Amendments noted where ap- plicable.] ARTICLE I General Regulations [Adopted 6-8-76 as L.L. No. 1-19761 § 38-L Prohibited activities. It shall be unlawful for any person owning or harboring any' dog in the Town of Southold to permit or allow such dog to: 3801 11-25-78 § 38-1 SOUTHOLD CODE § 38-4• r A. Run at large elsewhere than upon;the'premises of the owner' or custodian unless said' dog: shall be on a leasli'.of ac- companied by a-person at least twelve' (12) years, of age,- having'adequate control of such dog, or'unless it:be upon the premises of another person with the knowledge arid' consent, of such ,person. For the purpose' of this Article, a dog, or dogs' hunting in company with a hunter or -hunters shall be considered as accompanied by, their owners:. B. Engage, in habitual howling or barking or conduct itself in such a manner as to habitually annoy any person other than the' owner or person 'harboring such dog:' C. Cause damage or destruction to property other than the property of, the owner or person harboring such dog. D..Chase or ,otrherwise harass-any person in such manner as reasonably' to,cause intimidation•or to put such person in reasonable ' apprehension of bodily harm. or injury. § 38-2. Enforcement. TheDog'Warden shall enforce the provisions of this Article. § 384. Filing of complaints. Any person who observes a dog, causing damage or destruction to the property of a person other than its owner or one harboring.a dog, or causing anannoyance to a person other, than its owner or one harboring.a dog,. may file a signed complaint, under oath, with a Town Justice 'of; the Town' of Southold specifying: the, ob- jectionable conduct of the dog, the date thereof; the, damage caused, a description of the dog and the name- and residence, if, known, of the owner or other person harboring said dog-. § 38-4. Summons; arrest warrant. Upon receipt by the Town Justice of any' complaint. against the - conduct of any particulafdog, the Town Justice may summon the s 3802' 11-25-78 § 38-4 DOGS § 38-8 alleged owner' or other person harboring said dog to appear in person before him. If the summons is disregarded, the Justice may permit the filing'of an information and issue a warrant for the arrest of such person. § 38-5., Seeing Eye dogs exempted. This Article shall notapply to Seeing Eye dogs during such time as such dogs are performing the functions for .which they are trained. § 38-6. Seizure of dogs at large. Any dog found at large, not under effective restraint or in the immediate custody and control of the responsible person; may be seized by a duly appointed Dog Warden or.other duly appointed officer of the Town of Southold, confined and impounded. § 38-7. Confinement; redemption; disposition. Any dog impounded under the provisions of this Article shall be confined in accordance with the provisions of the Agriculture and Markets Law of the State of New York and may be redeemed by the owner or harborer thereof .upon payment to the Town Clerk or Dog Warden of the sums set forth in the Agriculture and Markets Law. Any dog not so redeemed shall at the option of the Dog Warden be sold at public 'or private sale or be destroyed or given to a, recognized society for the care and welfare of dogs. All proceedings shall be in accordance with the provisions of the Agriculture and_Markets Law of the State of New York. 0 § 38-8. Penalties for offenses. Any person committing an offense against any provision of this Article shall, upon conviction thereof, be guilty ' of a violation punishable by a fine not exceeding two hundred fifty dollars ($250.) or by imprisonment for a term not exceeding fifteen (15) days, or by both such fine and imprisonment. r 3803 11-25-78 § 38-9 SOUTHOLD .CODE § 38-11 § 38-9. Severability. .The invalidity of any section, provision or portion of this Article shall not invalidate any other section, provision or remaining portion thereof. I. § 38-10. When effective. This Article shall take effect ten (10) days after its adoption. ARTICLE II Fees [Adopted 9-26=78 as L.L. No. 5-1978] § 38-11. License fees. A. Commencing on the effective, date of this Article and until September 30, 1979; the license fee for dogs, in addition to other statutory charges, is hereby set as follows: (1) Five dollars ($5.) for a male dog and spayed female dog. (2) Ten dollars ($10.) for an unspayed female dog. B. Commencing on October 1, 1979, the license fee for dogs shall be as follows: (1) . Five dollars ($5.) for a spayed or neutered dog. ARTICLE I Catching of Shrimp [Adopted by Board of Trustees 6-29-331 § 77-100. Taking of shrimp by nonresidents prohibited. It shall be unlawful for any person not a resident of the Town of Southold to take shrimp from the waters of Brush's Creek, Willes Creek, Downs Creek, James Creek, West Creek, Richmond's Creek, Corey's Creek, Cedar Beach Creek, Goose Creek, Jockey Creek, Town Creek, Mill Creek, Long Creek, Budd's Pond, Dam Pond, Mattituck Creek, Goldsmith's Creek, Squash Creek, Wickham's Creek and Little Creek, or other creeks or inland waters within the bounds of said township. § 77-101. Residence requirements. i Persons shall be deemed to be residents of the Town of Southold at any given date, within the meaning of this Article, when they shall have actually and continuously resided within the said town for a period of at least six (6) months immediately preceding such date. § 77-102. Effect. No provision of this Article . shall be deemed to prevent any person or persons residing within the Town of Southold from angling for fish for other than commercial purposes. § 77-103. Penalties for offenses. Any violation of this Article shall be subject to a penalty of not less than five dollars ($5.) nor more than one hundred dollars ($100.) and costs. 7702 § 77-200 SHELLFISH § 77-201 ARTICLE II Taking of Shellfish [Adopted by Town Board 6-23-661 § 77-200. Title. This Article shall be known as the "Shellfish Ordinance of the • Town of Southold." § 77-201. Definitions. For the purposes of this Article, the terms used herein are defined as follows: COMMERCIAL PURPOSES — Any use or purpose other than for food consumption by the persons taking the shellfish or by members of such person's household. GUEST — A person who occupies living quarters in a _ dwelling maintained by a permanent resident. PERMANENT RESIDENT — A person who has maintained a permanent dwelling within the Town of Southold during the period of not less than sixty (60) days immediately preceding the date of his application for a permit hereunder, or the date of taking shellfish if no permit is required. SHELLFISH — Clams, scallops, oysters, blue claw crabs and mussels. TEMPORARY RESIDENT — A person who has occupied living quarters within the Town of Southold during the period of not less than seven (7) days immediately preceding the date of his application for a permit hereunder. TOWN WATERS — All waters and lands under tidewater in any harbor, bay or creek, title to which and the right of fishing in which is vested in the Town of Southold and/or in the Board of Trustees of the Town of Southold. 7703 1 77-202 SOUTHOLD CODE § 77-208 § 77-202. Permit requirements. A. Shellfish may be taken from town waters for commercial purposes by a permanent resident over the age of sixteen (16) years upon first obtaining a commercial shellfish permit therefor from the Town Clerk of the Town of Southold. B. Shellfish may be taken from town waters by a temporary • resident upon first obtaining a temporary resident shellfish permit therefor from the Town Clerk of the Town of Southold. C. Shellfish may be taken from town waters for non- commercial purposes by a permanent resident without obtaining a permit therefor. D. Shellfish may be taken from town waters for non- commercial purposes without obtaining a permit therefor by a guest when accompanied by a permanent resident in whose dwelling such guest occupies living quarters. E. No person not a permanent resident, a temporary resident or a guest accompanied by a permanent resident shall take shellfish in any manner at any time from town waters. F. The presence of shellfish in excess of the limits, or of less size than that, set forth in this Article, found aboard any boat or vessel in the waters of the Town of Southold, shall be deemed presumptive evidence of a violation of this Article. § 77-203. Permit fee; expiration; display. A. The fee for a commercial shellfish permit shall be five dollars ($5.). Such permit shall expire on December 31 of the year of issue. B. The fee for a temporary resident shellfish permit shall be five dollars ($5.). Such permit shall be issued only for the period of time that such temporary resident occupies living quarters within the Town of Southold., , 7704 �J § 77-203 SHELLFISH § 77-204 C. The holder of a shellfish permit shall carry the permit assigned to him on his person while engaged in the per- mitted activities, and the failure of such holder to exhibit his permit to an enforcement officer shall be presumptive evidence that no valid permit has been issued to him. • § 77-204. Scallops. A. Scallops may not be taken from town waters during the period from April 1 to the third Sunday in September in each year, both dates inclusive. B. Subject to the provisions of this section, during the period from the first Monday after the third Sunday in September to October 9 in each year, both dates inclusive, not more than two (2) pecks of scallops may be taken from town waters in any one (1) day by hand or with a scalp net. C. Subject to the provisions of this section, during the period from October 10 to March 31, both dates inclusive, scallops ( may be taken from town waters with a dredge or scrape ' having an opening at the mouth of not more than thirty-six (36) inches in width when towed by a boat operated by mechanical power or other means, provided that such dredge or scrape is brought aboard the boat by hand power without the use of a mechanical device. - D. Subject to the provisions of this section, a permanent resident, temporary resident or a guest, when accompanied by a permanent resident, may take from town waters not more than two (2) pecks of scallops in any one (1) day for other than commercial purposes. E. Subject to the provisions of this section, not more than ten (10) bushels of scallops may be taken from town waters for commercial purposes in any one (1) day by any one (1) person. Two (2) or more persons occupying the same boat may take, in the aggregate, not more than twenty (20 ) bushels of scallops in one (1) day for commercial purposes. F. Scallops shall not be taken from town waters during the period from sunset to sunrise. 7705 § 77-204 SOUTHOLD CODE § 77-206 G. Scallops shall not be taken from town waters on Sundays except by hand or with a scalp net. . H. Only scallops having an annual growth line or measuring more than two and one-fourth (21/a) inches from the middle of the hinge to the middle of the bill may be taken from town waters. § 77-205. Clams. A. Hard clams less than one (1) inch in thickness shall not be taken from town waters-: B. Soft or steamer clams less than two (2) inches in the longest diameter shall not be taken from town waters. C. Churning by power may be employed in the taking of soft clams on land below low -tide line in town waters. D. A permanent resident, a temporary resident or a guest accompanied by a permanent resident may take not more than two (2) pecks of clams from town waters in one (1) day for noncommercial purposes. § 77-206. Oysters. A. Oysters shall not be taken from town waters during the period from May 1 to August 31 in each year, both dates inclusive. B. Oysters shall not be taken from town waters during the period from sunset to sunrise. C. Only oysters measuring more than three (3) inches from the hinge to the bill may be taken from town waters. D. A permanent resident, a temporary resident or a guest accompanied by a permanent resident may take not more than two (2) pecks of oysters from town waters in any one (1) day for other than commercial purposes. E. Not more than five (5) bushels of oysters may be taken from town waters for commercial purposes in one (1) day 7706 § 77-206 SHELLFISH § 77-209 by any one (1) person. Two (2) or more persons occupying the same boat may take, in the aggregate, not more than ten (10) bushels of oysters in one (1) day for commercial purposes. • § 77-207. Blue claw crabs. A. Blue claw crabs measuring less than five (5) inches from point to point of the upper shell shall riot be taken from the waters of the Town of Southold. B. A permanent resident, a temporary resident or a guest accompanied by a permanent resident may not take more than one-half ('/z) bushel of blue claw crabs from town waters in any one (1) day for noncommercial purposes. C. Female blue claw crabs with eggs visible thereon, com-' monly called "sponge crabs," shall not be taken from the waters of the Town of Southold. o_ § 77-208. Mussels. A. A permanent resident, a temporary resident or a guest accompanied by a permanent resident may not take more than one (1) bushel of mussels from town waters in one (1) day for noncommercial purposes. B. Not more than ten (10) bushels of mussels may be taken from town waters for commercial purposes in one (1) day by any one (1) person. Two (2) or more persons occupying the same boat may take, in the aggregate, not more than twenty (20) bushels of mussels in one (1) day for com- 9 mercial purposes. § 77-209. Culling shellfish and restoration of underwater lands. A. Shellfish shall be culled when taken. All shellfish taken which do not comply with the provisions of this Article shall be immediately returned alive to the water. 7707 (,' § 77-209 SOUTHOLD CODE § 77-212 B. All lands under town waters disturbed by the taking of shellfish shall be restored to their condition prior to the taking of such shellfish by the person taking such shellfish. § 77-210. Restricted areas. Shellfish shall not be taken from any town waters which have _ • been restricted by the Town Board of Trustees, provided that such restricted areas shall have been properly designated by a resolution duly passed by said Board of Trustees and properly staked, and notices posted by said Board of Trustees. § 77-211. Transplanting of shellfish. Notwithstanding any other provision of this Article, the Town Board of Trustees may authorize the transplanting of shellfish in town waters of any age or size, subject to its supervision, when it shall find that such shellfish are in danger of destruction as the result of predators or other causes. § 77-212. Penalties for offenses. A. Any person convicted of an offense against any provision of this Article shall be deemed to have committed a violation against such Article and also shall be liable for any such offense or penalty therefor. B. For every offense against any provision of this Article, the person committing the same shall be subject to a fine of not more than two hundred fifty dollars ($250.) or . im- prisonment not exceeding fifteen (15) days, or both such fine and imprisonment. C. A second conviction for an offense against any of the provisions of this Article within a period of one (1 ) year shall constitute and effect an immediate forfeiture of a permit issued to such person. No new permit shall be issued to such person for at' least one (1) year after such forfeiture. 7708 § 77-212 SHELLFISH § 77-212 D. Any person committing an offense against this Article shall be subject to a civil penalty enforceable and collec- tible by the town for each such offense. Such penalty shall be collectible by and in the name of the town. E. After removal of any vehicle as provided in this Article, the police officer may store or cause such vehicle to be stored in a suitable place at the expense of the owner. Such owner or person in charge of the vehicle may redeem the same upon payment to the Southold Town Police Department of the amount of all expenses actually and necessarily incurred in effecting such removal, such removal charges not to exceed twenty-five dollars ($25.), together with any charges for storage, such storage charges not to exceed two dollars ($2.) per day or fraction thereof. § 92-52. Notice of removal. The Southold Town Police Department shall ascertain, to the extent possible, the owner or person in charge of such vehicle and notify him of the removal and disposition of such vehicle and of the amount which will be required to redeem the same. ARTICLE VI Penalties § 92-60. Penalties for offenses. Every person convicted of a traffic infraction for a violation of any provision of this chapter which is not a violation of any provision of the Vehicle and Traffic Law of the State of New York shall, for a first conviction thereof, be punished by a fine of not more than fifty dollars ($50.) or by imprisonment for not more than fifteen (15) days, or by both such fine and imprisonment; for a second such conviction within eighteen (18) months thereafter, such person shall be punished by a fine of not more than one hundred dollars ( $100.) or by imprisonment for not more than forty-five (45) days, or by both such fine and imprisonment; upon a third or subsequent conviction within eighteen (18) months after the first conviction, such person shall be punished by a fine of not more than two hundred fifty dollars ($250.) or by imprisonment for not more than ninety (90) days, or by both such fine and imprisonment. 9231 § 100-114 ZONING § 100-114 D. F. The following processes: ` (1) Nitrating of cotton or of other materials. (2) Milling or processing of flour. (3) Magnesium foundry. (4) Reduction, refining, smelting and alloying metal or metal ores. (5) Refining secondary aluminum. (6) Refining petroleum products, such as gasoline, kerosene, naphtha, lubricating oil. (7) Distillation of wood or bones. (8) Reduction and 'processing of wood pulp and fiber, including paper mill operations. G. Storage of explosives. I. Quarries. § 100-115. Junkyards. Notwithstanding any other provisions of this chapter, all automobile yards or other junkyards in existence at the effective date of this chapter, as first enacted in 1957, shall, within three (3) years from such date, provide suitable screening in the form of fencing or hedges completely around the periphery of the area used for such purposes, and the type of fencing and hedges shall be subject to the approval of the Board of Appeals.' e § 100-116. Dwelling unit density. Notwithstanding any other provision of this chapter, each dwelling unit in a multiple dwelling shall have nine thousand ( 9,000) square feet of land for each dwelling unit in the building where public water and public sewer are not provided, and shall have six thousand five hundred (6,500) square feet of land for each dwelling unit in the building where public water and public sewer are provided.19 § 100-117. Hotel and motel unit density.
