§ 24-1, Purpose.
The purpose of this chapter is to establish standards and controls of
the various types of fire, intrusion, holdup and other emergency
signals from fire and police alarm -services that require Fire
Department or police responses, investigation or safeguarding of
property at the location of an event reported by a signal which is

transmitted by telephone or radio to the Police or Fire Department
from a central station as hereinafter defined.
§ 24-2. Definitions.
For the purpose of this chapter, the following definitions shall apply:
ALARM AGENT [Repealed 4-5-88 by L.L. No. 6-1988] •
ALARM INSTALLATION — Any fire or police alarm device
or aggregation of fire or police alarm devices installed on or
within a single building or on or within more than one (1)
building or area adjacently located on a common site at a
specific location.
BUSINESS LICENSEE-- Any business, firm, corporation
or other commercial entity which is in the business of owning,
operating, maintaining, installing, leasing or selling a fire or
police alarm device, or system of fire or police alarm devices,
which business, firm or corporation or other commercial entity
is an owner, operator, provider of maintenance service,
installer, lessor or seller of said device, or system of devices,
subject to the license requirements of this chapter.
CENTRAL ALARM STATION — Any facility operated by a
private firm that owns or leases a system of fire or police
alarm devices, which facility is manned by operators who
receive, record or validate alarm signals and relay information
about such validated signals to the Police or Fire Department
when appropriate. .
DIAL ALARM — Any fire or police alarm device which is a
telephone device or telephone attachment that automatically or •
electronically selects a telephone line connected to a central
alarm, station or police headquarters and reproduces a
prerecorded message to report a criminal act or other
emergency requiring the Police or Fire Department.
DIRECT ALARM — Any fire or police alarm device
connected directly by leased telephone wires from the specified
location to police headquarters or the Fire Department.

EMERGENCY ALARM — Any fire or -police alarm device
designed to be actuated by a fire, criminal act or other
emergency at a specific location or by a victim of a holdup,
robbery or other emergency or criminal act at a specified
location.
FALSE EMERGENCY ALARM — Any signal actuated by
an emergency alarm to which the Police or Fire Department
responds which is not the result of a fire, robbery or other
crime or emergency.
FIRE DEPARTMENTS — Buildings owned by the Fire
Districts of Mattituck, Cutchogue, Southold, East Marion or
Orient.
FIRE OR POLICE ALARM DEVICE — Any device which,
when actuated by a fire, criminal act or other emergency
requiring Police or Fire Department response, transmits a
prerecorded message or other signal by a telephone, radio or
other means to a central alarm station or directly to the Police
or Fire Department or produces an audible or visible signal
designed to notify persons within audible or visible alarm
range of the signal, except for residential smoke detectors/
alarms.
INTRUSION — Any entry into an area or building equipped
with one (1) or more police and fire alarm devices by any
person or object whose entry actuates a police alarm device.
LICENSING AUTHORITY — The Town of Southold or its
designated agent.
POLICE HEADQUARTERS — Police headquarters and
other enclosures housing privately or publicly owned equip-
ment serving the'police.
TOWN 'OF SOUTHOLD — All of the Town of Southold.

'§ 24-3. License required; :authority; ,applications.
A. It shall be unlawful for any business, firm, corporation or
other commercial entity to operate, 'maintain, install, lease or
sell a fire or police alarm device or devices, or system of fire or
police alarm devices, as defined by the terms of this chapter,
without first obtaining a license 'as hereunder provided.

B. Authority to grant licenses and permits.
(1) The licensing authority is hereby authorized to grant a
revocable license to any business, firm, corporation or
other commercial entity, authorizing said business, firm,
corporation or other commercial entity to do business in
the Town of Southold by performing any or all of the
following functions: owning, operating, maintaining,
installing, leasing or selling a fire or police alarm device
or devices or system of fire or police alarm devices.

(3) The licensing authority is hereby authorized to grant a --
revocable permit to any owner of property located within
the Town of Southold, or the lessee thereof, to operate,
maintain, install and modify a fire or police alarm device.
C. Applications for licenses and permits. Applications for licenses
and permits shall be made as follows:
(1) All businesses, firms, corporations or other commercial
entities which are in the business of owning, operating,
maintaining, installing, leasing or selling a fire or police
alarm device or devices, or system of fire or police alarm
device or devices, who desire to conduct business in the •
Town of Southold shall apply to the licensing authority
for a business license, on a form to be supplied by the
licensing authority. The application shall contain specific
provisions relating to the quality, efficiency and effective-
ness of the device or system of devices owned or to be

operated, maintained, installed, leased or sold by the
business licensee; testing procedures involved; and any
other information the licensing authority shall determine
to be law.
(2) Such business license shall be issued for a one-year
period, on a calendar -year basis or a part thereof, and no
license shall extend beyond December 31 of each year.
Notwithstanding this provision, a person having a
business license may conduct such business through
January 31 of the year following the expiration of his
business license.

(4) Any property owner or lessee of property in the Town of
Southold having on his or its premises a fire or police
alarm device, or system of fire or police alarm devices,
shall apply to the licensing authority for a permit to own
or otherwise have such device on his or its premises. The
application shall contain provisions relating to the device
or system of devices installed or to be installed on the
premises. Application for permits for fire or police alarm
devices existing in premises on the effective date of this
chapter must be made to the licensing authority by
December 31, 1987. No such device may be installed on
the premises of the owner or lessee and no presently
existing fire or police alarm device complying with the
provisions of this chapter shall be modified after the
effective date of this chapter prior to the licensing
authority's having issued a permit to such owner or
lessee. Such permit need not be obtained on an annual
basis but shall be obtained each time a device or system is
• to be installed or modified.
§ 24-4.• License fees.
License fees shall be as follows:

A. Business license: one hundred dollars ($100.) per calendar year
or part thereof.

C. Owner or lessee permit: no charge.
§ 24-5. User fees.
There shall be payable to the Town of Southold a fee of two dollars
($2.) per month for a fire or police alarm device or devices installed on
the premises of any owner or lessee. Such user fee shall be payable in
the first instance by the business licensee who services the fire or
police alarm device or devices of the owner or lessee, but, upon the
failure of the business licensee to make such payments when they
become .due, the owner or lessee of the premises shall thereupon
become liable for any unpaid user fees. Such user fees shall be paid to
the Town Clerk monthly in advance of the first day of each month.
Upon failure to make any such payment, the town shall have the right
to proceed by civil action to collect such user fees. Failure to make any
such payment after written notice .thereof has been given to the owner
or lessee shall subject such owner or lessee to the penalty provisions of
such law.
§ 24-6. Suspension or revocation of licenses. [Amended 4-5-88

A license issued under this chapter may be suspended or revoked by
the licensing authority after notice and hearing by the licensing
authority for theviolation of any of the provisions of this chapter or
any regulation or regulations promulgated by the licensing authority
pursuant to this chapter, and any license or identification card issued
hereunder shall be surrendered immediately to the'licensing authority •
upon such suspension or revocation. No part of a license fee shall be
refunded when a license is suspended or revoked. Any applicant
whose application for a license or permit has been denied or any ..
business licensee, owner or lessee whose license has been suspended or

revoked by the licensing authority may appeal such denial, suspension
or revocation in writing to the Town Board at.a time and place to be
determined by the Town Board in support of his or its contention that
the license should not have been denied, suspended or revoked.
§ 24-7. Records to be kept and provided.
Every business, firm, corporation or other commercial entity
conducting the business of owning, operating, installing, leasing or
selling fire or police alarm devices within the Town of Southold shall
maintain complete and accurate records of all installations of alarm
systems in the Town of Southold and shall provide such records on a
monthly basis for the licensing authority.
§ 24-8. General Provisions.
A. Restrictions. No fire or police alarm device shall be connected
directly to the Town of Southold police headquarters or any
Fire Department without the express written consent of the
Chief of Police or Board of Fire Commissioners, respectively.
B. Direct alarm system. Any private firm engaged in the
business of burglar alarms or fire alarms and licensed by the
Town of Southold will operate a facility which is manned by a
trained operator who receives, records and validates alarm
signals and relays information about such validated signals to
the Southold Town Police Department or Fire Department on
a special telephone number set aside for the express purpose of
receiving such information. All central station alarm facilities
shall have the capability to' electronically supervise all alarm
systems so that a trouble signal is indicated should there be a
is
fault with any alarm system. The operator of any central
alarm company which calls police headquarters or the Fire
Department to report an actice alarm will identify himself or
herself by name and the name of the company and will provide
accurate directions to the protected premises at which the
alarm is sounding. The central alarm company shall further
provide the name of the caretaker., who is responsible for
resetting an activated alarm if the property owner or lessee of

the property is away. In the event that the caretaker is
unavailable, the alarm company shall be responsible' for
resetting an activated alarm.
i C. 'Audible alarm device. Any property owner or lessee of
property in the Town of Southold shall, prior, to the installation
of an audible signal designed to notify persons within the
audible range of the signal, obtain a permit for same. Any
such .alarm device which operates on house current must be
equipped with a standby battery power supply sufficient for at
least twenty-four' (24) hours. Any such alarm device will
incorporate a device whereby the system will automatically
shut off and/or reset the audible alarm after the alarm has
sounded for a maximum period of thirty (30) minutes. All
property .owners or lessees having such alarm devices on their
premises shall further be required to provide the Police
Department and Fire Department with the name of a person
who can respond to the premises within a reasonable time.
Said person shall have the capability of securing or, in the case
of fire, opening up said premises for inspection by the Fire
Department. Every such audible alarm device must be
equipped with a switch to silence the audible alarm.
D. Intentional false alarm. It shall be a violation of this chapter to
intentionally cause a false holdup alarm, and any person who
does intentionally cause a false holdup alarm shall be subject
to the penalty provisions hereof.
j E. Charges for false emergency alarms.
(1) Any owner or lessee of property having a fire or police
alarm device, or system of fire or police alarm devices, on
his or its premises on the effective date of this chapter
and any user of services or equipment furnished by a
i licensee under this chapter, shall pay to the Town of
Southold a charge for each and every false emergency
alarm to which the Police or Fire Department responds
in each calendar year, as follows:
(a) First and second false emergency alarm, each
calendar year: no charge.

(b) Third and all subsequent false emergency alarms,
each calendar year: one hundred dollars ($100.).
(2) The above charges shall be paid to the Town Clerk of the
Town of Southold. Failure to pay any such charges shall
subject such owner, lessee or user to the penalty
provisions of this chapter.
F. Rules, regulations and enforcement. The licensing authority
shall promulgate rules, regulations and standards which shall
be approved by the Town Board that may be necessary for the
purpose of assuring the quality, efficiency and effectiveness of
fire or police alarm devices and alarm installations owned,
operated, maintained, installed, leased or sold by a licensee
under this chapter and to facilitate the administration of this
chapter. The licensing authority shall administer and enforce
the provisions of this chapter. The aforesaid rules, regulations
and standards shall be set forth in writing, and copies shall be
available for applicants.
§ 24-9. Special provisions.
A. Central alarm station systems. The licensing authority is
hereby authorized to prescribe the locations and the manner of
installation of regular business telephone lines into police
headquarters from a central alarm station for the express
purpose .of providing direct telephone communication between
the central alarm station and police headquarters for use in
reporting alarms.
B. Exceptions. None of the provisions of this chapter shall apply
to a fire or police alarm device or devices installed in a motor
vehicle or trailer.
• C. Severability. If any part or parts of this chapter are for any
reason held to be invalid, such decision shall not affect the
validity of the remaining portions of this chapter. The Town
Board hereby declares that it would have passed the local law
enacting this chapter and each section, subsection, sentence,
clause and phrase thereof, irrespective of the fact that any one
(1) or more sections, subsections, sentences, clauses or phrases
might be declared invalid.

Any person, firm or corporation who does not pay any charge or fee
established in this chapter shall be subject to a fine not in excess of
two hundred fifty dollars ($250.) for each offense. A separate offense
shall be deemed committed, upon each day during which a violation
occurs or is committed, and such violation shall be construed as ' a
violation against this chapter.

ducted in violation of the provisions of this chapter or not
in compliance with a permit issued pursuant to this
chapter, he may notify the owner of the property or the
owner's agent or the person performing such operations to
suspend all operations, and any such person shall forthwith
cease operations until such notice of violation has been
rescinded.
B. Such notice shall be in writing, shall specify the violation
and shall state the conditions which must be complied with
and the time within which compliance must be completed
before operations may be resumed. Such notice shall also
inform the person to whom it is directed of his right to
apply for a hearing before the Board of Trustees of the
Town Southold, as, hereinafter provided.
C. Such notice shall be served upon the person to whom it is
directed by delivering it to him personally or by posting
the same in a conspicuous place on the premises where
operations are being conducted and mailing a copy thereof
to such person by certified mail to his last known address.
D. The Bay Constable may extend the time of compliance
specified in the notice of violation where there is evidence
of intent to comply within the time specified and conditions
exist which prevent immediate compliance.
E. In the event that the person upon whom a notice of
violation has been served shall fail to comply with said
notice within the time specified- therein "or within the time
specified in any extension of time issued by the Bay
Constable, any permit issued to such person pursuant to
this chapter shall be deemed revoked.
F. It shall be unlawful for any person served with a notice of
• violation pursuant to. § 32-51C to fail'td comply with such "

§ 32-52. Hearing.
A. Any person affected by a notice of violation issued. pun.
suant to the preceding section hereof may request and shall

be granted a hearing before the Board of Trustees,
provided that such .person shall file a written request
therefor with the Town Clerk within ten (10) days after
service of the notice of violation. Such request shall have,
annexed thereto a copy of the notice of violation upon
which a hearing is requested and shall set forth the reasons
why such notice of violation should be modified or
rescinded.
B. The Town Clerk shall present such request to the Board of
Trustees at its next regular meeting. The Board of
Trustees shall set a time and place for such hearing and
shall give the person requesting the same at least five (5)
days' notice of the time and place thereof.
C. At such hearing, the person requesting the same or his
representative shall be given an opportunity to show cause
why such notice of violation should be modified or
rescinded. After such hearing, the Board of Trustees may
sustain, modify or rescind such notice of violation or
revoke any permit previously issued and shall specify the
reasons therefor.
D. The notice of violation for which a hearing is requested
shall continue in effect pending the hearing and deter-
mination of the Board of Trustees.
§ 32-53. Compliance required; penalties for offenses.
A. It shall be unlawful for any owner, occupant, builder,
architect, contractor or their agents or any person to fail to
comply with any .provisions of this chapter or to fail in any
manner to comply with a written notice, directive or order of
the Bay Constable or to conduct any operation in a manner not •
in compliance with a permit issued pursuant to this chapter.

B. For every offense against any of the provisions of this .
chapter or any regulations made pursuant thereto or failure
to comply with a written notice or order of .the Bay Con-
stable within the time fixed for compliance therewith; the
owner, occupant, builder, architect, contractor or their

agents or any other person who commits, takes part or
assists in the commission of any such offense or who shall
fail to comply with a written order or notice of the Bay
Constable shall, upon conviction thereof, be guilty of a
violation punishable by a fine not exceeding two hundred
fifty dollars ($250.) or by imprisonment for a period not to
exceed six (6) months, or by both such fine and im-
prisonment. Each day's continued offense shall constitute
a separate, additional violation.
C. In addition to the above -provided penalties, the town may also
maintain an action or proceeding in a court of competent
jurisdiction to compel compliance with or to restrain by
injunction the violation of this chapter.

§ 59-10. Title.
This chapter shall be known and may be cited as the "Open Space
or Open Area Preservation Law of the Town of Southold."

§ 59-20. Findings.
The Town Board of the Town of Southold finds that the acquisition
of open space or open area in lands located in the Town of Southold,
if preserved and maintained in their present open state, is in the
public interest and a proper purpose of the town in accordance with
the findings and determination of the New York State Legislature, as
set forth in § 247 of the General Municipal Law.

§ 59-30. Definitions.
As used in this chapter, the terms used herein are defined as
follows:
ACQUISITION — To accept, by purchase, gift, grant,
bequest, devise, lease or otherwise, the fee or any lesser interest
or right in real property, including but not limited to
development rights.
ALIENATION The transfer of . the fee or any lesser
interest in real property from the Town of Southold to another.
COMMITTEE — The Southold Town Open Space
Committee.
DEVELOPMENT RIGHT — The permanent legal interest
or right to prohibit or restrict the use of land for any purpose
other than open space or open area.

OPEN SPACE or OPEN AREA — Any space or area
characterized by natural scenic beauty or whose existing
openness, natural condition or present state of use, if retained,
would maintain or enhance the conservation of natural or
scenic resources.
STRUCTURE — Anything constructed or erected in, on or
under the ground or attached to anything having a location on
or under the ground, including fences.

§ 5940. Acquisition.
A. Upon authorization by the Town Board, the Supervisor shall
solicit offers for the sale to the town. of the fee or any lesser
interest or right in real property as may be recommended by
the Committee.
B. Upon the receipt of such offer or offers, the Town Board shall
cause an appraisal or appraisals to be made of the market
value of the fee or any lesser interest or right in such real
property being offered.
C. After receipt of such appraisal or appraisals, the Town Board
shall hold a public hearing on the question of the acceptance of
such offer or offers.
D. Within sixty (60) days after such hearing, the Town Board
shall adopt a resolution either accepting or rejecting such offer
or offers.

§ 59-50. Alienation of fee, interest or right; instrument of
conveyance; Open Space Committee. .
A. The fee or any lesser interest or right acquired by the town
pursuant to the provisions ,of this chapter shall not thereafter

be alienated except upon the affirmative vote of a majority of
the Town Board after a public hearing thereon and upon the
approval by the electors of the town voting on a proposition
submitted at a special or biennial town election. No subse-
quent amendment of the provisions of the subsection shall alter
the limitation imposed upon the alienation of the fee or any
lesser interest or right acquired by the town prior to any such
amendment.
B. The instrument of conveyance transferring the fee or any
lesser interest or right in real property to the Town of
Southold shall be executed by the Supervisor on behalf of the
Town of Southold and the grantors and shall contain a
covenant specifically setting forth the limitations on the
alienation of the fee or any lesser interest or right and the
limitations on the use and enjoyment of the estate or interest
reserved by the use and enjoyment of the estate or interest
reserved by the grantor as the same are set forth as of the date
of the contract for sale of said fee or any lesser interest or
right.
C. Open Space Committee.
(1) The Committee shall consist of five (5) members to be
appointed by and serve at the pleasure of the Town
Board. The Chairman of the Committee shall be
designated by the Town Board.
(2) Duties of the Committee.
(a) The Committee shall perform the following duties:
[1] To recommend to the Town Board lands in
which the fee or any lesser interest or rights
should be acquired by the town.
[2] To review all matters relevant to open space or •
open areas.
[3] To serve as a review board for the granting of
permits for the construction, reconstruction and
additions of and to structures in or on the lands
in which the fee or any lesser interest or rights
have been acquired by the town.

[4] To promulgate such rules and regulations as
may be deemed necessary to govern the admin-
istration, procedures and duties of the Commit-
tee, -which rules and regulations shall not
become effective until approved by the Town
Board.
[5] To prepare, amend and maintain appropriate
maps delineating open space or open area lands,
lands in which the fee or any lesser interests or
rights have been acquired, lands in which the
fee .or any lesser interest or rights are proposed
to be acquired and such other information as
may be deemed appropriate.
[6] To perform such other duties and functions as
may, from time to time, be directed by the
Town Board.
(b) The Committee shall be authorized to incur such
expenses in the performance of its duties shall .be
appropriated therefor by the Town Board.

Should any provisions of this chapter be adjudged invalid by a court
of competent jurisdiction, such , adjudication shall not affect the
validity of any other provisions of this chapter.

ARTICLE I
General Provisions
§ 75-1.1. Title.
This chapter, shall be known and may be cited as the "Southold
Scavenger Waste Disposal Law."
§ 75-1.2. Definitions.
Unless the context indicates otherwise, the following terms shall, for
the purpose of this chapter, have the meanings herein indicated:
BOARD — The Southold Town Board, acting for and on be-
half of the Southold Wastewater Disposal District.
CARTER — Any trucker, hauler or enterprise that is li-
censed within the District to provide on-site system pumping
and other maintenance assistance.
CESSPOOL — Any cesspool which essentially operates as a
combined septic tank/drain field process: Since the solids re-
main in one (1) tank, they tend to clog more quickly than sep-
tic tanks which have drain field systems. Although these sys-
tems were previously in widespread use, they are not ac-
ceptable for new. construction due to their inefficiencies.
DISTRICT — The Southold Wastewater Disposal District.
DRAIN FIELD = A tile field consisting of perforated pipes
in below -ground .trenches, which allow the clarified effluent
from the septic tank to percolate to the groundwater (under-
ground water) or a circular below -grade tank with openings
constructed in the sidewalls which provide for drainage of the
treated liquid.
EASEMENT.— An interest in land owned by another that
entitled its holder to a specific limited use.
ON-SITE SYSTEM — Any below -grade cesspool, septic tank
and drain field as defined herein for the disposal of sanitary
sewage and normal domestic wastes.
PERSON — Any person, firm, partnership, association, cor-
poration, company, organization or other legal entity of any

E. Cesspool cleaning and drain opening products which are
prohibited by Article 39. of the -New York State Conservation ..
Law, or Suffolk County Local Law No. 12-1980.
§ 75-10.2. Discharge.
• No person shall .knowingly discharge prohibited waste at the .
Southold Scavenger Waste Pretreatment Facility.
ARTICLE XI
Administration and Enforcement
§ 75-11.1. Administration and enforcement officer.
The Town Board shall appoint a Sanitation Inspector (referred to in
this chapter as the "Inspector") who shall administer and enforce the
provisions of this chapter.
§ 75-11.2. Notice of violation.
A. Whenever the Inspector has reasonable grounds to believe
that operations regulated hereby.are being conducted in vio-
lation of the provisions of this chapter or not in compliance
with a permit or license issued pursuant to this chapter,. he
may notify the owner of the property or the owner's agent or
the person performing such operations, or the carter, to sus—
pend all operations, and any such person shall forthwith cease
operations until such notice of violation has been rescinded.
B. Such notice shall be in writing, shall specify the violation and
shall state the conditions which must be complied with -and
the time within which compliance must be completed before.
i - operations may be resumed.
C. Such notice shall be served upon the person to whom it is .
directed by delivering it to him personally or by posting the
same in a conspicuous place on the premises where operations
are being conducted and mailing a copy thereof to such per-
son by certified mail to his last known address.

D. The Inspector may extendthe time of compliance specified in
the notice of violation where there is evidence of intent to
comply within the time specified and conditions exist which
prevent immediate compliance.
E. In the event that the person upon whom a notice of violation
has been served shall fail to comply with said notice within
the time specified therein or within the time specified in any •
extension of time issued by the Inspector, any permit or li-
cense issued to such person pursuant to this chapter shall be
deemed revoked.
F. It shall, be unlawful for any person served with a notice of
violation pursuant to § 75-11.2C to fail to comply with such

§ 75-11.3. Compliance required; penalties for offenses.
A. It shall be unlawful for any carter, owner, occupant, builder,
architect; contractor or their agents or any other person to fail
to comply with a written notice, directive or order of the
Inspector or to conduct any operation in a manner not in
compliance with a permit issued pursuant to this chapter.

B. For each offense against any of the provisions of this chapter
or any, regulation made pursuant thereto or failure to comply
with a written notice or order of the Inspector within the time
fixed, for compliance therewith, the carter, owner, occupant,
builder, architect, contractor or their agents or any other per-
son who commits, takes part or assists in the commission of
any such offense or who shall fail to comply with a written
order or notice of the Inspector shall, upon a first conviction
thereof, be guilty of a violation punishable by a fine of not, •
exceeding five hundred dollars ($500.) or imprisonment for a
period .not to exceed fifteen (15) days, or both. Each day on
which' such violation shall occur shall constitute a separate,
additional offense. For. a second and subsequent conviction
within eighteen (18) months thereafter, such person shall be
guilty of a violation punishable by a fine not exceeding one

thousand five hundred dollars ($1,500.) or imprisonment for a
period not to exceed fifteen (15).days, or both such fine and
imprisonment.
C. In addition to the above -provided penalties, the Board may also
maintain- an action or proceeding in the name of the District;
in a court of competent jurisdiction, to compel compliance with
or to restrain any injunction the violation of this chapter.

A. Real property owned by one (1) or more persons, each of
whom is sixty-five (65) years of age or over, or real property
owned by husband and wife, one (1) of whom is sixty-five (65)
years of age or over, shall be exempt from town taxes to the

extent of fifty percent (50%) of the assessed valuation thereof.
Such exemption shall be computed after all other partial ex-
emptions allowed by law have been subtracted from the total
amount assessed.
B. The real property tax exemption on real property owned by
husband and -wife, one (1) of whom is sixty-five (65) years of
age or over, once granted, shall not be rescinded solely be-
cause of the death of the older spouse, so long as the surviving
spouse is at least sixty-two (62) years of age.
§ 85-2. Conditions. [Amended 3-12-85 by L.L. No. 3-1985]
No exemption shall be granted:
A. If the income of the owner or the combined income of the
owners of the property for the income tax year immediately
preceding the date of making application for exemption
exceeds the sum of twelve thousand dollars ($12,000.). "Income
tax year" shall mean the twelve-month period for which the
owner or owners filed a personal income tax return or, if no
return is filed, the calendar year. Where title is vested in �-
either the husband or the wife, their combined income may not
exceed such sum. Such income shall include social security
and -retirement benefits; interest; dividends; total gain from
the sale or exchange of a capital asset, which may be offset by
a loss from the sale or exchange of a capital asset in the same
income tax year; net rental income, salary or earnings; and the
net income from self-employment, but not including a return
of capital, gifts or inheritances. In computing net rental
income and net income from self-employment, no depreciation
deduction shall be allowed for the exhaustion, wear and tear of
real or personal property held for the production of income.

B. Unless the title of the property, shall have been vested in the
owner or one (1) of the owners of the property for at least.
twenty-four (24) consecutive months prior to the date of mak-
ing application for exemption; provided, however, that in the

§ 97-10. Title.
This chapter -shall be known and may be cited as the "Wetlands .
Ordinance of the Town of Southold."
§ 97-11. Declaration of policy.
A. The Town Board of the Town of Southold finds that rapid
growth, the spread of development and increasing demands
upon natural resources are encroaching upon or eliminating
many of its wetlands, which, if preserved and maintained in,
an undisturbed and natural condition, constitute important
physical,, social, aesthetic, recreational and economic assets. -to
existing and future residents of the Town of Southold.
B. It is the intention of this chapter to protect the ,citizens of the.
Town of Southold by providing for the protection, preservation,
proper maintenance and use of its wetlands

It shall be the duty of the Bay Constables (hereinafter referred to
as the "Bay Constable") to administer and enforce the provisions of
this chapter.

violation of the provisions of this chapter or not in compliance
with a permit issued pursuant to this chapter, he may notify
the owner of the property, or the owner's agent or the person
performing such operations, to suspend all operations; and
any such person shall forthwith cease operations until such

§ 97-32. Hearing on violation. [Amended 6-5-84 by L.L. No. 6-

A. Any person affected by a notice of violation issued pur-
suant to the preceding section hereof may request and shall
be granted a hearing before the Trustees, provided that
such person shall file a written request therefor with the
Clerk within ten (10) days after service of the notice of
violation. Such request shall have annexed thereto a copy
of the�notice of violation upon which a hearing is requested
and shall set forth the reasons why such notice of violation
should be modified or rescinded.
B. The Clerk shall present such request to the Trustees at its
next regular meeting. The Trustees shall set a time and'
place for such hearing and shall give the person requesting
the same at least five (5) days' notice of the time and place •
thereof.
C. At such hearing, the person requesting the same, or his
representative;_ shall be given an opportunity to show cause
why such notice of violation should be modified or
rescinded. After such hearing, the Trustees may sustain,
modify or rescind such notice of violation, or revoke any

permit "previously issued, and shall specify the reasons .
therefor.
D. The notice of violation for which a hearing is requested
shall continue in effect pending the hearing and de-
termination of the Trustees.
