MONOPOLIZE — The use for an unreasonable period .of
time to the exclusion of others or to unreasonably
restrict or obstruct the use of any public bulkhead, dock
or landing owned or controlled by the Town of Southold.
PERSON — Includes an individual, copartnership,
society, association, joint-stock company, club,
corporation and any combination of individuals.
§ 32-21. Monopolization of docks, bulkheads and landing
places prohibited.
It shall be unlawful for any person to monopolize, to the
exclusion of others, any public dock, public bulkhead or public
landing place within the boundaries of said Town of Southold
(excluding therefrom the territory within the limits of the
Incorporated Village of Greenport).

ARTICLE III
Boats
[Adopted 10-4-19601
§ 32-30. Short title; applicability.
A. This Article shall be known as the `Boat Ordinance of
the Town of Southold."
B. The following rules and regulations shall apply to all
• waters within the Town of Southold and to all waters
bounding the Town of Southold to a distance of one
thousand five hundred (1,500) feet from the shore;
provided, however, that they shall not apply to waters

within or bounding an incorporated village of the town to
a distance of one thousand five hundred (1,500) feet from
the shore.
§ 32-31. Definitions.
For the purpose of this Article, the terms used herein are
defined as follows:
BOATS — Every vessel propelled in any manner.

BOWRIDING — The practice of riding on the bow of a
vessel when such vessel is not equipped by the
manufacturer with facilities for riding on the bow while
said vessel is underway. [Added 8-28-1990 by L.L. No.
17-1990]
CHANNEL SYSTEM — The bed of a natural waterway
with well-defined banks presenting the evidence of the
flow of tidal waters and commonly or usually traversed
by watercraft; and, in addition,, refers to man-made or
stabilized waterways designed for the navigation of
watercraft. For the purpose of this Article, boat basins
and bathing areas are included in the "channel system."

PERMANENT MOORING — Any of a number of
different mechanical or cable -like systems the intended
purpose of which is to permit the securing of a boat to a
fixed location. Said system typically consists of an
anchoring device (mushroom or other) which is placed on
the bottom of the harbor and is connected to a floating
device (i.e., ball) by cables and/or lines. [Added

PERSONAL WATERCRAFT — A vessel which uses an
inboard motor powering a water jet pump as its primary
source of motive power and which is designed to be
operated by a person sitting, standing or kneeling on or

being towed behind the "vessel rather than in the
conventional manner of sitting or standing inside the
vessel. [Added 4-6-1993 by L.L. No. 4-19931
SPECIALTY PROP -CRAFT — A vessel which is powered
by an outboard motor or a propeller -driven motor and
which is designed to be operated by a person sitting,
• standing or kneeling on or .being towed behind the vessel
rather than in the conventional manner of sitting or
standing inside the vessel: [Added 4-6-1993 by L.L. No.

TEMPORARY ANCHORING — The securing of a boat in
a harbor on a temporary basis by means of an anchor
carried aboard the boat. [Added 5-10-1983 by L.L. No.
5-1983]
§ 32-32. Sanitary regulations. [Amended 8-10-19711
The dumping of oil, refuse, garbage, sewage or waste is
prohibited.
§ 32-32.1. Ramps. [Added 8-28-1990 by L.L. No. 17-19901
A. All boat engines must be shut off when loading or
unloading at any town boat ramp.
B. No person shall park or leave any unattended vehicle on
any ramp.
§ 32-33. Unnavigable boats; hazards to navigation.
• A. Any boat which becomes a menace to navigation or
unseaworthy or sinks, grounds or otherwise becomes
disabled or incapable of navigation shall be removed or
restored to navigable condition by the registered owner
upon notice from the Southold Town Board or its
designated agent, which notice shall be either by
personal service or by certified mail addressed to the

registered owner's last known address as given by him or
as stated in his certificate of registration. [Amended

B. If such boat is not removed or restored to navigable
condition by the owner within one (1) week after the
mailing of said notice, the Southold Town Board or its
designated. agent may direct the removal or destruction •
of the boat, and the cost of said removal, including
storage charges, shall attach to and shall become a lien
upon said boat, and said boat may be sold, upon direction
of the court, at public auction to defray said expenses,
any surplus being returned to the owner of record. The
town shall not be liable for any damage done to said boat
during its removal, storage and sale.
§ 32-34. Operation of boats near beaches and bathers.

No boat propelled other than by hand shall cruise or be
operated within one hundred (100) feet of any lifelines or
bathing float or, if there are no lifelines or bathing float, then
within one hundred (100) feet of any public or semipublic beach
regularly used for bathing or swimming, nor shall such boat
cruise or be operated in excess of five (5) miles per hour within
fifty (50) feet of any person bathing or swimming or an
anchored or moored boat.
.§ 32-35. Water-skiers.
A. No person shall operate a vessel for towing a person on
water skis, a surfboard or similar device unless there is
in such boat or vessel a person, other than the operator, •
of at least ten (10) years of age, in a position to observe
the progress of the person being towed. [Amended

B. No person shall ride on water skis, a surfboard or similar
device, or use or operate a boat to tow a person thereon,

between the period of one ¢(1) hour after sunset and one
(1) hour after sunrise. [Amended 3-7-1961]
C. Permitted areas.
(1) No person shall ride on water skis, surfboard or
similar device or use or operate a boat to tow a
person thereon within one hundred fifty (150) feet of
• any public or semipublic bathing beach or public
dock or within fifty (50) feet of any swimmer or
bather or moving or anchored boat, nor shall any
such persons engaged in such activities come within
three hundred (300) feet of the shoreline unless they
approach or depart perpendicularly to or from the
shoreline solely for the purpose of commencing or
ending the ride. [Amended 8-28-1990 by L.L. No.

(2) [Added 5-20-1992 by L.L. No. 10-19921 The
following regulations shall apply only to Hay
Harbor:
(a) Water skiing is permitted after 5:00 p.m. on
weekdays and all day Saturday and Sunday
unless organized waterfront activities are
planned by the Hay Harbor Club.
(b) Water skiers will follow a pattern established
by the first boat to start skiing, i.e., clockwise or
counterclockwise.
(c) Skiers will remain a minimum of one hundred
(100) feet from any dock or shoreline.
D. No person shall be towed on water skis, surfboard,
inflatable parasail or similar device, unless such person
is wearing a Coast Guard approved personal flotation
40 device of Type I, II or III. [Added 8-28-1990 by L.L. No.

E. No person shall be towed on water skis, surfboard,
inflatable parasail or similar device or use or operate a
boat to tow a person thereon between the period of

sunset to- sunrise or during periods of limited visibility.

§ 32-36. Speed limits; manner of operation.
A. The Town Board of the Town of Southold may, by
resolution, limit the speed of boats in any waters to •
which this Article applies and shall cause notice of such
speed limit to be posted at appropriate places in the
areas affected. Any person who shall operate a boat in
such areas at a greater speed than the speed specified in
such notice shall be deemed to have violated this Article.
B. Every person operating a boat shall at all times operate
the same in a careful and prudent manner and at such a
rate of speed as not to unreasonably interfere with the.
free and proper use of the waters or unreasonably
endanger any person or property.
C. Except where lower maximum speed limits have been
posted, no boat shall be operated in excess of forty-five
(45) miles per hour in the waters of the Town of

D. No boat shall be operated in such a manner as to throw
up a wake which could be dangerous to life or limb of a
person, boat or other property. [Added 8-28-1990 by

E. All commercial jetski or commercial windsurfing
operators shall provide a patrol boat (other than a jetski
or windsurfer) which must be operational and manned at
all times for the purpose of controlling their clientele.

F. All commercial jetski and windsurfer operators shall
require their clientele to wear United States Coast
Guard approved personal flotation devices of Type I, II or

the federal anchorage area located near the head of said creek.
The Town Board of Trustees shall cause said anchorage area to
be suitably designated by appropriate buoys or markers and
shall also cause suitable signs to be placed at appropriate
locations in said creek to direct boaters to such anchorage area.
• § 32-39.2. Anchoring and mooring in West Harbor and
Hay Harbor. [Added 5-10-1983 by L.L. No.

A. [Amended 5-31-1994 by L.L. No. 12-19941 All boats
temporarily anchored in West Harbor and Hay Harbor at
.Fishers Island shall anchor in an area assigned by the
Fishers Island Harbor Committee.
(1) Anchoring shall not be permitted for a continuous
period of more than three (3) days unless authorized
by the Bay Constable, which authorization may only
be granted for emergency situations.
B. Permanent moorings in West Harbor and Hay Harbor at
Fishers Island.
(1) All permanent moorings shall be located south of
Buoy No. 8.
(2) No permanent mooring shall be placed unless
authorized by a permit duly issued by" a Bay
Constable or Deputy or Assistant Bay Constable.
(3) [Amended 11-13-1990 by L.L. No. 25-1990;
11-24-1992 by L.L. No. 28-19921 The following fees
shall be paid for the issuance of a mooring permit:

(4) All mooring permits shall expire on December 31 of
the year of issuance.
(5) The location of each mooring shall be assigned by
the ,Fishers Island Harbor Committee, which shall
be appointed by the Town Board. [Amended

(6) All mooring buoys shall be assigned a number which
shall be affixed to the buoy by the permittee in
numbers at least five (5) inches in height.
§ 32-393. Mooring permits. [Added 4-5-1994 by L.L. No.
3-19941
A. The Town of Southold permits the installation of
moorings for boats in specified locations of town waters.
The use of moorings has increased to such an extent
that the number of moorings has begun to impair the
fragile marine environment in the surrounding town
waters. The Town Board therefore declares it to be the
policy of the town to restrict and regulate the issuance
of mooring permits as described herein.
B. Resident mooring permit.
(1) A resident mooring permit shall be issued by the
Town Trustees to all persons who are qualified
residents of the Town of Southold. Persons applying
for a resident mooring permit shall be requested to
sign an application in affidavit form and submit for
inspection one (1) of the following as proof of
residence:
(a) A valid tax receipt stub for the current year
for any taxable.real property within the Town

(42) Old Harbor Road, Cutchogue Harbor, New Suffolk,
along both sides from the terminus north for a
distance of one hundred fifty (150) feet.
(43) Third Street, Cutchogue Harbor, New Suffolk, along
both sides from the terminus north to Jackson
Street.
(44) The Anchorage, Mattituck Creek, Mattituck, along
both sides from the terminus east to Woodcliff Drive.
(45) Bailie Beach Road, Long Island Sound, Mattituck,
along both sides from the terminus south for a
distance of five hundred (500) feet.
(46) Bay Avenue, Peconic Bay, Mattituck, along both
sides from the terminus north to Peconic Bay
Boulevard.
(47) Bayview Avenue, also known as "Shore Acres,"
Mattituck Creek, Mattituck, along both sides from
the terminus west for a distance of two hundred fifty
(250) feet.
(48) Inlet Drive, Long Island Sound, Mattituck, along
both sides from the terminus south to Sound Beach
Drive.
(49) Knollwood Lane, Mattituck Creek, Mattituck, along
both sides from the terminus east for a distance of
one hundred eighty (180) feet.
(50) Sigsbee Road, Peconic Bay, Mattituck, along both
sides from the terminus north to Peconic Bay
Boulevard.
(51) Sound Beach Drive, Long Island Sound, Mattituck,
along both sides from the terminus south for a
distance of fifty (50) feet, then east for a distance of
two hundred (200) feet.
C. The following boat ramp areas are hereby designated as
Town of Southold "Parking by Southold Town Permit
Only" areas:

(1) King Street, also known as "Hog Pond Road," Orient
Harbor, Orient, along both sides from the terminus
north for a distance of three hundred (300) feet to
Harbor Road.
(2) Narrow River Road, Hallock's Bay, Orient, parking
area on south side known and referred to herein as
"Narrow River Road Launching Ramp" and along
both sides of Narrow River Road for a distance of
three hundred fifty (350) feet north and three
hundred fifty (350) feet south of the entrance for the
parking area.
(3) Bay Avenue, Gardiners Bay, East Marion, along
both sides from the terminus north to the bridge.
(4) Pipe's Neck Road, Greenport, along both sides from
the terminus north three hundred (300) feet.

north to Lake Drive.
(8) Minnehaha Boulevard, also known as "Nokomis

After removal of any vehicle as provided in this Article or the
removal, seizure, storage and/or impoundment of any vehicle
pursuant to any other provision of law, the police officer may store or
cause such vehicle to be stored in a suitable place at the expense of the
owner. Such owner or person in charge of the vehicle may redeem the
same upon payment to the Southold Town Police Department of the
amount of all expenses actually and necessarily incurred in effecting
such removal, such removal charges not to exceed seventy-five dollars
($75.) from 6:00 a.m. to 8:00 p.m. and not to exceed one hundred
dollars ($100.) from 8:00 p.m. and 6:00 a.m., together with any charges
for storage, such storage charges not to exceed eight dollars ($8.) per
day or fraction thereof.
§ 92-52. Notice of removal.
The Southold Town Police Department shall ascertain, to the
extent possible, the owner or person in charge of such vehicle and
notify him of the removal and disposition of such vehicle and of
the amount which will be required to redeem the same.
ARTICLE VI
Penalties
§ 92-60. Penalties for offenses.
Every person convicted of a traffic infraction for a violation of
any provision of this chapter which is not a violation of any
provision of the Vehicle and Traffic Law of the State of New York
shall, for a first conviction thereof, be punished by a fine of not
more than fifty dollars ($50.) or by imprisonment for not more
than fifteen (15) days, or by both such fine and imprisonment; for
a second such conviction within eighteen (18) months thereafter,
such person shall be punished by a fine of not more than one
hundred dollars ($100.) or by imprisonment for not more than
forty-five (45) days, or by both such fine and imprisonment; upon

a third or subsequent conviction within eighteen (18) months after
the first conviction, such person shall be punished by a fine of not
more than two hundred fifty dollars ($250.) or by imprisonment

DEDICATION — The conveyance of a fee or lesser
interest in property to public use, which precludes the
owner or others under him from asserting any right of
ownership inconsistent with the use for which the
property is dedicated.
DWELLING, MULTIPLE — A building or portion
thereof containing three (3) or more dwelling units,
DWELLING, ONE -FAMILY — A detached building
containing one (1) dwelling unit only consisting of a
minimum living area of eight hundred fifty (850) square
feet. [Amended 4-24-1990 by L.L. No. 8-19901
DWELLING, ROW OR ATTACHED — A one -family
dwelling with two (2) common or party walls separating
it from adjacent units on both sides.
DWELLING, SEMIDETACHED — A one -family
dwelling with one (1) wall in common with an adjacent
dwelling.
DWELLING, TWO-FAMILY — A detached building
containing two (2) dwelling units only.
DWELLING UNIT — A building or entirely self-
contained portion thereof consisting of a minimum living
area of eight hundred fifty (850) square feet containing
complete housekeeping facilities for only one (1) family,
including any domestic servants employed on the
premises, and having no enclosed space, other than
vestibules, entrance or other hallways or porches, or
cooking or sanitary facilities in common with any
"dwelling unit." A house trailer, a boarding- or rooming
house, convalescent home, fraternity or sorority house,
(� hotel, motel, inn, lodging or nursing or similar home or
other similar structure shall not be deemed to constitute

FAMILY — One (1) or more persons occupying a dwelling
unit as a single nonprofit housekeeping unit. -More than
five (5) persons eighteen (18) years of age or older,
exclusive of domestic servants; -not related by blood,
marriage or adoption shall not be considered a "family."
FARM— A. site or series of adjoining parcels under
single ownership or management devoted to agricultural
use.
FARM BUILDINGS — All- structures useful or necessary
for the conduct of agricultural activities, including but
not limited to barns, silos, mechanical equipment storage
sheds, animal pens or other shelters.
FENCE — A vertical enclosure, solid or partially open, to
prevent straying from within or intrusion from without
or intended to be used as a visual screen. A "fence" is
considered a structure for the purposes of this. chapter.
FISH PROCESSING — The readying of fish and
shellfish for shipping to market, including icing,
cleaning, filleting, shucking and the cooking of crabs or
lobster, but not including other cooking, canning,
freezing, smoking or other fish factory operations.
FLEA MARKET — An out-of-doors market operated only
during daylight hours where new or used items are sold
from individual locations, with each location being
operated independently from other locations. Items sold
include but are not limited to household items, antiques,
rare items, decorations, used books and used magazines.
This shall not include sales by a nonprofit organization

FLOODPLAIN — The relatively flat area or low lands
adjoining the channel of a river, . stream, watercourse,
canal or any body of standing water which has been or
may be covered by floodwater.
FLOOR AREA — The sum of the gross horizontal areas
of all floors of the building or buildings on a lot, having a
clear height of not less than six (6) feet measured from
the exterior faces of exterior walls or from the center line
of party walls separating two (2) buildings, including
cellar and basement areas. The "floor area" shall not
include roof overhangs projecting less than three (3) feet
or any floors or portions thereof contained on terraces or
balconies projecting beyond the exterior face of the
building.

F. Notwithstanding the limitations imposed by any other
provisions of this chapter, no building, dredging or filling
operation shall be permitted below the datum of mean
high water of tidal waters unless such building, dredging
• or filling operations have been duly authorized and are
conducted in conformity with all laws, ordinances, rules
and regulations of all governmental agencies having
jurisdiction thereof.2
§ 100-24. Lot creation. [Added 11-28-1995 by L.L. No.,
23-1995]
A. A lot created by deed or town approval shall be
recognized by the town if any one (1) of the following
standards apply and if the lots have not merged:
(1) The identical lot was created by deed recorded in the
Suffolk County Clerk's office on or before June 30,
1983, and the lot conformed to the minimum lot
requirement(s) set forth in Bulk Schedule AA3 as of
the date of lot creation.
(2) The lot(s) in question is/are approved by the
Southold Town Planning Board.
(3) The lot(s) in question is/are shown on a subdivision
map approved by the Southold Town Board prior to
June 30, 1983.
(4) The lot(s) in question is/are approved and/or
recognized by formal action of the Board of Appeals
prior to June 30, 1983.

B. All lots which are not recognized by the town pursuant to
the above section shall not receive any building permits
or other development entitlements.
C. All lots are subject to the merger provisions of § 100-25.
§ 100-25. Merger. [Added 11-28-1995 by L.L. No. 23-19951 •
A. Merger. A nonconforming lot shall merge with an
adjacent conforming or nonconforming lot which has
been held in common ownership with the first lot at any
time after July 1, 1983. An adjacent lot is one which
abuts with the parcel for a common course of fifty (50)
feet or more in distance. Nonconforming lots shall merge
until the total lot size conforms to the current bulk
schedule requirements.
B. Definitions. "Common ownership" shall mean that the
parcel is held by the same person in the same percentage
of ownership as an adjoining parcel.
C. Exceptions. Lots which are recognized under § 100-24
and meet any of the following categories shall be exempt
from the merger provision set forth above and shall not
be deemed merged by operation of this chapter:
(1) The nonconforming lot has a minimum size of forty
thousand (40,000) square feet, or
(2) The nonconforming lot obtained a lot size variance
from the Zoning Board, or
(3) If the lot is not on the maps described in former
§.100-12,4 the nonconforming lot has been held in
single and separate ownership from July 1, 1983 to
date, or 0

C. Trees used in parking lots shall include honey locust,
pine, oak or other similar fast-growing, hardy varieties
or existing trees where appropriately located.
§ 100-215. Properties located adjacent to creeks.
• The rear yards of properties located adjacent to creeks shall
include natural vegetation and/or shall contain suitable planted
vegetation to a minimum of twenty (20) feet inland from the
mean high -water -line elevation or wetland boundary to prevent
erosion of the shoreline. Vegetation within the buffer strip shall
not be fertilized or chemically treated.

Supplementary Regulations

§ 100-230. Exceptions and modifications.
A. Established front yard setback. Where property in the
vicinity is improved with principal buildings with front
yards of less than that required by the provisions of this
chapter, the front yard setback shall be the average
setback of the existing buildings within three hundred
(300) feet of the proposed building on the same side of
the street within the same use district.
B. Exceptions to lot depth requirements. The minimum lot
depth at any point may be decreased to seventy-five
percent (75%) of the minimum requirement if the
average depth conforms to the minimum requirement.
C. Exceptions to yard requirements.

(1) Permitted obstructions. Cornices or cantilevered
roofs may project not more than two (2) feet into a
required yard. Belt courses, windowsills and other
ornamental features may project not more than six
(6) inches into a required yard. Fences or walls not
over four (4) feet in height may be erected anywhere
on the lot, except as set forth in § 100-232 herein.
Paved terraces, steps and walks (other than such as
are needed for access to the buildings on the lot)
shall not project within fifteen (15) feet of a street
line or four (4) feet of a property line.
(2) Entries and porticos. A roofed -over but unenclosed
projection in the nature of an entry or portico, not
more than six (6) feet wide and extending not more
than five (5) feet out from the front wall of the
building, shall be exempt from the requirements of
this section when the building otherwise complies
with the regulations of this section. In computing
the average setback, the presence of such entries
and porticos shall be ignored. [Amended 7-13-1993

(3) Permitted projections. In any district, chimneys on
residential, public or semipublic buildings may
project into a required yard to the extent of not more
than two (2) feet. In .any residential district, terraces
or steps may project into any required yard,
provided that no part thereof is nearer than four (4)

D. Height exceptions. The height limitations of this chapter
shall not apply to:
(1) Spires, belfries, cupolas and domes not for human
occupancy; and monuments, transmission towers,
