BOUNDARY LINE AGREEMENT
AGREEMENT made this j$1 day of May, 2015, between WALTER P. HENNESSEY
& MARIANNE FONTANA, residing at -PO-Bur-K. Cutchogue, NY 11935, hereinafter
referred to as Hennessey/Fontana, and 44 &0 Dq* Lane,
ELEANOR B. DE VECCHIS, residing at 4300 Depot Lane, Cutchogue, NY 11935,
hereinafter referred to as De Vecchis.
WITNESSETH
WHEREAS, Hennessey/Fontana is the owner of certain improved real property located
at 4460 Depot Lane, Cutchogue, NY, known and designated as SCTM # 1000-96-5-8
(hereinafter referred to as "Parcel A") and more particularly described in Schedule A annexed
hereto; and
WHEREAS, De Vecchis is the owner of certain improved real property located at 4300
Depot Lane, Cutchogue, NY, known and designated as SCTM # 1000-96-5-9 (hereinafter
referred to as "Parcel B") and more particularly described in Schedule B annexed hereto; and
WHEREAS, Nathan Taft Corwin Land Surveyor made a certain survey of Parcel A
dated February 16, 2000 updated May 3, 2015 (hereinafter "Survey") and annexed hereto as
Exhibit A; and
WHEREAS, the parties hereto desire to establish a common boundary line between
Parcel A and Parcel B;
NOW THEREFORE, in consideration of the sum of one ($1.00) dollar by each of the
parties hereto to the other in hand paid, the receipt of which is hereby acknowledged, the
parties hereto, their heirs, successors and assigns, agree as follows:
FIRST: The common boundary line dividing Parcel A and Parcel B begins at a point
255.28 feet southeasterly from the corner formed by the intersection of the Westerly side of
Depot Lane with the southerly side of Long Island Railroad, and is described as follows:
RUNNING THENCE North 46° 23'30" East 411.18 feet
SECOND: The Hennessey/Fontana quitclaims and releases to the De Vecchis, any and all J
claims of title and interest in and to any land lying to the south of said common boundary line, as
shown on the survey, and the De Vecchis quitclaims and releases to the Hennessey/Fontana, any
and all claims of title and interest in and to any land lying to the north of said common boundary
line, as shown on the survey;
THIRD: The De Vecchis acknowledges that a portion of a fence as shown on the survey
encroaches on Lot A by up to 6.0 feet North of the common boundary line.

IT IS MUTUALLY COVENANTED AND AGREED by and between the parties
,hereto that this agreement shall run with the land and shall be binding upon and shall inure to the
benefit of the respective heirs, successors and assigns of each of the parties.

and year first written above.
