The Planning Department conducted a final site inspection of the LTE modifications
referenced above on July 17, 2018.
Based on that site inspection, we have received a report from our consultant stating that
all changes and modifications have been constructed in accordance with the provided
construction drawings.
We have found that the LTE modifications and up-grades are in compliance with the
General Requirements of §280-70, therefore, we recommend a Certificate of
Occupancy be issued for this application.

.application and the submission from your office of Check #5157, $4,000.00 was placed
into an escrow account with the Town Comptroller's Office to cover the cost of the
review by CityScape Consultants.
Enclosed please find a copy of Amato Law Group Check #5157 with the memo
transmitting it to our Accounting Department, the Purchase Order #28127, the Voucher,
the invoice from CityScape Consultants, Inc., a copy of their report dated 6/1/15 and a

As an addendum to the attached Site Plan Use Determination, the Planning Department
has conducted a review of the proposed modifications pursuant to §280-74 B.(2), and
has received a report from our Wireless Technical Consultant, Cityscape, Inc. (see
attached report). We have the following recommendations for this application:
The proposed Verizon modifications and up -grades are in compliance with the General
Requirements of §280-70, therefore, we recommend a Building Permit be issued for this
application with the conditions listed below, and in accordance with the Structural
Analysis Report, dated January 9, 2013, the Structural Evaluation, dated April 20, 2015
and the RF Compliance Assessment and Report, dated March 30, 2015:
Conditions:
1. The Building Permit must state the following:
a. All feed lines shall be installed inside the monopole structure as approved;
b. Prior to the issuance of a Certificate of Occupancy, the Planning
Department is required to verify that the condition detailed above has
been met.

At your request, on behalf of the Town of Southold, New York, ("Town") Cityscape
Consultants, Inc. ("CityScape") in its capacity as telecommunications consultant for the Town,
has considered the merits of an application provided by Verizon Wireless ("Applicant") to
modify their facilities on an existing ninety (90) foot concealed slick -stick support structure
owned by American Tower Company ("Tower Owner) and located at 23300 Main Road in
Orient Point, New York, see figure 1.
All wireless service providers are in the process of upgrading and modifying equipment
in an attempt to maintain their current subscriber base while simultaneously providing improved
and advanced services. Verizon, T -Mobile and AT&T have been most active with these types of
upgrades in the eastern half of the United States with Verizon and T -Mobile launching more
high-speed wireless broadband services over other carriers. Short-term system modifications are
underway to overcome current over -capacity problems while future facilities will be
concentrating more towards the wireless Internet electronics as more spectrum is being delivered
to meet consumer demands.
The Applicant's proposed modifications are intended to provide Verizon subscribers with
newer technologies known as fourth generation (4G) LTE, better identified as high-speed
wireless broadband. The Applicant has proposed to abandon the concealment canister at the
sixty-five (65) foot level and remove six (6) existing antennas and the twelve (12) feed lines.
The Applicant will replace the six (6) antennas with three (3) new antennas, and six (6) TMA's
(top mounted amplifiers) in the top concealment canister at the eighty-four feet and four inches
(84.4') height of the support structure. The Applicant will replace the twelve (12) existing 7/8"
coax feed lines at sixty-five (65) feet with twelve (12) new 7/8 inch coax feed lines to the new
top mounted antennas. Also collocated on the pole is, AT&T which will remain in the center
canister located at 75 feet as well as the Orient Fire Department with equipment (2 short stub
antennas and 2 whip antennas) for public safety located at approximately fifty-two (52) foot level
and an existing double whip antennas mounted at ninety (90) feet. There will be no visible
changes to the concealment structure; see final pole configuration as noted in figure 2.

The Applicant provided a minimal Structural Evaluation statement dated April 20, 2015
that did not include any actual tower stress rating analysis but claimed the facility was adequate
for the proposed loads. CityScape reviewed the previous Structural Analysis dated January 9,
2013 which reported a final tower rating of 99% out of an allowable maximum of 105%. Since
the Applicant will be removing equipment and replacing feed lines, CityScape considers the
stress level will remain reasonably consistent at 99%; see figure 3. It's also important to note that
the overturn moment of a waving flag has more loading concerns than the weight of any internal
antennas and feed lines. The pole was designed to support the additional loading caused by a
Rag which is greater than any internally mounted antennas and feed lines.
In addition to the structural statement the Applicant supplied a previous RF Compliance
Assessment and Report dated March 30, 2015, with a calculations table indicating the human
exposure concerns will not be an issue and the Applicant will be in compliance with applicable
FCC rules regarding human exposure to RF energy; see figures 4 and 5. The proximity of all the
existing and proposed antennas including the Orient Fire Department antennas will not create a
potential health risk to humans according to the FCC OET Bulletin 65; Supplemental C;
categorical exclusion. The last visit at the site by Cityscape found the main gate open and not
secure, see figure 6. CityScape recommends the Applicant and Tower Owner be advised of the
potential lack of security at the facility.
Under the Middle Class Tax Relief and Job Creation Act of 2012 ("The Act") any
personal wireless facility collocation, modification or upgrade may qualify for streamlined
processing and administrative approval if the request does not increase the structure height and
girth by 10% or 20 feet, whichever is greater, and does not require any excavation outside the
existing ground compound. The Act further states that if an application meets the criteria, the
application must be approved and cannot be denied. CityScape has determined the application,
herein complies with the Act and is qualified for streamlined processing.
The Applicant's proposed installation, if built as designed, will be in compliance of
applicable federal and local codes. It is the opinion of the undersigned the proposed
improvements are justified and will provide the Applicant's subscribers high-speed wireless
broadband service in and around the Town. Should the Town choose to approve the subject
application, Cityscape recommends approval with the following conditions:
1. All feed lines shall be installed inside the pole structure; and,
2. All concealment panels shall be sufficiently secured.

monopole owned by Crown Castle, and to lease a 167 x 35' parcel of land on which to locate an
equipment shelter. -'Access to -the leased premises will be provided via an existing_access'and

As per the above referenced Agreement between Town and Consultant, Consultant agrees to provide
a review and analysis for an Application known as "Orient" from Verizon Wireless for modifications
and upgrades to an existing tower located at 23300 Main Road, Orient, New York 11957, SCTM
#1000-18-5-13.8.
Review services for the Application will be performed at an agreed upon rate of four thousand dollars
($4,000). There will be no additional costs of fees associated with the review of this Application
and/or follow-up letters relating to this Application.
Consultant will provide the services as outlined in Exhibit A, Scope of Services, of the Agreement.

The Planning Department is in receipt of an application to up -grade and maintain an existing
Verizon facility and related equipment at the existing site referenced above. Pursuant to §280-
130A of the Southold Town Code, the Planning Department is required to provide a brief report
to the Building Department concerning the proposed wireless communications up -grades to
determine whether they meet the guidelines for wireless facilities.
Pursuant to §280-74A(d) of the Town Code, the Planning Board will hire a Technical Consultant
to aid in the review of the application and hereby requires the submission of $4,000.00 into an
escrow account with the Town Comptroller's Office to cover the cost of the Technical
Consultant's review.
Please remit a check in the amount of $4,000.00 payable to the Town of Southold.

d. Upon approval of this application, the Building Inspector, will issue a Building Permit to the applicant. Such a permit

e. No building shall be occupied or used in whole or in partifor any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

TERMS AND CONDITIONS
1. The TOWN OF SOUTHOLD is not responsible for materials, supplies or equipment delivered
or services performed without authority of written order. Quantities specified are not to be
exceeded.
2. No changes may be made in this order without written authority of the supervisor.
3. Inspection of delivery will be made at delivery point unless otherwise specified. Materials must
be properly packaged. Damaged material will not be accepted. Include itemized packing lists with
all shipments. Delivery indoors is required unless otherwise specified. All prices quoted must in-
clude shipping, handling, packing and crating charges and be F.O.B. delivered, unless other terms
are agreed to.
4. Substitutions of specified items will not be acceptable. The Town of Southold reserves the
right to reject and return at shippers expense, materials delivered which do not conform to de-
scription of item ordered.
5. If order cannot be filled in whole or in part in time specified, notify the town immediately. In
case of delay in delivery, or in case of any default of the vendor, the town may procure the goods
or services from other sources and hold the vendor responsible for any EXCESS COST, EX-
PENSE OR DAMAGES occasioned thereby.
6. Upon acceptance of this order the vendor agrees to comply with all Federal, State or local
laws relative thereto:
a. The vendor shall defend actions or ciairns brought and hold the Town of Southold, its
agents and its employees harmless from loss, suits, costs, rights, patent or patent rights of any
invention or any other cause.
b. The vendor represents and warrants that the unit prices charged herein are not higher than
any applicable legal maximum prices permitted, and are not in excess of those currently
charged to other governmental, institutional or commercial users for similar items, quantities
and deliveries.
c. Insofar as applicable, the Vendor shall comply with Sections 220, 220-a, 220-b, 220-c,
220-d, 220-e and 222 of the Labor Law of the State of New York relating to maximum work-
ing hours and minimum wages of employees and prohibiting discrimination on account of race,
sex, color, creed or national origin in hiring employees within the State of New York involved
in the manufacture of materials, equipment, or supplies specified in this order.
d. The vendor shall comply with Sections 103a and 103b of the General Municipal Law
pertaining to disqualifications of contractor for failure to waive immunity before Grand Jury.
7. INVOICES RENDERED ON ENCLOSED CLAIM FORM MUST BE ITEMIZED IN DETAIL.
Claims for partial deliveries are not allowed unless indicated. Claims in question will constitute a
condition precedent to the right of the vendor or receive any payment and matters of dispute
must be adjusted before final acceptance by the Town of Southold.
8. Billing shall allow for exemption from taxes under Federal Excise Tax Exemption Certificate
No. A-163554 held by the Town of Southold.
9. Cash discount terms must be indicated on claim voucher; discount period will be computed
from date of acceptance of delivery or receipt of a correct claim voucher, whichever is later.
10. The provisions of the New York State Fair Trade Law (Feld -Crawford Act) and the Federal
Price Discrimination Law (Robinson-Patman Act) do not apply to purchases made by the Town
of Southold.
