of the Planning Board, such use in a C-1 District shall require site plan approval of the Planning Board. § 100-92. Signs. Signs as specified in and regulated by § 100-60C of this chapter are permitted in a C-1 District. § 100-93. Bulk, area and parking requirements. No building or premises shall be used and no building or part thereof shall be erected or altered in the C-1 General Industrial 10041 § 100-93 SOUTHOLD CODE § 100-110 District unless the same conforms with the "Bulk and Parking Schedule" incorporated into this chapter by reference, with the same force and effect as if such regulations were set forth herein in full. ARTICLE X Tourist Camps, Camp Cottages and Trailers' s ' § 100-100. Permits required. • No tourist camp shall be established, maintained or operated in any district, nor shall any tent, tent house, camp cottage, house car or trailer to be used or occupied as a place for living, sleeping or eating, whether charge is or is not made, be erected or placed therein, unless authorized by the Town Board pursuant to the provisions of the Trailer Camp Ordinance, dated June 30, 1953.16 § 100-101. Automobile trailers or house cars. Notwithstanding any other provisions of this chapter, a single. automobile trailer or house car may be located outside a tourist camp only when authorized by the Town Board and subject to such conditions as may be prescribed by the Town Board. § 100-102. Exemptions. This Article shall not be deemed to apply to the temporary or seasonal camp of any unit of the Boy Scouts of America or the Girl Scouts of America or other such organizations under the leadership provided by said organizations, respectively. ARTICLE XI General Regulations § 100-110. Signs. The provisions of this section shall apply in all districts. A. No sign, billboard, advertising display or structure, poster or device shall be erected, moved, enlarged or recon- structed - except as expressly permitted in this chapter. 15 Editor's Note: see also Ch. 88, Tourist and Trailer Camps. 16 Editor's Note : This ordinance appears as Ch. 88, Tourist and Trailer Camps, of this Code. 10042 § 100-141 ZONING § 100-141 Building Inspector may authorize, in writing, the ex- tension of the permit for an additional six (6) months. Thereafter, a new permit shall be required. [Amended 5.30- 75 by L.L. No. 3-19751 I. As soon as the foundation of a building or of any addition to an existing building is completed, and before first -story framing or wall construction is begun, there shall be filed with the Building Inspector an accurate survey, signed by the person responsible for said survey, showing the exact location of such foundation with respect to the street and property lines of the lot. No further construction shall be performed until such survey is approved by the Building Inspector. J. Permit fees. [Amended 7-31-73; 2-1-83 by L.L. No. 2-19831 (1) [Amended 7-17-84 by L.L. No. 8-1984; 1-8-85 by L.L. No. 1-1985] The following fees shall be paid upon the filing of an application with the Building Inspector for a building permit, which fees shall be paid into the gener- al fund if the application is approved or returned to the applicant if the application is denied: (a) Single-family dwellings: [1] New dwellings and additions to existing dwell- ings: fifty dollars ($50.) plus ten cents ($0.10) for each square foot of floor area in excess of eight hundred fifty (850) square feet. [2] Accessory buildings and additions and altera- tions to existing accessory buildings: twenty- five dollars ($25.) plus ten cents ($0.10) for each square foot of floor area in excess of five hundred • (500) square feet. (b) Farm buildings and additions and alterations to ex- isting farm buildings: twenty-five dollars ( $25.) for each building. (c) Hotel, motel, multiple dwellings and business, in- dustrial and all other buildings: 10069 2-26-85 § 100-141 SOUTHOLD CODE § 100=142 [1] New buildings and additions and alterations to existing buildings: one hundred dollars ($100.) plus fifteen cents ($0.15) for each square foot of floor area in excess of one thousand (1,000) square feet. [2] Accessory buildings and additions and altera- • tions to existing accessory buildings: twenty- five dollars ($25.) plus ten cents ($0.10) for each square foot of floor area in excess of five hundred (500) square feet. (d) Foundations constructed under existing buildings: thirty dollars ($30.). (e) All other structures (i.e., fences, pools, etc.) and ad- ditions and alterations to such structures: twenty- five dollars ($25.). (f) Signs. The -fee for all signs, except signs permitted by §. 100-30C(6xa), shall be twenty-five cents ($0.25) for each square foot of sign area, with a minimum fee of five dollars ($5.). (g) Demolition and/or removal and/or relocation of any building: one hundred dollars ($100.). (2) For the purposes of this Subsection J, cellars, decks, attached garages and any habitable area shall be included in the calculation of floor area. § 100-142. Revocation of permit. The Building Inspector may revoke a building permit theretofore issued and approved in the following instances: • A. Where he finds that there has been any false statement or misrepresentation as to a material fact in the application, plan or specifications on which the building permit was based. B.
